About national standartization
The parliament adopts this organic law.
This law is applied to activities for national standartization and establishes the legal basis of its organization.
For the purposes of this law the following basic concepts are used:
application of the standard – use of the standard in the sphere of production, services, in trade, in case of public procurements, in activities for supervision of the market and in other areas;
poll about the standard – provision of sufficient time for consideration of the standard or the draft standard by concerned parties which can submit in writing notes and offers to this standard for the purpose of establishment of consensus;
compliance to the standard – accomplishment of all requirements of the standard;
the document on standardization – others, than the standard, specifications accepted by body for standardization for repeated or permanent application which observance is not obligatory;
National fund of standards – set of the standards which are under authority of national authority on standardization and other documents on standardization – the Moldavian, European, international, interstate and other countries;
quality infrastructure – set of the organizations performing activities in the field of standardization, metrology, assessment of conformity and accreditation;
body for standardization – the body recognized at national, regional or international level performing activities for standardization which main function according to its status are development and approval or adoption of the standards available to wide range of users;
the national authority on standardization – the body for standardization recognized at the level of the Republic of Moldova, authorized to become the national member of the relevant international or regional standardization organizations;
the concerned party – physical person or legal entity, including bodies of the public power which is interested and occupied with activities for standardization, namely: producers, associations of consumers, the foster or trade-union organizations or associations, micro, small and medium scale enterprises, educational, design and research establishments, test laboratories, certification bodies, bodies for supervision of the market and other interested physical persons and legal entities;
the program for national standartization – the working program of national authority for standardization containing list of subjects which are object of activity on standardization;
the draft standard – the document containing specifications of rather specific subject which can be approved according to rules of national standartization which content is result of preliminary works and extends for the purpose of submission of notes and offers or for poll on it;
process – set of the interconnected or interacting types of activity of which the product or service is result;
products – any by industrial method the produced products and any agricultural products, including fish products;
service – any independent economic activity rendered by regular method on paid basis;
system – set of the interconnected or interacting elements;
the direct reference on standards – the reference to standards in legislative and regulations, specifying that the single way of achievement of compliance to certain requirements of the regulation is observance of the standards specified as the reference;
the indirect reference to standards – the reference to standards in legislative and regulations, specifying that one of ways of achievement of compliance to certain requirements of the regulation is observance of the specified standards;
the dated reference to standards – the reference to standards in legislative and regulations, identifying one or several specific standards so that the subsequent reviews of the specified standards were applicable only after modification of the regulation;
the undated reference to standards – the reference to standards in legislative and regulations, identifying one or several specific standards so that the subsequent reviews of the specified standards were applicable without the need for modification of the regulation;
specifications – the document providing technical requirements to which there shall correspond products, process, service or system, and the establishing one or more of the following aspects:
a) necessary product characteristics, including the quality levels, efficiency, interaction, environmental protection, health, safety or the sizes, and also the requirements applied to products concerning the trade name, terminology, symbols, testing and test methods, packaging, marking or labeling and assessment procedure of compliance;
b) the methods and production processes applied to agricultural products, products intended for consumption by the person and animals, to medicines and also the methods and production processes connected with other products if those influence its characteristics;
c) necessary characteristics of service, including the quality levels, efficiency, interaction, environmental protection, health, safety, and also requirements imposed on the supplier concerning information which shall be provided to the receiver;
d) methods and criteria for evaluation of efficiency of construction products, establishment of agreed terms for sale of construction products, concerning their main characteristics;
ICT specifications – specifications in the field of information and communication technologies;
the standard – the specifications developed on the basis of consensus accepted by acknowledged body for standardization for repeated or permanent application which observance is not obligatory;
the Moldavian standard – the standard approved or accepted by national authority of the Republic of Moldova on standardization;
the European standard – the standard accepted by any European standardization organization;
the harmonized standard – the European standard accepted at the request of the European commission for application of the harmonized European Union law;
the international standard – the standard accepted by any International Organization for Standardization;
the interstate standard – the standard accepted by Interstate council on standardization, metrology and certification;
the conflict Moldavian standard – the Moldavian standard which has the same scope, as the European, international, interstate standard or the standard of other country and which contains the conditions contradicting conditions of the European, international, interstate standard or standard of other country;
standardization – the specific activities performed by acknowledged body for standardization during which are developed, affirm, accepted standards and other documents on standardization are reviewed, change and cancelled;
national standartization – the standardization which is carried out at the level of one specific country.
Activities for national standartization are activities in public interests and promote:
a) to increase in competitiveness of national economy;
