1. Approve the Procedure for creation and introduction of the Register of the humanitarian assistance to public associations of the Republic of Tajikistan it (is applied).

2. To provide to the Ministry of Justice of the Republic of Tajikistan execution of this Procedure.

Procedure for creation and introduction of the Register of the humanitarian assistance to public associations of the Republic of Tajikistan

1. This Procedure is developed on the basis by part 2 of article 27 of the Law of the Republic of Tajikistan "About public associations" and establishes rules of the organization and introduction of the Register of the public associations formed with participation of foreign states, foreign legal entities, foreign subjects, the international organizations and international social movements and also at the expense of the voluntary contributions received from other physical persons and legal entities, donations, grants or property (further - the Register), for the purpose of implementation of state regulation and control of observance of the current legislation by them.

2. Creation and maintaining the Register performs registering body of public associations - the Ministry of Justice of the Republic of Tajikistan, justice department of Gorno-Badakhshan area, Khatlon and Sughd areas (further - registering body).

3. In case of receipt of voluntary contributions, donations, grants or property according to part 2 of article 27 of the Law of the Republic of Tajikistan "About public associations" (further - foreign sources), public associations shall notify registering body within 10 days.

4. The notification is considered provided if it was directly handed over in registering body or is sent by mail by the cover letter with the order to notify on its delivery, by the telegram, the fax, and also other ways of communication and delivery which register receipt of the notification in registering body. The notification of public association can be provided by e-mail. The form of the notification and procedure for giving of electronic form of the notification are determined by the Ministry of Justice of the Republic of Tajikistan.

5. In the notification the following data shall be specified:

- name and registration number of public association;

- legal address;

- individual taxpayer number;

- surname, name, middle name of the head of public association;

- form and type of fee (donation or purposeful);

- financing is direct with indication of the foreign subject or by means of other organization (affiliated receivers of finance);

- name and project objective;

- region of activities of the project;

- the period of implementation of the project (distribution of means for year if the project is performed more than one year);

- the number of receivers of the help (the national group needing the help);

- the name of the organization which will be directly attracted for implementation of the project.

6. In case of duration of the implementable project it is more than for one year, repeated provision of the notification is optional.

7. Entering of data into the Register is performed by specialists of registering body. In case of insufficiency of data, the registering body can request the additional information from the head of public association.

8. The register is open and is provided for mass use on the website of the Ministry of Justice of the Republic of Tajikistan and in other sources.

9. Entering of information of public association on foreign means into the Register is entered in written and electronic form.

10. In the Register the following data are registered:

- name and registration number of public association;

- legal address;

- surname, name, middle name of the head of public association;

- form and type of fee (donation or their purpose);

- date of provision of the notification from public association;

- project start date and term of its completion;

- financing.

11. For not provision at the scheduled time of the notification by public organization, the head of public association bears responsibility. Provision of the notification by public organization concerning receipt of fee from foreign source does not exempt from fulfillment of duties, specified in article 25 of the Law of the Republic of Tajikistan "About public associations".

12. The registering body during creation of the Register can use the following confirmatory information on receipt of voluntary contributions, donations, grants or property from foreign sources:

- notification of public association;

- analysis results and estimates of the annual statement of the public association which is carried out by registering body (its regional division);

- participation in actions of public association;

- conducting checks of compliance of activities of public association to its authorized purposes;

- information of the state statistic report which characterizes activities of economic subjects;

- information obtained from tax authority, customs and other public authorities and local executive bodies of the government;

- information obtained from legal entities and physical persons;

- information of organizations, independent information centers and services;

- information of mass media;

- information of other states;

- information from other sources.
