About approval of the Regulations on State commission of the Republic of Tajikistan on control of drugs

1. Approve the enclosed Regulations on State commission of the Republic of Tajikistan on control of drugs.
2. To the ministries and departments of the Republic of Tajikistan, Chairmen of areas, cities and areas to render every possible assistance to State commission of the Republic of Tajikistan on control of drugs in case of control of legal drug trafficking, psychotropic substances and their precursors and fight against drug trafficking.
3. Declare invalid the Regulations on State commission of the Republic of Tajikistan on control of drugs approved by the order of the Government of the Republic of Tajikistan of June 4, 1996 No. 215.

1. State commission of the Republic of Tajikistan on control of drugs (further in the text - State commission) is the state body performing state policy in the sphere of legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking.
2. The state commission is formed by the Presidential decree of the Republic of Tajikistan and in the activities is guided by the Constitution of the Republic of Tajikistan, the laws of the Republic of Tajikistan, presidential decrees of the Republic of Tajikistan, the orders of the Government of the Republic of Tajikistan, the Single Convention of the UN "About drugs of 1961", the Convention of the UN "About psychotropic substances of 1971", the Convention of the UN "About fight against illicit trafficking in drugs and psychotropic substances of 1988" (further in the text - Conventions of the UN), other legal and international legal acts, this Provision.
3. The state commission in the activities is accountable to the Government of the Republic of Tajikistan.
4. The state commission represents state interests of the Republic of Tajikistan on the international scene within the competence.
5. Decisions of State commission concerning legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking are obligatory to execution for all state bodies, regional, city and district Hukumatov, the companies, organizations and the organizations of the Republic of Tajikistan.
6. The ministries and departments of the Republic of Tajikistan concerning legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking are accountable to State commission.
7. The state commission is legal entity, has the settlement account (including currency), seal with the image of the State Emblem of the Republic of Tajikistan with the name in the Tajik, Russian and English languages.
8. Main objectives of State Commission of the Republic. Tajikistan on control of drugs are:
8.1. Development, coordination and control of the state and international programs in the sphere of legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking.
8.2. The conclusion at the request of the President of the Republic of Tajikistan, the Government of the Republic of Tajikistan of bilateral and multi-lateral agreements about cooperation with other states, the non-governmental international organizations concerning legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking.
8.3. Representation of the Republic of Tajikistan in the International Committee United Nations on control over drugs and other international organizations dealing with problems of drug addiction. Submission to them of reports and other information according to requirements of Conventions of the UN and other international agreements concerning control of legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking which participant is the Republic of Tajikistan, control of their execution,
8.4. Coordination and control within the competence of activities of the ministries and departments of the Republic of Tajikistan, regional, city and district Hukumatov concerning control of legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking.
8.5. Implementation of permanent complex assessment of condition of fight against drug trafficking, psychotropic substances and their precursors in the territory of the Republic of Tajikistan.
8.6. Maintaining the State register of drugs, psychotropic substances and their precursors. Determination in coordination with the interested ministries and departments of the Republic of Tajikistan their requirements for the republic and data presentation on them in the International UN committee on control over drugs for receipt of the corresponding quotas.
8.7. Approval and updating of national Lists of the drugs, psychotropic substances and their precursors constituted according to Conventions of the UN. Introduction in need of corresponding changes into the specified Lists. Official interpretation and explanations according to these Lists are included into exclusive competence of State commission.
8.8. Control of activities of the companies, organizations and organizations performing legal drug trafficking, psychotropic substances and their precursors irrespective of patterns of ownership.
8.9. Licensing of import, export, production, conversion and realization of drugs, psychotropic substances and their precursors.
8.10. Generalization and the analysis arriving from the ministries and departments of the Republic of Tajikistan performing legal drug trafficking, psychotropic substances, their precursors and fight against their illicit trafficking, the data and materials about drug abuse situation condition in the republic. Representation of the generalized materials to the President of the Republic of Tajikistan, to the Government of the Republic of Tajikistan, the International UN committee on control over drugs and to other interested bodies.
8.11. Assistance to creation and enhancement of activities of the republican Center of operational information for control of drugs and psychotropic substances for ensuring free and free exchange of information with the interested Ministries and departments of the Republic of Tajikistan and the foreign states.
8.12. Ensuring interaction of the state, public, religious and charitable organizations, organizations and companies in work on attraction of financial resources for financing of programs for control of drugs.
