The government of the Republic of Kazakhstan and the Government of the Republic of Tajikistan which are hereinafter referred to as with the Parties
being guided by the principles and rules of international law,
aiming at expansion and deepening of the relations in the field of military cooperation between the states,
agreed as follows:
The military cooperation between the Parties is performed for the purpose of strengthening of defense potentials and on the basis of the principles of sovereignty, equality and mutual advantage.
The parties perform military cooperation in the following areas:
- international security and defense policy;
- military construction and reforming of armed forces;
- military science and education;
- training of troops;
- material logistics of armed forces;
- legal and social security of activities of armed forces;
- military medicine, improvement of the military personnel and members of their families;
- culture, sport and tourism.
The military cooperation of the Party is performed in the following forms:
- official visits, working meetings and consultations;
- joint military scientific research, including on creation of the latest military technologies;
- joint development and production of arms and military equipment;
- training of the military personnel in military schools of the Parties, joint preparation military and scientific and research and educational personnel in military area;
- holding joint actions for training of troops;
- exchange of military and scientific, military and technical and special information, including by holding of conferences, seminars;
- holding cultural and sporting events within military cooperation.
For the purpose of implementation of provisions of this agreement of the Party will sign free standing agreements.
Responsibility for implementation of provisions of this agreement is conferred:
from the Republic of Kazakhstan on the Ministry of Defence of the Republic of Kazakhstan;
from the Republic of Tajikistan on the Ministry of Defence of the Republic of Tajikistan.
The parties annually and jointly develop the annual plan of military cooperation. The plan of military cooperation includes the name of actions, time and the venue, sources of financing and other questions.
The Parties perform the financial expenses connected with implementation of actions in the field of military cooperation by mutual consent of the Parties.
The host party undertakes all expenses connected with placement, food and transport servicing of delegation of the sending party.
The sending party provides at own expense payment of expenses on journey of members of delegation to the place of visit on the territory of the host state and back.
The financial questions connected with procedure for preparation and retraining of specialists in military educational institutions of the Parties are regulated by separately signed agreements. The parties ensure safety of information obtained within military cooperation and observe the approved privacy degree.
Information transfer of one of the Parties to the third party is allowed by mutual consent of the Parties.
Changes and additions by mutual consent of the Parties which are drawn up by separate protocols can be made to this agreement and will be integral parts of this agreement.
In case of disputes in case of interpretation or application of provisions of this agreement of the Party will resolve them by negotiations or consultations.
This agreement becomes effective from the date of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force. This agreement is signed for a period of five years and its action is automatically prolonged for the subsequent five-year periods if any of the Parties does not declare the desire to stop its action, at least in six months prior to the expiration of the next term. It is made in the city of Dushanbe on December "16", 1999, in duplicate, everyone in the Kazakh, Tajik and Russian languages, and all texts are equally authoritative. In case of discrepancies of provisions of this agreement of the Party will be guided by the text in Russian.
