The agreement between the Government of the Republic of Kazakhstan and the Cabinet of Ministers of Ukraine on cooperation in the field of standardization, metrology and certification

of October 14, 1997

Government of the Republic of Kazakhstan and Cabinet of Ministers of Ukraine, further "Parties",

for the purpose of elimination of technical barriers in economic and trade relations, expressing the aspiration to develop cooperation in the field of standardization, metrology and certification, proceeding at the same time from the principles and regulations accepted by the international organizations

being guided by economic interests of both Parties,

agreed as follows:

Article 1

The parties mutually recognize the operating state systems of standardization, ensuring unity of measurements and certification.

Parties:

provide mutual submission of regulating and reference documents on standardization, metrology and certification on agreed terms;

mutually recognize in the procedure approved by the Parties results of the state testing, approvals of type (including certificates), checkings, calibrations, metrological certification of measuring instruments and the organization which carry out accreditation of testing and test laboratories and centers, and also the laboratories and the centers performing checking, testing and calibration of measuring instruments accredited by them;

recognize accredited bodies on certifications, test laboratories and the centers of other Party issued by them certificates and marks of conformity on mutually delivered goods.

Responsibility for safety of products is born by her manufacturer, and for reliability of certificates of conformity - the body which issued the certificate.

The either party can apply regulating documents on standardization, metrology and certification of other Party if their requirements do not contradict the established procedure entered by national authority on standardization, metrology and certification according to the current legislation of the state.

Article 2

The parties will cooperate on the basis of the agreements, protocols and programs providing:

interaction in development of regulating and methodical documents on standardization, metrology and certification;

preparation and advanced training of personnel;

creation, enhancement and checking of national standards of units of physical quantities and initial model measuring instruments;

creation and application of standard samples of structure and properties of substances and materials, and also standard help data on physical constants and properties of substances and materials;

further development, enhancement and harmonization of the state systems of standardization, ensuring unity of measurements and certification;

development of information activities in the field of standardization, metrology and certification.

Article 3

The parties will give mutual support in case of the accession to the international organizations in the field of standardization, metrology and certification which member is one of the Parties, and in work of these organizations.

Article 4

The parties provide confidentiality of the obtained documentation and information on the works which are carried out within this Agreement and on the achieved scientific and technical results if the transferring Party stipulates their konfiditsialnost. This information can be transferred to the third state only in case of written consent of the Party which provided it.

Article 5

The coordination of works provided by this Agreement, and their realization are assigned:

in the Republic of Kazakhstan - on standardization Agency, metrology and certification of Ministry of Economics and trade of the Republic of Kazakhstan;

in Ukraine - on the State committee of Ukraine on standardization, metrology and certification.

Article 6

Provisions of this agreement if necessary are concretized by supplementary agreements and protocols between standardization Agency, metrology and certification of Ministry of Economics and trade of the Republic of Kazakhstan and the State Committee of Ukraine on standardization, metrology and certification.

Article 7

Financing of cooperation will be performed on the basis of the mutual arrangement of the Parties.

Article 8

This agreement does not affect the rights and obligations following from the agreements signed by the Parties and their organizations with other states.

Article 9

All matters of argument connected with interpretation and accomplishment of this agreement will be solved by mutual consultations and negotiations at the different levels.

Article 10

This Agreement is signed sine die and becomes effective from the date of its signing.

Any Party can denounce this Agreement, having notified in writing other Party on the intention.

The Agreement is terminated in 6 months from the date of receipt of such message by other Party.

It is made in Almaty on October "14", 1997 in duplicate, everyone in the Kazakh, Ukrainian and Russian languages, and all texts are authentic. In case of disagreements concerning interpretation of provisions of this agreement, preference is given to the text in Russian.
