About approval of the Regulations on procedure for selection of persons who can perform works (to render services) to insolvent banks or banks which are liquidated, Fund of guaranteeing household deposits

According to Item 10 parts one, to Item of 1 part five of article 12 of the Law of Ukraine "About system of guaranteeing household deposits" the executive directorate of Fund of guaranteeing household deposits solved:

1. Declare invalid the decision of executive directorate of Fund of guaranteeing household deposits of July 23, 2012 No. 12 "About approval of the Regulations on procedure for attraction by the authorized person of Fund of guaranteeing household deposits of advisers, auditors, lawyers and other persons to work in the course of implementation of temporary administration or liquidation of bank", registered in the Ministry of Justice of Ukraine on August 13, 2012 at No. 1364/21676 (with changes).

2. Approve Regulations on procedure for selection of persons who can perform works (to render services) to insolvent banks or banks which are liquidated by Fund of guaranteeing household deposits which is applied.

3. To fund of guaranteeing household deposits (further - Fund) in time no later than 30 working days from the date of entry into force of this decision to begin carrying out planned qualification selection.

Persons included in the list of persons selected by executive directorate of Fund are in such list before approval date executive directorate of Fund of the list of persons selected by Fund for activities by results of the made planned qualification selection.

4. To provide to department of strategy and normative and methodological providing together with legal department submission of this decision to the Ministry of Justice of Ukraine for state registration.

5. And the international organizations to provide to department of public relations placement of this decision on the official page of Fund on the Internet after its state registration.

6. This decision becomes effective from the date of its official publication.

7. I reserve control of execution of this decision.

Regulations on procedure for selection of persons who can perform works (to render services) to insolvent banks or banks which are liquidated, Fund of guaranteeing household deposits

I. General provisions

1. This Provision determines conditions and procedure for selection of persons which can perform works (to render services) to insolvent banks or banks which are liquidated, by the following directions:

1) "Legal consultants" (including "Work with assets");

2) "Collection of overdue debt of borrowers and other debtors of bank";

3) "Services of online service for repayment of the credits of borrowers of insolvent banks or banks which are liquidated, by means of payment cards and other services of online service";

4) "Services of the virtual room of data";

5) "Archiving of documents";

6) "Digitization (scanning) of documents";

7) "Broker services in security sale";

8) "Financial consultants" (including "Conducting financial accounting and maintenance of maintaining register of requirements of creditors");

9) "Organization of open tenderings (auctions)";

10) "Auditor services";

11) "Adviser of the authorized person Fonda of guaranteeing household deposits";

12) "Subjects of estimative activities";

13) other directions which are not provided in subitems 1 - 12 these Items.

Requirements of this provision do not extend to performance of works (rendering the services) necessary for implementation of requirements of Article 41-1 - the Law of Ukraine "About system of guaranteeing household deposits" (further - the Law), deliveries of goods to insolvent banks or banks which are liquidated.

2. Terms in this Provision are used in the following values:

responsible structural division - the structural division of Fund of guaranteeing household deposits (further - Fund) which is responsible for the organization of qualification selection of persons who can perform works (to render services) to insolvent banks or banks which are liquidated, and maintaining the list of persons selected by Fund for activities (further - the List);

service - any activities (except production of goods and performance of works);

work - designing, construction new, expansion, reconstruction, capital repairs and restoration of the existing objects and constructions of production and non-productive appointment, technical retrofitting of operating plants and services accompanying works included in the estimated cost of works if the cost of such services does not exceed the cost of works;

the participant of qualification selection (further - the participant) - the physical person, physical person entrepreneur, the legal entity (the resident or the nonresident) who submitted the qualification proposal.

3. Selection of persons for performance of works (rendering services) to insolvent bank or the liquidated bank, is performed in the following procedure:

the procedure of qualification selection on the right of rendering services (performance of works) in the corresponding direction of Fund as to the temporary administrator / liquidator or the authorized person of Fund is carried out (in case of delegation to it Fund of appropriate authority);

the List is constituted.

4. The organizer of holding procedure of qualification selection of persons who can perform works (to render services) to insolvent banks or banks which are liquidated is the Fund.

5. Planned qualification selections are performed by Fund at least once in 2 years. If necessary the Fund can make additional qualification selections.

6. Qualification selections (planned and additional) are carried out for the purpose of inclusion of persons in the List.

The list is valid before approval of the new List, by results of carrying out planned qualification selection.

7. The list affirms executive directorate of Fund.

8. Holding procedure of qualification selection performs the committee determined by Fund (further - Committee).

9. Under the organization and carrying out qualification selection the Fund has no right:
