About lotteries and lottery activities
This Law governs the public relations in the field of lottery and lottery activities in the Republic of Kazakhstan, determines procedure and conditions of its organization and carrying out, establishes organizational bases of state regulation in the field of lottery and lottery activities.
In this Law the following basic concepts are used:
1) superprize - the part of prize fund of drawing lottery which is not played during draw of circulation and passing from one circulation into the following circulation according to conditions of carrying out lottery;
2) prize fund - the money and (or) other property created due to distribution (realization) of lottery tickets, receipts or other documents or at the expense of own means of the operator of lottery and paid to participants of lottery in the form of prize;
3) draw of prize fund - process which is carried out after distribution (realization) of lottery tickets, receipts or other documents and directed to determination won (won) the participant (participants) of lottery;
4) lottery - game which is held according to this Law, conditions of carrying out lottery and the agreement, in which one party (the operator of lottery) holds draw of prize fund, and the second party (the participant of lottery) acquires the right to prize if it is acknowledged the lottery which won in accordance with the terms of carrying out. Lottery is not the draw of the prizes directed to sales promotion of goods (services) by the commercial organizations;
5) the center of processing of lottery information - the hardware and software connected to communication networks and intended for receipt, storage and accounting of information on the widespread (implemented) lottery tickets, receipts or other documents, revenue from the implemented lottery tickets, receipts or other documents, the paid prizes and its transfers from the operator of lottery to the center of the lottery reporting;
6) the lottery ticket, the receipt or other document - the document provided by conditions of carrying out lottery, including electronically, confirming the participation right in lottery;
7) the center of the lottery reporting - the hardware and software connected by means of communication networks to the center of processing of lottery information, allowing to obtain timely from the operator of lottery information on the widespread (implemented) lottery tickets, receipts or other documents, revenue from the implemented lottery tickets, receipts or other documents, the paid prizes;
8) the lottery equipment - the device or devices (random number generator, mechanical, electric, electronic or other technical devices) intended (intended) for determination of advantageous lottery combination;
9) authorized body in the field of lottery and lottery activities (further - authorized body) - the central executive body performing management in the field of lottery and lottery activities;
10) lottery combination - the set of symbols (texts, numbers, signs, drawings) provided by conditions of carrying out lottery specified in the lottery ticket, the receipt or other document;
11) the participant of lottery - the physical person which reached eighteen-year age, owning the lottery ticket, the receipt or other document granting the participation right in draw of prize fund;

13) the operator of lottery - the legal entity performing activities for carrying out lotteries;
14) carrying out lottery - implementation of the actions including production of lottery tickets, receipts or other documents or the conclusion of agreements on their production, and also the conclusion of agreements with the manufacturer lottery and other the equipment, necessary for carrying out lottery, software products and (or) others agreements (contracts), necessary for carrying out lottery, distribution (realization) and accounting of lottery tickets, receipts or other documents, draw of prize fund, examination of advantageous lottery tickets, receipts or other documents, payment of prizes to participants of lottery, implementation of other actions and actions necessary for carrying out lottery;
14-1) distributor (agent) of lottery - the individual entrepreneur or the legal entity performing for remuneration distribution (realization) of lottery tickets, receipts or other documents, verification of advantageous lottery tickets, receipts or other documents, and also payment of prizes from name and at the expense of the operator of lottery;
15) the lottery terminal - the equipment intended for implementation (registration) of lottery tickets, receipts or other documents;
16) instant lottery - type of lottery in which the set of symbols (texts, numbers, signs, drawings) allowing to determine prizes is pledged in lottery tickets, receipts or other documents for stages of production and before their distribution (realization) among participants of lottery. When carrying out instant lottery the participant of such lottery directly after payment of the lottery ticket, the receipt or other document and issue (registration) of the lottery ticket, the receipt or other document determines availability and the size of the prize or its absence;
17) circulation - the number of the widespread (implemented) lottery tickets, receipts or other documents participating in draw of prize fund (part of prize fund) in accordance with the terms of carrying out lottery;
18) drawing lottery - type of lottery in which the draw of prize fund between participants of lottery is held with use of the lottery equipment one-timely after distribution (realization) of lottery tickets, receipts or other documents;
19) prize - the part of prize fund paid by the operator of lottery in the amount of and form (cash or in nature) in accordance with the terms of carrying out lottery to the participant of lottery recognized won in accordance with the terms of carrying out lottery.
1. The legislation of the Republic of Kazakhstan on lotteries and lottery activities is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.
2. If the international treaty ratified by the Republic of Kazakhstan establishes other rules, than those which contain in this Law then are applied rules of the international treaty.
The basic principles in the field of lottery and lottery activities are:
1) ensuring equality of conditions of the participation in lottery assuming equality of chances of participants of lottery of prize;
2) ensuring the publicity assuming the obligatory publication of conditions of carrying out lottery and results of draws of prize fund of drawing lotteries.
