AIR CODE OF THE REPUBLIC OF UZBEKISTAN

Section I. General provisions

Article 1. Sovereignty over airspace

The Republic of Uzbekistan possesses complete and exclusive sovereignty over the airspace located over the overland and water territory of the republic.

Airspace of the Republic of Uzbekistan is part of its state territory.

Article 2. Legislation on use of air

The relations in the field of use of airspace of the Republic of Uzbekistan and activities of all its users, including aircraft in the territory of the Republic of Uzbekistan are regulated by this Code, Regulations on use of airspace of the Republic of Uzbekistan, the Basic rules of flights of aircraft in airspace of the Republic of Uzbekistan approved by the Cabinet of Ministers of the Republic of Uzbekistan, and also Rules of flights of civil and experimental aviation in airspace of the Republic of Uzbekistan and the Rules of flights of the state aircraft in airspace of the Republic of Uzbekistan approved respectively by Aviation administration of the Republic of Uzbekistan and the Ministry of Defence of the Republic of Uzbekistan, and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about use of airspace and activities of aircraft then are applied rules of the international treaty.

Article 3. Coverage of the Air code of the Republic of Uzbekistan

The air code of the Republic of Uzbekistan determines procedure for activities of aircraft, other activities for use of airspace for the purpose of protection of interests of the state. Safety-of-life functions of air vehicles and requirements satisfaction of the national economy of the Republic of Uzbekistan and citizens: extends to all aircraft of the Republic of Uzbekistan, except Articles 24, of 25, of 33, of 38, 43-46, 50, of 53, of 54, of 56, 94-135, extending only to civil aviation.

Article 4. Public administration and control in the field of use of airspace and activities of aircraft

Public administration and control in the field of use of airspace is imposed on the Ministry of Defence of the Republic of Uzbekistan according to Regulations on use of airspace.

Management and control in sphere of activity of civil and experimental aviation are performed by Aviation administration of the Republic of Uzbekistan.

Management and control in sphere of activity of the state aircraft within the competence the Ministry of Defence, Service of state security, National guard, the Ministry of Internal Affairs, and also according to the decision of the Cabinet of Ministers of the Republic of Uzbekistan exercise other state bodies.

Article 5. Participation of the non-state organizations and citizens in development and implementation of actions for regulation of use of airspace and activities of aircraft.

Commercial, public and other non-state organizations and citizens have the right to take part in development and implementation of actions for rational, effective and safe use of airspace and activities of aircraft.

State bodies consider offers of commercial, public and other non-state organizations and citizens in case of development and implementation of the specified actions.

Section II. Use of airspace

Chapter I. Regulation of use of airspace

Article 6. The activities connected with use of airspace

Flights of air vehicles and other flight vehicles, all types of firing practice and rockets firings, explosive works and other activities connected with movement in airspace of material objects belong to the activities connected with use of airspace of the Republic of Uzbekistan.

Article 7. Users airspace

Airspace users of the Republic of Uzbekistan are the companies, organizations, the organizations and citizens of the Republic of Uzbekistan, and also other states performing the activities specified in article 6 of this Code, officially registered in state bodies of the Republic of Uzbekistan.

Article 8. Structure of airspace

For implementation of the activities connected with use of airspace in airspace service areas of air traffic, areas of airfields and airline hubs, the airways, routes and special flying areas of air vehicles, areas of uncontrollable flights, prohibited areas and zones of restriction, regions of polygons, areas of explosive works, other special elements forming structure of airspace of the Republic of Uzbekistan in the set are established.

The organization of use of airspace shall be performed in case of respect for the universally recognized norms on environmental protection.

Article 9. Priorities in use of airspace

All users airspace have the equal rights and bear identical responsibility in the territory of the Republic of Uzbekistan when implementing the activities connected with use of airspace.

The attribution of utilization of part of airspace in the presence of two or the users who were more interested in it is provided by airspace according to the following priorities:

a) reflection of air attack or prevention and the termination of violation of frontier of the Republic of Uzbekistan, liquidation of use of force or threat of use of force against sovereignty, territorial integrity, political independence and public safety of the Republic of Uzbekistan:

b) assistance in case of natural or other disasters, catastrophic crashes, accidents, emergency situations, life-threatening and to human health or creating danger of the population of significant economic damage;

c) start, landing, search and evacuation of spacecrafts and their crews;

d) prevention and termination of violations of procedure for use of airspace;

e) flights of air vehicles or other activities performed according to decisions of the Cabinet of Ministers of the Republic of Uzbekistan;

e) flights of air vehicles or other activities performed according to international agreements of the Republic of Uzbekistan;

g) regular public conveyances;

h) flights of the state aircraft of the Republic of Uzbekistan, and also other states according to special rules;

i) carrying out experimental and research works;

j) regular carriages of goods and mails;

k) non scheduled air transports, accomplishment of aerial and other works for the benefit of the national economy;

l) holding training, demonstration, cultural and educational and other events;

m) the activities connected with satisfaction personal needs of citizens;

o) other activities.

Article 10. The bodies performing operational regulation of use of airspace

Operational regulation of use of airspace is performed within the competence by the bodies specified in Article 4.

Article 11. Permission to use of airspace

The activities connected with use of airspace are allowed in case of observance of necessary security measures only after receipt of permission of the bodies specified in Article 4, through controls by use of airspace (UIVP).

Instructions of controls use of airspace are obligatory for all users airspace.

Article 12. Prohibition and restriction of use of airspace

Use of airspace of the Republic of Uzbekistan or its certain areas can be forbidden or limited for implementation of the activities specified in article 6 of this Code, controls by use of airspace.

Article 13. Organization of communication

The ministries, departments, the companies, organizations, the organizations and the citizens interested in use of airspace shall organize communication channels with relevant organs of Aviation administration, the Ministry of Defence, and in case of use of airspace for accomplishment of flights of air vehicles and with bodies of antiaircraft protection of the Republic of Uzbekistan.

Telecommunications agencies provide in lease to users necessary channels and communication devices. In case of incapacitation of the provided communication channels and devices they shall be in accordance with the established procedure replaced by others.

All international and intercity phones and telegraph public are established and operate the companies the Ministry of development of information technologies and communications of the Republic of Uzbekistan.

Communication by the international and intercity phones and telegraph in first-priority procedure is provided during the carrying out search and rescue works and assistance in emergency situations.

Article 14. Violations of procedure for use of airspace

The activities connected with use of airspace of the Republic of Uzbekistan which is performed with violation of this Code and other regulations developed according to it are recognized violation of procedure for use of airspace of the Republic of Uzbekistan.

The bodies exercising control of observance of procedure for use of airspace shall take measures for the termination or crossing of violations of procedure for use of airspace.

Users airspace, and also the legal entities and physical persons which are not connected with aviation activities, allowed violation of procedure for use of airspace or made the actions which caused safety hazard of flights of air vehicles shall upon the demand of the specified bodies at own expense or by own efforts to stop the specified violation or implementation of such activities.
