The government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic which are hereinafter referred to as with the Parties
proceeding from provisions of the Agreement on creation of the Commonwealth of Independent States of December 8, 1991, and also the Agreement on cooperation in the field of investing activities of December 24, 1993,
attaching importance to the radical economic reforms, transformations caused by transition to market economy
proceeding from regulations of the intergovernmental agreement on carrying out coordinated policy in the field of standardization, metrology and certification of March 13, 1992,
for the purpose of creating favorable conditions for mutually beneficial cooperation in the field of construction activities
agreed as follows:
For the purposes of this agreement the following terms mean:
"the state license" - special permission to the right of implementation of separate types of construction activities;
"construction activities" - accomplishment of construction, installation works, project works, engineering researches for construction, production of construction materials, products and designs;
"licensed body" - body of the state system of licensing of construction activities which grants licenses;
"the subject of licensing" - organizations, the organizations, the companies and physical persons which are performing or having intention to begin construction activities.
The parties mutually recognize the state licenses for those types of construction activities issued by licensed bodies of the Republic of Kazakhstan and the Kyrgyz Republic for which national procedures for issue of licenses are equivalent.
Mutual recognition of the state licenses granted by licensed bodies of the Republic of Kazakhstan and the Kyrgyz Republic does not extend to the state licenses granted by the Parties to subjects of licensing of the third countries.
Establishment of procedure for mutual recognition of the state licenses granted by licensed bodies of the Republic of Kazakhstan and the Kyrgyz Republic, and also the solution of other questions within this agreement are made on the basis of mutual agreements and arrangements between the Ministry of construction, housing and building of the territories of the Republic of Kazakhstan and the State committee of the Kyrgyz Republic on architecture and construction.
The state licenses for implementation of construction activities which are mutually recognized by the Parties are subject to registration in the central licensed body of the country where the subject of licensing has intention to perform construction activities.
The amount of payment for registration of the license is established in the amount equivalent to 100 US dollars for each license.
Payment is made in national currency of the country where construction activities according to the national currency rate in relation to US dollar on the date of adoption of the statement for registration are performed.
The parties for the purpose of further expansion of the sphere of mutual recognition of the state licenses for implementation of construction activities issued by licensed bodies of the Republic of Kazakhstan and the Kyrgyz Republic will communicate and perform cooperation on rapprochement of legal, regulating and methodological documents in the field of the state licensing of construction activities.
This agreement does not affect the rights and obligations of the Parties under other agreements which participants they are.
This agreement becomes effective from the moment of signing and is effective within five years. If any of the Parties does not make the written application on the desire to terminate this agreement no later than six months before expiration of the Agreement, then its action is considered prolonged the next five years.
It is made in the city of Almaty, on May 19, 1995 in duplicate, everyone in the Kazakh, Kyrgyz and Russian languages, and all texts are equally authoritative.
