1. Approve Regulations on decrease in sulfur content in some types of liquid fuel it (is applied).
2. This Resolution becomes effective within three months from the date of publication, except for Provision Item 9 which will be applied since January 1, 2020.
3. To impose control over the implementation of this resolution on the Ministry of Agriculture, regional development and the environment.

to the Order of the Government of the Republic of Moldova of April 8, 2016 No. 414
This Provision shifts the Directive 1999/32/CE of Council of April 26, 1999 about reducing sulfur content in certain types of liquid fuel and amending the Directive 93/12/CEE published in the Official Magazine of the European Community L121 of May 11, 1999.
1. The regulations on decrease in sulfur content in some types of liquid fuel (further – the Provision) establish conditions of use of certain types of liquid fuel, including ship fuel, for the purpose of emission reduction of sulfur dioxide, the resulting their burning, reduction of negative effects of such emissions for health of the population and the environment.
2. Emission reduction of sulfur dioxide, the certain types of liquid fuel resulting from combustion received from oil is performed by limiting introduction of values on sulfur content in these fuels, as condition for their use in the territory of the Republic of Moldova, including in exclusive economic zone or in pollution control zones.
3. In this Provision the following basic concepts are determined:
MARPOL – The international convention on prevention of pollution from courts, 1973 changed by the Protocol, accepted in London on February 17, 1978 which the Republic of Moldova joined the Law No. 189-XVI of July 28, 2005 on accession of the Republic of Moldova to the International convention on prevention of pollution from courts accepted in London on November 2, 1973 and to the Protocol to it (to MARPOL 73/78) accepted in London on February 17, 1978;
zones of control of emissions of SOx – the sea zones determined by International Maritime Organization into whom obligatory special measures concerning emissions of SOx occurring from courts for prevention, decrease and control of pollution of the atmosphere are entered;
passenger ships – the vessels transporting more than 12 passengers;
the passenger – any person on the vessel, except the captains and crew members hired or occupied in ship activities of persons, and children aged up to one year;
regular services – series of the flights performed by passenger ships for servicing of movement between the same ports or large number of ports, or series of trips from port to port without intermediate calling port, according to the published schedule, or carried out with such regularity or frequency that represent the acknowledged schedule;
public vessels – vessels which belong to armed forces of the state carry the external signs distinguishing such vessels on nationality, are under command of the officer authorized by the government of the relevant state whose surname is specified in the corresponding office list or its equivalent onboard which there is crew undergoing conscription service in armed forces;
moored to the court mooring – court, standing in safety conditions on a leash or on anchor in the port of the Republic of Moldova for the period of loading, unloading or in case of accomplishment of calling port, including time spent in case of unemployment by handling works;
placement in the market – delivery or provision in the territory of the Republic of Moldova to the third party for a fee or free of charge ship fuel for burning onboard the vessel. Exception are deliveries or provision to export of the ship fuel containing in cargo tankers of the vessel;
method of decrease in emissions – any material improvement, accessories, the device or devices, materials, the equipment for installation on the vessel or other procedures, alternative fuel, or the compliance methods used as an alternative to decrease in sulfur content in ship fuel for fulfillment of requirements, established in this Provision which give in to check, measurement and execution;
the ASTM D 86 method – the method provided by the American community on testing and materials in the edition of 1976 for standard definitions and specifications of petroleum products and lubricants;
installation for burning – any technical device in which fuel is oxidized for the purpose of use of the developed heat energy.
4. This Provision is applied to the following types of liquid fuel:
1) fuel oil – any liquid fuel derivative from oil, except for the ship fuel determined according to the Combined commodity nomenclature approved by the Law No. 172 of July 25, 2014 in codes: from 2710 19 510 to 2710 19 680 and, respectively, codes 2710 20 310, 2710 20 350, 2710 20 390, or any liquid fuel derivative oils, except for the gasoil determined in subitems 2) and 3) which on limits of distillation belongs to the category of heavy oils, held for use in fuel quality from which less than 65% on amount, including losses, are distilled in case of 250 °C by the SM ASTM D86 method. If distillation cannot be determined by the SM ASTM D method 86, the petroleum product enters category of fuel oil;
2) gasoil – any liquid fuel received from oil, except for ship fuel, determined according to the Combined commodity nomenclature in codes 2710 19 250, 2710 19 290, 2710 19 470, 2710 19 480, 2710 20 170 or 2710 20th 190, or any liquid fuel received from oil, except for ship fuel from which less than 65% on amount, including losses, are distilled in case of 250 °C, and from which, at least 85% on amount, including losses, are distilled in case of 350 °C by the SM ASTM D86 method;
