About approval of the Procedure for the state control (supervision) of the goods which are subject to sanitary and epidemiologic and veterinary control (supervision) to which the Republic of Kazakhstan applies the requirements different from requirements of the Eurasian Economic Union, and products made from them

For the purpose of non-admission on the territory of the Kyrgyz Republic of goods to which the Republic of Kazakhstan applies the requirements different from requirements of the Eurasian Economic Union according to the Protocol on some questions of import and the goods circulation on customs area of the Eurasian Economic Union signed on October 16, 2015 articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve the Procedure for the state control (supervision) of the goods which are subject to sanitary and epidemiologic and veterinary control (supervision) to which the Republic of Kazakhstan applies the requirements different from requirements of the Eurasian Economic Union, and products made from them (further - controlled goods), according to appendix.

2. The state inspectorate for veterinary and phytosanitary safety under the Government of the Kyrgyz Republic:

- after approval with state members of the Eurasian Economic Union of system of ensuring the traceability of controlled goods provided by the Republic of Kazakhstan (further - system of traceability) to provide functioning of national system of traceability of the goods which are subject to veterinary control (supervision), the traceability of controlled goods integrated with the Kazakhstan system;

- together with Department of prevention of diseases and state sanitary and epidemiological surveillance of the Ministry of Health of the Kyrgyz Republic before introduction of system of traceability to exercise control (supervision) of the imported controlled goods from the Republic of Kazakhstan;

- in case of identification of the facts of import of controlled goods to create mobile groups of number of persons employed of the Ministry of Internal Affairs of the Kyrgyz Republic, the Ministry of Economics of the Kyrgyz Republic, Public service on fight against economic crimes at the Government of the Kyrgyz Republic (financial police) and to organize control and operational and raid actions.

3. To the Ministry of Economics of the Kyrgyz Republic together with the State inspectorate for veterinary and phytosanitary safety under the Government of the Kyrgyz Republic and Department of prevention of diseases and state sanitary and epidemiological surveillance of the Ministry of Health of the Kyrgyz Republic to carry out information work among subjects of entrepreneurship concerning transportation, storage and realization of the food products imported from the Republic of Kazakhstan.

4. This resolution becomes effective after fifteen days from the date of official publication and acts before date of cancellation of veterinary health control (supervision) on the Kyrgyz-Kazakhstan site of frontier.

5. To impose control of execution of this resolution on department of agro-industrial complex and ecology of Government office of the Kyrgyz Republic.

Procedure for the state control (supervision) of the goods which are subject to sanitary and epidemiologic and veterinary control (supervision) to which the Republic of Kazakhstan applies the requirements different from requirements of the Eurasian Economic Union, and products made from them

1. General provisions

1. This Procedure establishes the procedure of the state control (supervision) of the goods which are subject to sanitary and epidemiologic and veterinary control (supervision) to which the Republic of Kazakhstan applies the requirements different from requirements of the Eurasian Economic Union (further - EEU), and products made from them (further - controlled goods).

2. The order of interaction and transfers of data on movement of controlled goods is performed based on this Procedure and the Protocol on some questions of import and the goods circulation on customs area of the Eurasian Economic Union signed in the settlement of Burabay on October 16, 2015.

3. The controlled goods imported on the territory of the Kyrgyz Republic are subject to documentary and physical control.

Documentary control consists in verification of accompanying documents.

Physical control includes:

- survey of controlled goods;

- check of compliance of controlled goods to the data specified in the shown documents for the purpose of exception of availability of the controlled goods which are not specified in accompanying documents;

- control of compliance of the vehicle to the established veterinary health requirements necessary for transportation of controlled goods;

- control of conditions and mode of movement (transportation);

- control of compliance of packaging and marking to requirements of technical regulations.

4. On check points through Frontier of the Kyrgyz Republic the owner (consignor) or carrier (the receiver, the owner of goods) represents to the official of authorized state body on implementation of the state supervision and control in the field of veterinary and phytosanitary safety of the data in form according to appendix 1 to this Procedure (further - Data), in duplicate.

The owner (consignor) or carrier (the receiver, the owner of goods) of controlled goods reflects in Data:

- the name of controlled goods on the Commodity Nomenclature of Foreign Economic Activity group;

- weight of controlled goods;

- details of the invoice (invoice) on the imported controlled goods;

- details of the receiver of controlled goods (full name, the name and legal address, registration at the place of residence);

- details of the sender of controlled goods (full name, the name and legal address, registration at the place of residence);

- the documents confirming traceability of origin of controlled goods (the contract between the supplier and the receiver, the veterinary certificate of EEU or the declaration of conformity, or the certificate of conformity).

5. In Data corrections, blots are not allowed.

6. In case of transit of controlled goods through the territory of the Kyrgyz Republic of the Data are not represented. In this case the owner (consignor) of controlled goods represents the copy of the declaration on goods to the official of authorized state body in the field of protection of Frontier of the Kyrgyz Republic and to the official of authorized state body on implementation of the state supervision and control in the field of veterinary and phytosanitary safety on the check point.
