ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of forming of the list of subjects of production of precious metals

According to the subitem 10) article 4 of the Law of the Republic of Kazakhstan of January 14, 2016 "About precious metals and gemstones" PRIKAZYVAYU:

1. Approve the enclosed Rules of forming of the list of subjects of production of precious metals.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information within five working days from the date of receipt of the registered order for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after day of its first official publication.

Rules of forming of the list of subjects of production of precious metals

1. General provisions

1. These rules of forming of the list of subjects of production of precious metals (further - Rules) are developed according to the subitem 10) of article 4 of the Law of the Republic of Kazakhstan of January 14, 2016 "About precious metals and gemstones" (further - the Law) and determine procedure for forming of the list of subjects of production of precious metals (further - the List).

2. In these rules the following basic concepts are used:

1) refining - process of purification of precious metals of impurity and the accompanying components, bringing precious metals to the quality conforming to the national or international standard;

2) precious metals - gold, silver, platinum and metals of platinum group (palladium, iridium, rhodium, ruthenium and osmium) in any condition and type;

3) subjects of production of precious metals - the legal entities of the Republic of Kazakhstan performing production of precious metals in the territory of the Republic of Kazakhstan;

4) the primary goods containing precious metals - the raw precious metals (including Dore's alloy in the form of ingot, cathodic metals), zinc rainfall, scrap and waste of precious metals, ores and concentrates of precious metals, the ores, concentrates and ashes of non-ferrous metals, semi-products of production of non-ferrous metals containing precious metals;

5) authorized body - the central executive body performing management and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination in the field of regulation of production of precious metals and turnover of precious metals and gemstones, the primary goods containing precious metals, jewelry and other products.

2. Procedure for forming of the list of subjects of production of precious metals

The subjects of production of precious metals which are performing conversion and (or) refining of the precious metals and primary goods containing precious metals and submitted the notification on introduction of the subjects of production of precious metals this in the list (further - the Notification) in form, according to appendix 1 to these rules are included in the List.

4. The list of subjects of production of precious metals is created in form, according to appendix 2 to these rules and affirms authorized body. Entering of data into the List is performed by authorized body based on the notification.

5. The authorized body considers the notification within 5 working days from the date of its receipt with removal of one of the following decisions:

1) about inclusion of the subject of production of precious metals in the List;

2) about refusal in inclusion of the subject of production of precious metals in the List.

6. The basis for refusal in inclusion of the subject of production of precious metals in the List is discrepancy of the notification provided by the subject of production of precious metals to form according to appendix 1 to these rules.

7. The decision on inclusion in the List are accepted in the form of the order of authorized body which is subject to placement on Internet resource of authorized body.

8. In cases of change of the data entered in the List, the subject of production of precious metals notifies authorized body in any form based on which the authorized body makes corresponding changes to the List within 5 working days from the moment of receipt of the notification.

9. In case of the termination by the subject of production of precious metals of activities for conversion and (or) refining of the precious metals and primary goods containing precious metals, this subject of production of precious metals is excluded by authorized body from the List based on its notification provided in any form within 5 working days from the moment of receipt of this notification.
