The memorandum between the Government of the Republic of Kazakhstan and the Government of Georgia of cooperation in the field of environmental protection

The government of the Republic of Kazakhstan and the Government of Georgia, in subsequent referred to as with the Parties,

based on the traditional friendly and business relations which developed between two states

in view of exclusive importance and relevance of the efforts concerning cooperation in the field of environmental protection and coordination of collateral actions on participation of both countries in national and international ecological programs

agreed about the following:

Article 1

The parties develop programs of synchronization of the legislation in the field of the environment, including regulations, standard rates and standards.

Article 2

The parties cooperate in studying of the environment, exchange of the relevant information, creation of system of the mutual warning of ecologically dangerous situations.

Article 3

The parties will cooperate in the field of protection of the environment, production of scientific and technical works, monitoring, implementation of expert and advisory meetings.

Article 4

The parties will cooperate in area of public administration and regulation of environmental protection and environmental management, state control, experience exchange of use of the corresponding economic mechanisms, probations of specialists.

Article 5

The parties will cooperate in area of implementation of joint research operations, exchange of results of scientific and technical developments, including the available projects on problems of protection of oil fields of coastal part of the Caspian Sea, and also creation and realization of ekologo-economic and power resource-saving systems and constructions.

Article 6

The parties exchange data on national sources of dangerous impact on the environment.

Article 7

The parties will coordinate actions of national rescue services for liquidation of emergency ecological situations and industrial accidents.

Article 8

The parties will adjust exchange of information about movement of toxic, radioactive waste and substances.

Article 9

The parties agree that all goods, the materials and technologies imported on the territory of one of the Parties or from the third countries shall meet nonconsumptive standards and standards of the Parties, and in the absence of those - to regulations and standards of the EU and WHO. The parties have the right to carry out additional inspection of goods on their compliance to nonconsumptive requirements. When transporting goods from other Party, and also in case of transit transportations the International standards and rules concerning transportation of dangerous goods are effective. Import and transit of radioactive, toxic and other waste is performed according to the legislation of the Parties.

Article 10

The parties will abstain from the actions causing damage as a result of transport impacts on the environment when crossing the territory of both States.

Article 11

The parties will promote collateral actions of Customs Services on suppression of export and import of rare disappearing animals and products from them.

Article 12

The parties will prepare the agreement on economic incentives of distribution of environmentally friendly technologies for signing.

Article 13

For permission of all possible disputes and contradictions, and also the solution of the questions provided by Articles of this Memorandum the Parties will create the Mixed Commission. This Memorandum becomes effective from the date of signing and will be valid before the expiration of six months from date when one of the Parties sends the written notice to other Party about intention to stop its action.

This Memorandum is constituted and signed in Tbilisi on September 17, 1996 in duplicate, everyone in the Kazakh, Georgian and Russian languages, and all copies are equally authoritative.
