About the Procedure for forming and maintaining the single list of products concerning which mandatory requirements within the Eurasian Economic Union are established

For the purpose of implementation of article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 and according to Item 27 of appendix No. 1 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Council of the Eurasian economic commission solved:

1. Approve the enclosed Procedure for forming and maintaining the single list of products concerning which mandatory requirements within the Eurasian Economic Union are established.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Procedure for forming and maintaining the single list of products concerning which mandatory requirements within the Eurasian Economic Union are established

1. This Procedure is developed according to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement) and determines rules of forming and maintaining the single list of products concerning which mandatory requirements within the Eurasian Economic Union are established (further - the single list).

2. Forming and maintaining the single list are performed based on offers of state members of the Eurasian Economic Union (further respectively - state members, the Union).

3. The following products can be included in the single list:

a) concerning which acts of the Eurasian economic commission (further - the Commission) establish mandatory requirements for the purpose of protection of life and (or) health of the person, property, the environment, life and (or) health of animals and plants, preventions of the actions misleading consumers and also for the purpose of ensuring energy efficiency and resource-saving;

b) concerning which according to the international experience mandatory requirements of safety for the purpose of protection of life and (or) health of the person, property, the environment, life and (or) health of animals and plants, preventions of the actions misleading consumers and also for the purpose of ensuring energy efficiency and resource-saving are established;

c) of which according to scientific data, and (or) results of researches, and (or) information of the international organizations the risks connected with possibility of damnification and (or) causing damage of life and (or) to health of the person, property, the environment, life and (or) health of animals and plants are characteristic;

d) concerning which by results of the state control (supervision) risks of damnification and (or) causing damage of life are revealed and confirmed and (or) to health of the person, property, the environment, life and (or) health of animals and plants.

4. The offer on inclusion of products in the single list contains the name of type (types) or group (groups) of products, and also the description and (or) determination of products which are offered to be included in the single list. The following documents are attached to the offer on inclusion of products in the single list:

a) explanatory note;

b) the concept of technical regulation of products offered for inclusion in the single list.

5. The explanatory note specified in the subitem "an" of item 4 of this Procedure contains:

a) reasons for inclusion of products in the single list according to Item 3 presents of the Procedure;

b) the analysis of the legislation of state members in the field of regulation of the specified products, including regarding the state members of mandatory requirements and the applied assessment procedures of compliance established according to the legislation;

c) the analysis of the international experience in the field of establishment of mandatory requirements concerning products offered for inclusion in the single list;

d) the analysis of international standards (rules, directives, recommendations and other documents accepted by International Organizations for Standardization), regional documents (regulations, directives, decisions, standards, rules and other documents), national (state) standards and other documents in the field of standardization accepted concerning products offered for inclusion in the single list;

e) assessment of degree of potential danger of products, including information on the risks connected with possibility of damnification and (or) causing damage of life and (or) to health of the person, property, the environment, life and (or) health of animals and plants, prepared on the basis of scientific data, and (or) results of researches, and (or) information of the international organizations which are also attached to the explanatory note.

6. The concept of technical regulation of products offered for inclusion in the single list, specified in the subitem "b" of item 4 of this Procedure contains:

a) the offer on regulation of products offered for inclusion in the single list by establishment of single mandatory requirements in the technical regulation of the Union (technical regulations of the Union) or by establishment in the legislation of state members of national mandatory requirements taking into account the level of economic and scientific and technical development of state members;

b) the purposes of the offered regulation and data on their compliance to provisions of the Section X of the Agreement;

c) assessment of impact of the offered regulation, including concerning subjects of business activity and other interested persons, and the description of different possible ways of the problem resolution to which solution the offered regulation is directed;
