About Agency on control of drugs in case of the President of the Republic of Tajikistan

For the purpose of increase in efficiency of activities of enhancement of organizational structure of the Agency on control of drugs in case of the President of the Republic of Tajikistan I decide:

1. Approve the Provision, Structure of central office and the Scheme of management of the Agency on control of drugs in case of the President of the Republic of Tajikistan (the appendices 1,2, 3).

2. Establish the extreme number of staff of the Agency in number of 443 units (without service personnel), including the number of staff of central office in number of 274 units.

3. Permit the Agency to have two deputy directors including one first.

4. To perform financing of activities of the Agency at the expense of means of the republican budget, controls of the UN on drugs and crime, the donor countries and other international organizations.

5. Recognize invalid:

- The presidential decree of the Republic of Tajikistan of July 12, 1999 No. 1248 "About approval of the Provision and structure of the Agency on control of drugs in case of the President of the Republic of Tajikistan"

- The presidential decree of the Republic of Tajikistan of February 28, 2003 No. 1030 "About introduction change and amendments in the Presidential decree of the Republic of Tajikistan of July 12, 1999, No. 1248 "About approval of the Provision and structure of the Agency on control of drugs in case of the President of the Republic of Tajikistan".

Regulations on the Agency on control of drugs in case of the President of the Republic of Tajikistan

I. General provisions

1. The agency on control of drugs in case of the President of the Republic of Tajikistan (further - the Agency) is the law enforcement agency performing state policy in the sphere of fight against drug trafficking, psychotropic substances and their precursors, control of their turnover and controlling its realization in the territory of the Republic of Tajikistan.

The main objective of the Agency is coordination and control of activities of state bodies for drug trafficking, psychotropic substances and their precursors, counteraction to their illicit trafficking, prevention of drug addiction, and also coordination of activities of public organizations for prevention of drug addiction.

2. The agency is body in case of the President of the Republic of Tajikistan and in the activities is accountable to the President of the Republic of Tajikistan.

3. In the activities the Agency is guided by the Constitution of the Republic of Tajikistan, other regulatory legal acts of the Republic of Tajikistan, international legal acts acknowledged the Republic of Tajikistan and this Provision.

4. The agency, according to the legislation of the Republic of Tajikistan, represents the interests of the Republic of Tajikistan in the international relations concerning fight against drug trafficking, psychotropic substances and their precursors, control of their turnover and prevention of drug addiction.

II. Powers

5. The main functions of the Agency are:

- identification the prevention, suppression and disclosure of the crimes connected with drugs, psychotropic substances and their precursors identification and suppression of activities of criminal narcogroups with regional and international backgrounds and also persons involved in this category of crimes;

- conducting inquiry and pretrial investigation on criminal cases about the crimes carried by the legislation of the Republic of Tajikistan to competence of the Agency;

- implementation of operational search activities in compliance with the legislation of the Republic of Tajikistan;

- implementation of production on stages about administrative offenses in compliance with the legislation of the Republic of Tajikistan;

- content of persons detained on suspicion of making crime and arrested in temporary detention centers of the Agency;

- implementation of measures of counteraction of legalization of income (money laundering) gained from drug trafficking;

- implementation of measures for ensuring internal security;

- participation in development and implementation of national programs in the sphere of control over drugs;

- development together with the competent ministries and departments of regulatory legal acts about procedure for drug trafficking, psychotropic substances and their precursors in the territory of the Republic of Tajikistan and control of their execution;

- control in the sphere of drug trafficking of psychotropic substances and their precursors according to the procedure determined by the legislation of the Republic of Tajikistan;

- control of activities of the companies of the organizations and organization irrespective of patterns of ownership in the sphere of drug trafficking of psychotropic substances and their precursors and issue the instruction on elimination of the revealed shortcomings;

- signing at the request of the President of the Republic of Tajikistan or the Government of the Republic of Tajikistan of international treaties on cooperation in the field of control over drugs;

- carrying out the complex analysis and assessment of condition of fight against drug trafficking, psychotropic substances and their precursors of control of their turnover and prevention of drug addiction in the territory of the republic;

- together with the Ministry of Health of the Republic of Tajikistan generalizes data on needs of the Republic of Tajikistan for drugs and psychotropic substances and their submission to the Government of the Republic of Tajikistan for the subsequent direction in the International UN committee on control and drugs;

- according to international conventions of the UN on control of drugs together with the interested ministries and departments development of the National list of drugs, psychotropic substances and their precursors and its representation on approval of the Government of the Republic of Tajikistan;

- the organization and coordination of work on training, advanced training and experience exchange of staff of the Agency, other law enforcement agencies and the competent ministries and departments to the republics;

- coordination and control of prevention of drug addiction, the implementation of others of function provided by regulatory legal acts of the Republic of Tajikistan.

6. The agency has the right:

- perform at the request of the President of the Republic of Tajikistan check of activities of the ministries and departments concerning the organization of fight against drug trafficking, psychotropic substances and their precursors,
