About mutual understanding between the Government of the Kyrgyz Republic and Organization for Security and Cooperation in Europe in the field of development and reforming of law enforcement agencies and other state bodies of the Kyrgyz Republic

The government of the Kyrgyz Republic (further - "Government") and the Organization for Security and Cooperation in Europe (further - "OSCE") provided by the OSCE Center in Bishkek (further - "OSCE Center"), further referred to as with the Parties, being guided by intention to develop closer cooperation in the field of reforming of law enforcement agencies and other state bodies, and also considering the essential help given to OSCE since 2003, directed to implementation of structural, methodical and practical development and reforming of law-enforcement bodies of the Kyrgyz Republic

with intention to provide advisory, methodological, material and logistical assistance and assistance to law enforcement agencies and other state bodies of the Kyrgyz Republic within projects implementation on their reforming and implementations in their work of democratic principles according to the legislation of the Kyrgyz Republic,

recognizing need of enforcement of trust between society, law enforcement agencies and other state bodies of the Kyrgyz Republic by means of implementation of adequate measures,

recognizing the capacity of OSCE capable to make valuable contribution to process of reforming of law enforcement agencies and other state bodies of the Kyrgyz Republic by exchange of the advanced international practice and experience in this area,

agreed as follows:

Article 1. Purpose

The purpose of this Memorandum is creation of the legal basis providing implementation of cooperation between the Parties, determination of methods of work and instruments of their practical implementation, establishment of time frames of implementation in system of law enforcement agencies and other state bodies of the Kyrgyz Republic of the advanced principles of work on the basis of the program documents realized at the level of the Government.

For the purpose of implementation of this Memorandum are understood as law enforcement agencies and other state bodies: law-enforcement bodies, homeland security, on fight against economic crimes, criminal executive system, the Customs, border service, financial investigation, and also drugs monitoring bodies.

Article 2. Spheres of cooperation

For goal achievement of this Memorandum of the Party will perform cooperation in the following spheres:

1. Reforming of law enforcement agencies and other state bodies of the Kyrgyz Republic by means of realization of project activities.

2. Strengthening of capacity of law enforcement agencies and other state bodies of the Kyrgyz Republic in ensuring public safety and law and order.

3. Strengthening of capacity of law enforcement agencies and other state bodies in fight against crime (including in counteraction of organized crime, to drug trafficking, human trafficking, extremism, terrorism, the international conflicts, illegal migration, legalization of the income got in the criminal way, to crimes against the personality and property; in fight against corruption, cybercrime, in ensuring the state protection of persons participating in criminal trial).

4. Enhancement of education system of law-enforcement bodies of the Kyrgyz Republic.

5. Strengthening of administrative and managerial capacity of law enforcement agencies and other state bodies of the Kyrgyz Republic.

Article 3. Mechanism of execution of the Memorandum

1. Assistance from OSCE through the OSCE Center will be rendered in Bishkek by means of implementation of the budget and off-budget projects aimed at the development and reforming of law enforcement agencies and other state bodies of the Kyrgyz Republic.

2. For the purpose of execution of this Memorandum of the Party appoint the representatives who will be given authority to represent the Parties in case of approval and implementation of project activities.

3. Activities, duration and sales terms of each project shall be approved annually by both Parties and will be developed proceeding from requirements of the Government, according to the legislation of the Kyrgyz Republic and rules established by OSCE.

Article 4. Financing of project activities

Financing of project activities will be performed for the account:

1. General annual approved budget of the OSCE Center.

2. Off-budget deposits from state members of OSCE (further - "donor states"), the international organizations, in the presence of such opportunity, and for mutual consent of the Parties.

Article 5. Obligations of the OSCE Center

The OSCE center shall:

1. Cooperate with the Government, the donor states, executive structures of OSCE during implementation of project activities.

2. Provide advice and the material assistance to the Government in development and reforming of law enforcement agencies and other state bodies including:

1) assistance if necessary and in coordination with the Government in project development of the regulatory legal acts initiated within spheres of cooperation and project activities;

2) increase in potential of law enforcement officers and other state bodies by the organization and holding trainings/trainings as required;

3) establishment and development of cooperation with the international institutes and other foreign partners in the field of ensuring public safety and law and order;

4) participation together with the Government, the relevant law enforcement agencies and other state bodies in monitoring of the undertaken reforms of system of law and order, assessment of the events held within project activities and development of the conclusions and recommendations;

5) assistance in holding the sociological polls and other actions directed to determination of level of public trust to law enforcement agencies and other state bodies;

6) assistance in enhancement of education system and retraining of personnel of law enforcement agencies and other state bodies;

7) assistance in exchange of the best practices, including study working trips to the countries of the FSU and beyond and involvement of the international experts;

8) organization and holding thematic seminars, round tables, conferences.

3. Render assistance to efforts of the Government on strengthening of capacity of law enforcement agencies and other state bodies in fight against crime (including in counteraction of organized crime, to drug trafficking, human trafficking, extremism, terrorism, the international conflicts, illegal migration, legalization of the income got in the criminal way, to crimes against the personality and property in fight against corruption, cybercrime, in ensuring the state protection of persons participating in criminal trial), in other directions of law-enforcement activities, and also strengthening of mechanisms of cross-border and international interaction with authorized bodies of the foreign states.
