About volunteering

This Law establishes the legal basis of volunteering, determines the basic principles and types of volunteer activities, the purpose and task, the main forms and procedure of these activities, and also measure of the state support of volunteering.

Chapter I. General provisions

Article 1. The basic concepts applied in this Law

For the purposes of this Law the following basic concepts are applied:

1) volunteering – form of social service, set of the public relations arising in connection with implementation by citizens (volunteers) on own initiative and gratuitously activities in provision of services, knowledge and abilities or participation in activities in the field of public advantage for the benefit of receivers of the volunteer help;

2) the volunteer – the citizen of Turkmenistan, and also the foreign citizen or the stateless person performing personally in time, free from work (study), volunteer activities;

3) area of public advantage – social support and protection of citizens, charity, health care, science and education, culture and art, tourism and sport, environmental protection and other areas having social significance;

4) the receiver of the volunteer help – physical person or legal entity, social group, society in general which need the help of volunteers and for the benefit of which volunteer activities are performed;

5) the foreign volunteer – the volunteer who is the foreign citizen or the stateless person, on legal causes staying in the territory of Turkmenistan during the continuous period of time – no more than twelve months – for the purpose of implementation of volunteer activities for the contract of volunteering with the volunteer organization in Turkmenistan according to provisions of this Law;

6) volunteer activities – the voluntary activities performed gratuitously on the basis of free declaration of will of citizens (volunteers) by performance of works, rendering services in the forms and types provided by this Law;

7) the volunteer program – complex of the actions directed to the solution of socially important tasks and realized with use of organized activities of volunteers;

8) the volunteer share – the one-time action directed to the solution of specific socially important objective which participants are volunteers;

9) the volunteer organization – the public organizations registered according to the Law of Turkmenistan "About public associations", or the international non-governmental non-profit organization having state registration (representation) in the territory of Turkmenistan acting as the organizer of volunteer activities, performing the volunteer programs or volunteer shares involving in the activities of volunteers who act from their name and according to their order;

10) the agreement of volunteering – the agreement concluded in the form of the civil contract between the physical person which is referred to as with the volunteer, and the legal entity who is referred to as with the volunteer organization on whom the first person shall before second perform certain activities in the field of public advantage without receipt of cash or other material remuneration;

11) the personal book of the volunteer – the document of the established form by which activities of physical person as the volunteer are confirmed;

12) the state register of volunteers – the register which joins volunteers as participants of volunteer programs or volunteer shares, and also voluntarily stated declaration of will about that participation;

13) information network of volunteering – the open information resource on the Internet providing mechanisms of promotion of specific proposals, programs for rendering assistance of volunteer activities;

14) the coordinator of volunteers – the volunteer or the employee of the volunteer organization appointed by the volunteer organization from among her members for the purpose of implementation of such functions as instructing of volunteers, job sharing between them, determination of the place and amount of work of each volunteer, the control over the implementation of work by them and also having powers of interaction is direct with authorized body of public administration in the field of volunteering, other executive bodies and local government bodies and with other volunteer organizations.
