About ethics and office behavior of the government employee

This Law is directed to increase in requirements to moral shape and business qualities of the government employee and establishes general ethical standards and rules of conduct of the government employee for worthy implementation of professional activity by it.

Chapter I. General provisions

Article 1. Legislation of Turkmenistan on ethics and office behavior of the government employee

The legislation of Turkmenistan on ethics and office behavior of the government employee is based on the Constitution of Turkmenistan, and also on the conventional moral principles and regulations of society and state and consists of this Law, the laws of Turkmenistan "About public service", "About anti-corruption" and other regulatory legal acts of Turkmenistan which are the code of the general principles of office, professional ethics and the basic rules of behavior which it is necessary to be guided by the government employee irrespective of post.

Article 2. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) professional ethics – system of the moral principles, regulations and rules of conduct of the specialist taking into account features of its professional activity and specific situation;

2) office ethics – regulations and rules of conduct which are based on public opinion and traditions and are directed to unity of labor collective, creation of healthy psychological climate and high-quality ensuring work;

3) office behavior – set of the regulations expressing requirements of the state and society to moral essence of public service which are basis for forming of rules of conduct of government employees during implementation of office activities by them.

Article 3. Features of operation of this Law

1. The citizen arriving on public service shall get acquainted with regulations of this Law and observe them in case of accomplishment of job responsibilities.

2. The government employee shall respect the rules of this Law. Each citizen has the right to expect from the government employee of behavior in relation to it according to requirements of this Law.

3. High requirements to moral shape and business qualities of the government employee are expression of special trust from society and the state to public service.

Article 4. Purposes of this Law

1. The purposes of this Law are establishment of general ethical standards and rules of conduct of government employees for implementation of professional activity by them, and also assistance to strengthening of the authority of the government employee, trust of citizens to state bodies and ensuring integrity of moral and normative basis of behavior of government employees.

This Law is aimed at providing that the government employee put all the forces, knowledge and experience in the professional activity performed by it, fairly served the Homeland, the people and the President of Turkmenistan, and also increased efficiency of accomplishment of the job responsibilities.

2. This Law forms basis for forming of the high moral principles in the sphere of public service, respect for it in public consciousness, and also provides public consciousness and the moral of government employees, their self-checking.

3. Knowledge and observance by the government employee of regulations of this Law are one of requirements of quality evaluation of its professional activity and office behavior.

Chapter II. Principles and rules of office behavior of government employees

Article 5. Principles and rules of office behavior of government employees

1. The principles and rules of office behavior of government employees represent behavior bases by which they should be guided in case of execution of job responsibilities.

2. Government employees in case of execution of job responsibilities shall be guided by the principle of legality, requirements of the Constitution, the laws and other regulatory legal acts of Turkmenistan, to be committed to policy of the President of Turkmenistan and to consistently put it into practice, the actions to strengthen the authority of the government, not to allow making of the actions capable to discredit bodies of the state.

3. Government employees, understanding social responsibility, the state and citizens, shall:

1) steadily to observe requirements of the National oath of Turkmenistan;

2) to fulfill job responsibilities honesty and at the high professional level for the purpose of ensuring effective work of state bodies;

3) to recognize that protection, support of the person and service to it are the main tasks of public authorities, and recognition observance and protection of rights and freedoms of man and citizen determine sense and content of activities of state bodies and government employees;

4) to provide protection of the rights and legitimate interests of legal entities;

5) to perform the activities within powers of the relevant state body;

6) to prevent and resist to the actions causing damage to the interests of the state interfering effective activities of state bodies;

7) not to give preference to any professional or social communities, physical persons and legal entities, to be independent of their influence in case of execution of job responsibilities;

8) not to allow manifestation of bureaucracy and red tape by consideration of addresses, at the scheduled time to take according to them necessary measures;

9) to exclude the actions connected with influence of any private, valuable, financial and other interests interfering fair execution of job responsibilities;

10) to observe the prohibitions established by the laws of Turkmenistan, restrictions and obligations, to fulfill the duties connected with passing of public service;

11) to observe the neutral approach excluding possibility of influence on their office activities of decisions of political parties, other public associations;

12) to respect the rules of office, professional ethics and the rule of business behavior, to stop their violation by other government employees;

13) strictly to observe the state and labor discipline, to dispose effectively of the conferred powers; it is rational to use working hours;

14) to be fair, fair, modest, to respect the commonly accepted moral ethical standards, in the relations with citizens, officials and colleagues to be polite and attentive;

15) to promote strengthening of unity of the people of Turkmenistan, interethnic and interfaith concord in the country, to relate validly to state language and other languages, traditions and customs of the people of Turkmenistan;

16) to be example of respect for the state symbols of Turkmenistan;

17) to keep and strengthen trust of society to public service, the state and its bodies;
