For the purpose of protection of surface water and prevention of ecologically harmful impact of economic and other activity on water objects, according to the Water code of the Kyrgyz Republic, the laws of the Kyrgyz Republic "About environmental protection", "About water", "About public health care", articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Rules of protection of surface water of the Kyrgyz Republic according to appendix.

2. This resolution becomes effective after fifteen days from the date of official publication.

Rules of protection of surface water of the Kyrgyz Republic

1. General provisions

1. These rules of protection of surface water of the Kyrgyz Republic (further - Rules) regulate questions of protection of surface water from pollution, contaminations and depletions, when implementing by water users of different types of economic activity which make or can make adverse effect on condition of surface water, irrespective of their form of business, and also regulate procedure of actions for protection of surface water.

2. Authorized state bodies in the field of the water relations and water users when implementing the activities for protection of surface water are guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic and other regulatory legal acts of the Kyrgyz Republic, and also these rules.

2. The basic concepts used in Rules

The assimilating capability of water object - capability of water object to accept certain mass of substances in unit of time without violation of regulations of quality of water in control alignment (Item) of water use.

Water object - any concentration of surface water, including the rivers, streams, springs, lakes, swamps, glaciers and snow patches.

Water users - legal entities and physical persons of the Kyrgyz Republic, and also foreign physical persons and legal entities, including stateless persons which activities exert impact on condition of surface water.

Waterway - the water object characterized by permanent or temporary movement of water in bed in the direction of general bias.

Waterways are subdivided into the following categories:

- permanent and temporary;

Drainage water - the underground water which is taken away from the irrigated and drained land arrays, is included into concept of waste water.

Pollution of waters - process of change of structure and properties of water in water object as a result of receipt of pollutants in it.

Contamination of waters - accumulating in water objects of foreign objects.

Depletion of waters - steady reducing inventories and quality degradation of surface water.

Source of impurity - object from which in natural waters impurity of the dissolved, colloid or weighed substances arrive.

Controlled indicators - the indicators of structure and properties of water which are subject to control when checking observance of the established regulations of quality of water in water object and on release of sewage.

Control alignment - the cross section of flow in which quality of water is controlled.

Cultural and community water use - use of surface water for bathing, sports and rest of the population. The quality requirements of water established for cultural and community water use extend to all sites of the water objects which are within settlements, irrespective of use type.
