Agreement between the Russian Federation and Republic of Kazakhstan on unity of management of Customs Services

of May 16, 1995

The Russian Federation and the Republic of Kazakhstan which are hereinafter referred to as with the Parties based on the Agreement on the Customs union of January 20, 1995,

wishing to provide unity of management of Customs Services of the Russian Federation and the Republic of Kazakhstan,

agreed as follows:

Article 1.

For the purposes of this agreement the provided terms mean:

"Customs Service of the Russian Federation" - the State Customs Committee of the Russian Federation;

"Customs Service of the Republic of Kazakhstan" - Customs committee under the Cabinet of Ministers of the Republic of Kazakhstan;

"Representative office of Customs Service of the Russian Federation under Customs Service of the Republic of Kazakhstan" - the organizational structures and the staff of Customs Service of the Russian Federation providing unity of management of Customs Service of the Republic of Kazakhstan with Customs Service of the Russian Federation;

"Representative office of Customs Service of the Republic of Kazakhstan under Customs Service of the Russian Federation" - the organizational structures and the staff of Customs Service of the Republic of Kazakhstan providing unity of management of Customs Service of the Republic of Kazakhstan with Customs Service of the Russian Federation;

"members of families of staff of Representations" - spouses, children, and also constantly jointly the relatives living with the staff of Representations and being in their dependence.

Article 2.

For the purpose of ensuring unity of management of the Customs Services:

The parties establish Representative office of Customs Service of the Russian Federation under Customs Service of the Republic of Kazakhstan;

The representation is headed by the Representative of Customs Service of the Russian Federation to Customs Service of the Republic of Kazakhstan who is the deputy chief of Customs Service of the Russian Federation on position, the member of Board of Customs Service of the Republic of Kazakhstan and has the status of the first deputy chief of Customs Service of the Republic of Kazakhstan;

The parties establish Representative office of Customs Service of the Republic of Kazakhstan under Customs Service of the Russian Federation which questions of functioning are determined by Customs Services of the Parties separate protocols within this agreement;

The representative of Customs Service of the Republic of Kazakhstan is the deputy chief of Customs Service of the Republic of Kazakhstan and the member of Board of Customs Service of the Russian Federation on position;

the decisions of Customs Services of the Parties relating to regulation of legal relationship in the field of customs affairs are accepted on the basis of delegation of appropriate authority of one of the Parties and appear for execution in Customs Services relevant decisions of their chiefs.

Article 3.

The representative office of Customs Service of the Russian Federation performs the following main functions:

providing within the powers of accomplishment of this agreement;

approval of decisions of Customs Service of the Republic of Kazakhstan, including the decisions concerning development of customs infrastructure and operational decisions on increase in efficiency of customs control;

organization of exchange of information for customs affairs;

organization of interaction of Customs Services of the Parties, including joint customs control;

development of offers on standardization of the legislation and the regulatory base in the field of customs affairs of the Republic of Kazakhstan with the relevant legislation and the regulatory base of the Russian Federation;

determination of the current and perspective demands in the employee involvement of Representation for work in Customs Service of the Republic of Kazakhstan according to the procedure established by Customs Services of the Parties;

approval of the direction of staff of Customs Service of the Republic of Kazakhstan in educational institutions of Customs Service of the Russian Federation;

approval of questions of material equipping of Customs Service of the Republic of Kazakhstan.

Article 4.

The structure, number and structure of Representations are determined by Customs Services of the Parties by mutual approval.

Article 5.

Representative of Customs Service of the Russian Federation to Customs Service of the Republic of Kazakhstan:

it is appointed the order of the chief of Customs Service of the Russian Federation in coordination with the chief of Customs Service of the Republic of Kazakhstan;

performs concerning the staff of Representation of the right of the chief of regional customs authority of the Russian Federation and is manager of the corresponding credits.

Representative of Customs Service of the Republic of Kazakhstan to Customs Service of the Russian Federation:

it is appointed the order of the chief of Customs Service of the Republic of Kazakhstan in coordination with the chief of Customs Service of the Russian Federation;

performs concerning the staff of Representation of the right of the chief of regional customs authority of the Republic of Kazakhstan and is manager of the corresponding credits.

Article 6.

1. The laws and regulations of the Russian Federation determining the status of staff of Customs Service of the Russian Federation extend to the staff of Representative office of Customs Service of the Russian Federation and members of their families in full; behind them the privileges and benefits established for the staff of Customs Service of the Russian Federation and members of their families remain.

Staff of Representation wears the uniform established for officials of customs authorities of the Russian Federation and has the right to storage and carrying firearms according to the procedure established for officials of Customs Service of the Republic of Kazakhstan.

2. The laws and regulations of the Republic of Kazakhstan determining the status of staff of Customs Service of the Republic of Kazakhstan extend to the staff of Representative office of Customs Service of the Republic of Kazakhstan and members of their families in full; behind them the privileges and benefits established for the staff of Customs Service of the Republic of Kazakhstan and members of their families remain.

Staff of Representation wears the uniform established for officials of customs authorities of the Republic of Kazakhstan and has the right to storage and carrying firearms according to the procedure established for officials of Customs Service of the Russian Federation.

Article 7.

Staff of Representation and members of their families observe the Constitution and the legislation of adoptive state.

Safety, legal and social protection is guaranteed to the staff of Representations and members of their families.
