About protection of atmospheric air

(as amended on 13-11-2021)

This Law determines legal and organizational basis of protection of atmospheric air from emissions of pollutants and is aimed at providing ecological safety, prevention of harmful effects of economic and other activity on the environment and health of the population.

Chapter I. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) atmospheric air – the component of the surrounding environment representing natural mix of gases of the atmosphere;

2) the contaminating (harmful) substance – chemical or biological substance or mix of such substances which contain in atmospheric air and which in certain concentration make harmful effects on the environment and health of the population;

3) harmful physical impact on atmospheric air – harmful effects of noise, vibration, ionizing radiation, magnetic fields, infrared radiation, temperature and other physical factors which change physical properties of atmospheric air and negatively influence the environment and health of the population;

4) emissions of pollutants in atmospheric air - receipt in atmospheric air of pollutants from stationary and portable sources of emissions of pollutants;

5) pollution of atmospheric air – emissions in atmospheric air of pollutants which exceed their threshold limit value in air;

6) protection of atmospheric air – the activities of public authorities, local government bodies, public associations, other legal entities, and also physical persons directed to improvement of quality of atmospheric air for the purpose of prevention of its negative impact on health of the population and the environment;

7) sources of emissions of pollutants – processing and other equipment, engineering procedures, machines and mechanisms from which emissions of pollutants in atmospheric air are performed;

8) portable sources of emissions of pollutants – the transport and other portable means and self-propelled machines equipped with engines which operation involves emissions of pollutants in atmospheric air;

9) stationary sources of emissions of pollutants – any source (dot, vulgar or other source of emissions) with organized or unorganized emission of pollutants in the atmospheric air functioning constantly or temporarily in the borders of the site of the territory of object, the company relating to legal entity or physical person;

10) quality of atmospheric air – set of the physical, chemical and biological properties of atmospheric air reflecting degree of its compliance to hygienic and ecological standard rates;

11) maximum permissible emission of pollutants – the standard rate of maximum permissible emission of pollutant in atmospheric air which is established for stationary source of emissions of pollutants taking into account technical standard rates of emissions of pollutants in atmospheric air and background pollution of atmospheric air provided that this source does not exceed hygienic and ecological standard rates of quality of atmospheric air, maximum permissible (critical) loads of ecological systems;

12) the standard rate of maximum permissible emission of pollutants – the maximum sizes of intake of pollutants in atmospheric air in case of which observance standard rates of quality of atmospheric air are provided;

13) above-standard emission of pollutants – emission of pollutants in the atmospheric air exceeding standard rates in the field of protection of atmospheric air on one or the substance which was more contaminating atmospheric air;

14) threshold limit value of pollutant in atmospheric air – the concentration of pollutants which does not have direct or indirect adverse effect on this or future generation, not reducing efficiency of the person, not worsening its health and sanitary living conditions of life;

15) the standard rate of threshold limit value of pollutants in atmospheric air – indicator of impact of one or several pollutants on atmospheric air which exceeding leads to harmful effects on the environment and health of the population;

16) the standard rate of maximum permissible harmful physical impact on atmospheric air – the standard rate which is established for each source of noise, vibration, electromagnetic and other physical impact on atmospheric air in case of which harmful physical impact does not lead to exceeding of maximum permissible levels of physical impacts on atmospheric air;

17) the hygienic standard rate of quality of atmospheric air – criterion of quality of atmospheric air which reflects threshold limit value of pollutants in atmospheric air in case of which there are no harmful effects on health of the population;

18) the ecological standard rate of quality of atmospheric air – criterion of quality of atmospheric air which reflects the maximum content of pollutants in atmospheric air in case of which there are no harmful effects on the environment;

19) adverse weather conditions – the weather conditions promoting accumulating (increase) of pollutants in ground layer of atmospheric air;

20) cross-border pollution of atmospheric air – pollution of atmospheric air as a result of transfer of pollutants on long distance which source of emissions is in the territory of other state;
