The government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan which are hereinafter referred to as with the Parties

for the purpose of creating favorable conditions for development of the message between the Republic of Kazakhstan and the Republic of Uzbekistan,

being guided by need of enhancement of procedure for the omission through the Kazakhstan-Uzbek frontier of persons, vehicles, freights, goods and animals,

recognizing need of identification and suppression of illegal migration, arms trafficking, drugs, psychotropic substances and precursors, and also acceptances of joint and timely measures according to the prevention of distribution of epidemics and epizooty,

agreed as follows:

Article 1

For crossing of the Kazakhstan-Uzbek frontier by persons and vehicles, and also cargo transfers, goods and animals of the Party will establish the international, bilateral check points through frontier (further referred to as - check points).

Lists of check points of the Party will approve through diplomatic channels and will draw up protocols which will be integral parts of this agreement.

In coordination of boundary and customs departments of the states of the Parties and according to national legal systems of the states of the Parties Items of the simplified omission of citizens of the states of the Parties can be established.

Article 2

Crossing of the Kazakhstan-Uzbek frontier by persons through automobile check points can be performed with use of vehicles or on foot.

Article 3

Boundary, customs and, if necessary, other types of control of persons, vehicles, freights, goods and animals (further referred to as control) are performed at check points according to national legal systems of the states of the Parties and international treaties which participants they are.

Article 4

Opening of check points is performed after completion of their arrangement and creation of necessary infrastructure for activities of regulatory authorities of the states of each of the Parties.

The parties notify each other on opening or closing of the established check points through diplomatic channels.

Competent authorities of the Parties, actionees of this agreement, are:

from the Republic of Kazakhstan - the Border service of Committee of homeland security of the Republic of Kazakhstan and Customs committee of the Ministry of state revenues of the Republic of Kazakhstan;

from the Republic of Uzbekistan - Committee on protection of Frontier of the Republic of Uzbekistan and the State Customs Committee of the Republic of Uzbekistan.

Article 5

Work of check points is carried out round the clock if other procedure is not established in coordination with competent authorities of the Parties.

This agreement does not mention obligations which are earlier assumed by the Parties in relation to other states and is not directed against the third countries and their interests.

Article 6

Restriction or the termination of movement through check points can be performed for the benefit of homeland security of the states of the Parties, for the sanitary and quarantine reasons, owing to natural disasters, in case of epidemics and epizooty. The party which introduces such restrictions notifies other Party through diplomatic channels not later than 24 hours till the planned time of their introduction with indication of the reasons and effective periods of restrictions.

The parties will inform each other on restriction or the termination of movement through the Kazakhstan-Uzbek frontier in connection with planned repair of objects of check points or communication constructions not later than three months prior to such works with the notification on date of their completion.

Article 7

In exceptional cases (natural disasters, the fires, floods, epidemics, epizooty, accidents of technogenic nature, rendering emergency medical service), boundary departments of the states of the Parties according to the mutual arrangement can perform the omission of citizens of the states of the Parties, vehicles and the equipment through frontier out of operating points of the omission with observance of established procedure of control.

Article 8

For ensuring proper activities of check points each of the Parties creates necessary infrastructure in the territory of the state.

When designing, and also when constructing facilities automobile and railway check points the possibility of creation of conditions for carrying out joint control in the territories of the states of the Parties is provided.

The procedure and the organization of joint control will be settled by separate arrangements between the relevant departments of the Parties.

Article 9

For the purpose of implementation of this agreement of the Party will hold in case of need bilateral consultations concerning its execution.
