1. Approve the enclosed standard of the state service "Acquisition of Rights the Parcels of Land Which Are in State-owned Property, Not Requiring Tendering (Tenders, Auctions)".

2. To provide to committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in printing and electronic type on official publication in periodic printing editions and information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan, and also in the Republican center of legal information within five working days from the date of receipt of the registered order for inclusion in reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Acquisition of Rights the Parcels of Land Which Are in State-owned Property, Not Requiring Tendering (Tenders, Auctions)"

Chapter 1. General provisions

1. The state service "Acquisition of Rights the Parcels of Land Which Are in State-owned Property, Not Requiring Tendering (Tenders, Auctions)" (further - the state service).

2. The standard of the state service (further - the Standard) is developed by the Ministry of Agriculture of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears local executive bodies of areas, Nour-Sultan's cities, Almaty and Shymkent, areas, the cities of regional value, the cities of district value, akims of settlements, villages, rural districts (further - the service provider).

Reception of an application and issue of result of rendering the state service are performed through:

1) office of the service provider;

2) Government for Citizens State corporation (further State corporation).

Chapter 2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) from the date of delivery of document package to the service provider, in the State corporation:

1 stage: determination of possibility of use of the asked parcel of land on the declared purpose, production of the act of the choice of the parcel of land, issue of the conclusion of the land commission of 23 (twenty three) working days;

in case of the appeal to the State corporation, day of acceptance rendering the state service does not enter in time, at the same time the result of rendering the state service by the service provider is provided in the State corporation a day before the termination of term of rendering the state service;

2 stage: from the date of approval of the land management project decision about provision of the right of land use to the parcel of land of 7 (seven) working days;

2) the most allowed time of expectation for delivery of document package of 15 (fifteen) minutes;

3) the most allowed time of servicing of 15 (fifteen) minutes.

5. Form of rendering the state service: paper.

6. Result of rendering the state service the decision of the service provider on provision of the right to the parcel of land or motivated refusal in rendering the state service in the bases, stipulated in Item 10 these Standards.

Form of provision of result of rendering the state service: paper.

7. The state service is rendered free of charge to physical persons and legal entities (further uslugopoluchatel).

8. Working schedule:

1) the service provider Monday through Friday from 9:00 till 18:30 o'clock with lunch break from 13:00 till 14:30 o'clock, except for days off and holidays, according to the labor law of the Republic of Kazakhstan and article 5 of the Law of the Republic of Kazakhstan of December 13, 2001 "About holidays in the Republic of Kazakhstan" (further - the Law on holidays).

Reception of an application and issue of result of rendering the state service are performed from 9:00 till 17:30 o'clock with lunch break from 13:00 till 14:30 o'clock.

The state service is rendered in the location of the parcel of land in turn, without making an appointment and the accelerated servicing;

2) the State corporation - Monday through Saturday inclusive, according to the working schedule from 9:00 to 20:00 o'clock, without interruption for lunch, except for Sundays and holidays, according to the labor law of the Republic of Kazakhstan and article 5 of the Law on holidays.

The state service is rendered on the location of the parcel of land according to the procedure of "electronic queue" without the accelerated servicing and preliminary record, booking of electronic queue by means of the web portal of "the electronic government" www.egov.kz is possible (further - the portal).

9. Uslugopoluchatel (or his representative by proxy), including represents the faces having privileges in one copy to office of the service provider and to the State corporation:

1 stage:

1) the statement on acquisition of right to the parcel of land in form, according to appendix 1 to this Standard;

2) the identity document (for identification of the personality);

the approved land management project.
