About some questions of maintaining the state inventory of fauna

Based on Item 2 of article 54 of the Law of the Republic of Belarus of July 10, 2007 "About fauna" the Council of Ministers of the Republic of Belarus DECIDES: No. 257-Z

1. Approve Regulations on procedure for maintaining the state inventory of fauna and use of its data it (is applied).

2. Financing of maintaining the state inventory of fauna and scientific ensuring maintaining the state inventory of fauna is performed according to the legislation.

3. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of December 13, 2004 No. 1580 "About approval of the Regulations on procedure for maintaining the state inventory of flora and use of its data" (The national register of legal acts of the Republic of Belarus, 2004, No. 196, 5/15295);

Item 2 of the resolution of Council of Ministers of the Republic of Belarus of December 27, 2007 No. 1837 "About some questions of monitoring and the inventory of fauna" (The national register of legal acts of the Republic of Belarus, 2008, No. 5, 5/26494);

the resolution of Council of Ministers of the Republic of Belarus of January 3, 2011 No. 5 "About modification of the Regulations on procedure for maintaining the state inventory of flora" (The national register of legal acts of the Republic of Belarus, 2011, No. 7, 5/33123);

subitem 2.3 of Item 2 of the resolution of Council of Ministers of the Republic of Belarus of October 25, 2011 No. 1426 "About some questions of the address with flora objects" (The national register of legal acts of the Republic of Belarus, 2011, No. 123, 5/34663).

4. This resolution becomes effective since June 30, 2016.

Regulations on procedure for maintaining the state inventory of fauna and use of its data

1. This Provision determines procedure for maintaining the state inventory of fauna (further - the inventory) and uses of its data.

2. In this Provision terms are used in the values established by the Law of the Republic of Belarus "About fauna".

3. The inventory represents the electronic database (the state information resource "State Inventory of Fauna") placed on the global computer Internet and is kept concerning the objects of fauna living in the territory of the Republic of Belarus.

4. Maintaining the inventory is performed for the purpose of:

preserving biological diversity of fauna;

rational use of objects of fauna;

control of change of quantity and quality characteristics of objects of fauna;

economic evaluation of resources of fauna.

Data of the inventory are used for providing state bodies, other organizations and citizens with data on fauna objects.

5. Maintaining the inventory is performed by the Ministry of Natural Resources and Environmental Protection (further - Ministry for Protection of the Environment and Natural Resources).

Under the authority of the inventory participate:

The ministry of forestry (further - Minleskhoz) - concerning the wild animals belonging to subjects to hunting;

The Ministry of Agriculture and Food (further - Ministry of Agriculture and Food Production) - concerning the wild animals belonging to objects of fishery;

National academy of Sciences of Belarus (further - NAS of Belarus) - concerning genetic fund of wild animals, and also wild animals whose types are included in the Red List of the Republic of Belarus and (or) fall under action of international treaties of the Republic of Belarus.

Coordination of work of the state bodies and other organizations specified in part two of this Item for participation in maintaining the inventory is performed by Ministry for Protection of the Environment and Natural Resources.

5-1. Maintaining the inventory includes:

information processing about objects of fauna, arrived in the electronic database of the inventory, for check of its compliance to the data representation forms about fauna objects established by Ministry for Protection of the Environment and Natural Resources;

information analysis about fauna objects, assessment of change of quantity and quality characteristics of objects of fauna and economic evaluation of resources of fauna;

preparation of analytical materials about objects of fauna and information on users of the objects of fauna which did not provide the specified information.

6. Scientific ensuring maintaining the inventory and participation in its maintaining is performed by NAS of Belarus in the way:

carrying out cadastral inspection of grounds (information collection about availability, distribution, specific structure, condition and use of objects of fauna) according to the procedure and on the conditions determined by NAS of Belarus in coordination with Ministry for Protection of the Environment and Natural Resources, Minleskhoz, Ministry of Agriculture and Food Production and the State inspectorate of protection of animal and flora in case of the President of the Republic of Belarus;

the analysis and assessment of information obtained as a result of carrying out cadastral inspection of grounds, accounting of objects of fauna and amounts of their use, monitoring of fauna, and also other information on objects of fauna and preparation of analytical materials.

7. Users of objects of fauna provide information on fauna objects (including based on accounting of objects of fauna and amounts of their use) in forms and in the terms established by Ministry for Protection of the Environment and Natural Resources in coordination with NAS of Belarus, Minleskhoz, Ministry of Agriculture and Food Production and the State inspectorate of protection of animal and flora in case of the President of the Republic of Belarus by its entering into the corresponding forms in the electronic database of the inventory.

Coordination of works on introduction by users of objects of fauna of information, including based on accounting of objects of fauna and amounts of their use, in the electronic database of the inventory perform:

on the wild animals belonging to subjects to hunting – Minleskhoz;

on the wild animals belonging to objects of fishery – Ministry of Agriculture and Food Production;

on the wild animals who are not belonging to subjects to hunting and fishery and general coordination of work on entering by users of objects of fauna of information into the corresponding forms of the electronic database of the inventory – Ministry for Protection of the Environment and Natural Resources.

8. The systematized data of the inventory have open character, except for the data carried by the legislation to the state secrets, or other information which is not subject to provision and distribution according to legal acts and are placed on the global computer Internet.
