1. Approve the enclosed Instruction about procedure for carrying out competitive selection of contractors of actions of the state programs which are not subordinate state-financed organizations.

2. This resolution becomes effective after its official publication.

The instruction about procedure for carrying out competitive selection of contractors of actions of the state programs which are not subordinate state-financed organizations

Chapter 1. General provisions

1. This Instruction determines procedure for carrying out competitive selection of contractors of actions of state programs whose responsible customer is the Ministry of Agriculture and Food of the Republic of Belarus (further - the state program), not being subordinate state-financed organizations of customers if other is not established by the legislation.

2. For the purposes of this Instruction terms and their determinations in the values established by the Budget code of the Republic of Belarus, Regulations on procedure for forming, financing, accomplishment and efficiency evaluation of state programs approved by the resolution of Council of Ministers of the Republic of Belarus of February 29, 2016 No. 167 "About some measures for forming, financing, accomplishment of state programs and assessment of their efficiency" are applied (The national legal Internet portal of the Republic of Belarus, 16.03. 2016, 5/41794), and also following terms and their determinations:

date of tender - date of commission session which agenda includes question of determination of the participant who won competition;

the contract for accomplishment of action - the contract for accomplishment of action of the state program at the expense of means republican and (or) local budgets, concluded between the customer of this state program and the contractor of action determined by this customer by results of competitive selection;

the bid - the paper document including the Sections determined by this Instruction, including the statement on participation in tender terms offered by the participant for the conclusion of the contract for accomplishment of action, the enclosed documents by means of which giving to the organizer of tender the legal entity, the individual entrepreneur declare participation in tender as the potential contractor of action;

the notice on carrying out tender - the paper document constituted according to requirements of this Instruction and approved by tender committee which the organizer of tender informs legal entities and individual entrepreneurs on carrying out:

open tender, including repeated, by means of its publication in the printing mass media determined by the organizer of tender, and placement on the official site (further - placement in mass media);

closed competition, including repeated, by means of the direction its mail service in the form of the registered mailing to the legal entities and (or) individual entrepreneurs determined by the commission (further - the direction by mail);

the commission - the permanent commission created by the organizer of tender for the organization and carrying out tender and for other purposes determined by this Instruction;

tender - tender form, won which is recognized the participant who offered according to the conclusion of the commission the best terms for the conclusion of the contract for accomplishment of action in comparison with the conditions offered by other participants;

the organizer of tender - the customer of the state program;

the official site - the website of the organizer of tender on the global computer Internet;

acceptance of the bid - registration by service of documentary ensuring management (further - service of preschool educational institution) the organizer of tender of the post envelope having mark "Bid", which arrived to the organizer of tender, by putting down of the mark in it consisting of the abbreviated name of the organizer of tender and receipt date of post envelope to the organizer of tender;

the participant - the legal entity, the individual entrepreneur who submitted to the organizer of tender the bid.

3. Competitive selection of contractors of actions is performed by customers of the state program by carrying out tender by them, except as specified, specified in item 4 of this Instruction.

Subject of tender is the right to the conclusion of the contract for accomplishment of action.

Are allowed to participation in tender by the commission:

legal entities:

not being subordinate state-financed organization of the customer;

the liquidations which are not in process or reorganization (except for the legal entity reorganized in the form of joining to it of other legal entity);

legal entities, individual entrepreneurs:

not recognized in the procedure established by the legislation as economically insolvent (bankrupts), except for the legal entity who is in the procedure of sanitation;

the Republic of Belarus which is not included according to the Law of July 13, 2012 "About public procurements of goods (works, services)" (The national legal Internet portal of the Republic of Belarus, 21.07. 2012, 2/1971) in supplier list (contractors, contractors) who are temporarily not allowed to participation in procedures of public procurements;

the individual entrepreneurs who are not in activities termination stage.

4. In case of lack of bids the commission has the right to determine as the contractor (contractors) of action of any persons in accordance with the terms, determined by the commission.
