This Law establishes the legal basis of activities and governs the public relations in the field of mail in the territory of the Republic of Kazakhstan, determines the rights and obligations of subjects of mail activities, competence of state bodies in mail.

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) subscription box - the special box for receipt of separate types of mailings established on production facilities of operators of mail for use by addressees;

2) subscriber mailbox - the special cabinet with cells established in buildings, apartment houses (residential buildings), individual apartment houses for receipt of mailings by addressees;

3) the addressee (receiver) - the user of services of the operator of mail to whom the mailing or postal money transfer are addressed;

3-1) special mail service - type of the express mail service performed by structural division of the National operator of mail and providing acceptance, processing, protection, transportation and delivery (delivery) of the mail, special and other departures containing any secret protected by the law and values including precious metals, gemstones and products from them;

4) the personalized device - the device for drawing on documents and mailings of prints with indication of the name of the operator of mail, its production facility, and also other information determined by the operator of mail;

5) parcel post - not registered and registered mailing with printing editions, official papers, documents and other objects, the sizes which weight and method of packaging are provided according to rules of provision of services of mail service;

6) hybrid departure - the e-mail (message) accepted by the operator of mail to transfer and delivered to the addressee in the form of the letter (postcard) or the letter (postcard) accepted by the operator of mail to transfer and delivered to the addressee in the form of the e-mail (message) to e-mail or electronic subscriber mailbox;

11) distribution of periodic printing editions on subscription - provision of mail by the operator based on the signed contract with the owner of mass media or his representative of service in acceptance of subscription to the periodic printing edition, including with use of Internet resource, and to implementation of acceptance, processing, transportation and delivery of the periodic printing edition to the user of services of the operator of mail;

12) the international commercial correspondence with the answer - the mailing which is drawn up according to acts of Universal Postal Union, containing prepaid the sender the mailing of return;

13) services of the accelerated mail service - service in transfer of mailings with the mode of the accelerated processing, transportations, deliveries and (or) deliveries of mailings;

14) the sender - the user of services of the operator of mail who transfers the operator of mail the mailing or money for their transfer;

15) sending - the registered mailing with things, objects and goods, the sizes, weight and which packaging are provided according to rules of provision of services of mail service;

16) the courier - the employee of operator of mail or the physical person having the contract with the operator of mail which accepts the registered mailing at the sender outside production facility and hands the mailing to the specified address on the mailing;

17) services of express mail service - the services in acceptance, transportation and delivery of the registered mailings rendered by the courier;

17-1) mailing with the announced value - the mailing (except postcard) when which giving by the sender its cost by submission of supporting documents according to the procedure appears, determined by authorized body in the field of mail;

18) operational day - working hours during which the operator of mail provides mail services;

19) production facility - the building, the room in the building intended and equipped for implementation of activities in the field of mail by the operator of mail;

20) mail - the communication type providing in the territory of the Republic of Kazakhstan provision of mail of range of services by operators and implementation of other activities according to acts of Universal Postal Union and this Law;

21) universal services of mail service - the services which are part of universal communication services which appear to any user of services of the operator of mail in any settlement in the set time with the established quality and the price level providing availability of these services;

22) services of mail service - activities of operators of mail for transfer of the registered and not registered mailings, postal money transfers, hybrid departures, distribution of periodic printing editions, realization of signs of mail payment and philatelic products;

23) means of mail service - the technical means, the equipment and technologies used for provision of services of mail service;

25) mail network - set of the production facilities and mail routes used by provision of mail of services of mail service by the operator;

26) mailings - the written correspondence, sending accepted to transfer of mail by the operator;

27) delivery of the mailing - movement of the mailing from production facilities of the destination in subscription box or subscriber mailbox, or to other address specified by the sender;

28) transfer of the mailing - set of transactions of acceptance, processing, transportation and (or) transfer, delivery and (or) delivery of the mailing;

29) acceptance of the mailing - registration of mail by the operator for further transportation of the mailing accepted from the sender;

30) processing of the mailing - the production operations with mailings providing their preparation for transportation;

33) the postal index - the schematic digital and letter symbol of the address appropriated to real estate objects for their administrative-territorial identification and systematization for the purpose of acceleration of transfer of the mailing or postal money transfer;

34) postcard - not registered or registered mailing with the written message on the special standard form;

35) mail activities - provision of services of mail service through mail networks;

36) subjects of mail activities are operators of mail and users of services of the operator of mail;

37) the operator of mail - the physical person or legal entity registered in the territory of the Republic of Kazakhstan providing services in the field of mail activities;

38) the user of services of the operator of mail - the physical person or legal entity which is the consumer of the services provided by the operator of mail including based on the agreements signed by it with the operator of mail;

39) authorized body in the field of mail (further - authorized body) - the central executive body of the Republic of Kazakhstan enabling within the competence the realization of state policy, the state control, coordination and regulation of activities in the field of mail in the territory of the Republic of Kazakhstan;
