About enhancement of public administration in the sphere of control of drug trafficking, psychotropic substances and their precursors and in the sphere of migration

For the purpose of enhancement of public administration in the sphere of control of drug trafficking, psychotropic substances and their precursors and in the sphere of migration, according to article 80 of the Constitution of the Russian Federation, the Federal constitutional Law of December 17, 1997 "About the Government of the Russian Federation" and until adoption of the relevant Federal Law I decide No. 2-FKZ:

1. Abolish Federal Drug Control Service of the Russian Federation and Federal Migration Service.

2. Transfer to the Ministry of Internal Affairs of the Russian Federation:

a) functions and powers of the abolished Federal Drug Control Service of the Russian Federation and Federal Migration Service;

b) the number of staff of the abolished Federal Drug Control Service of the Russian Federation;

c) the number of staff of the abolished Federal Migration Service, having reduced it by 30 percent.

3. Determine that the Ministry of Internal Affairs of the Russian Federation is:

a) the federal executive body performing functions on development and realization of state policy and normative legal regulation in the sphere of internal affairs, in the sphere of control of drug trafficking, psychotropic substances and their precursors in the sphere of migration, and also law-enforcement functions on federal state control (supervision) in the specified spheres;

b) the legal successor of the abolished Federal Drug Control Service of the Russian Federation and Federal Migration Service, including according to the obligations which resulted from execution of judgments.

4. Determine that:

a) employees, federal government civil servants and employees of monitoring bodies for drug trafficking and psychotropic substances (further - bodies of drug enforcement) and the Federal Migration Service continue to fulfill the duties assigned to them before completion of the actions provided by this Decree;

b) the staff of bodies of drug enforcement who showed willingness to arrive on service in law-enforcement bodies of the Russian Federation (further - law-enforcement bodies) is employed in the specified bodies according to the procedure of the translation without probation period and recertification. The lump-sum allowance is not paid to such employees;

c) to the staff of bodies of drug enforcement employed in law-enforcement bodies according to the procedure of the translation:

the special ranks corresponding to the special ranks given in bodies of drug enforcement, but not above special colonelcy are given;

terms of stay in special ranks during service in bodies of drug enforcement are set off in case of assignment of the next special ranks;

the length of service in bodies of drug enforcement is set off in length of service in law-enforcement bodies for award of pension, payment of monetary pay and provision of other measures of social support;

the periods and terms of provision of the main and additional vacations, settlement periods for calculation of benefits and compensations estimated during service in bodies of drug enforcement remain;

d) housing and social security of staff of the bodies of drug enforcement employed in law-enforcement bodies according to the procedure of the translation is performed in accordance with the legislation of the Russian Federation.

5. Finish holding the organizational and regular actions connected with implementation of this Decree till June 1, 2016.

6. To the government of the Russian Federation:

a) provide in accordance with the established procedure transfer to the Ministry of Internal Affairs of the Russian Federation of property, including immovable, fixed for abolished by Federal Drug Control Service of the Russian Federation and Federal Migration Service which is necessary for the implementation of functions and powers delegated to the Ministry of Internal Affairs of the Russian Federation;

b) redistribute in accordance with the established procedure budgetary appropriations of the federal budget according to this Decree;

c) provide in the terms established by the legislation of the Russian Federation holding liquidating procedures in connection with abolition of Federal Drug Control Service of the Russian Federation and Federal Migration Service;

d) provide offers on limiting refining of the number of staff of law-enforcement bodies and central office of the Ministry of Internal Affairs of the Russian Federation;

e) bring the acts into accord with this Decree;

e) provide offers on reduction of acts of the President of the Russian Federation to compliance with this Decree;

g) provide the solution of the financial, material and other questions connected with implementation of this Decree.

7. To the Ministry of Internal Affairs of the Russian Federation:

a) provide acceptance to production of criminal cases, materials of verifications of messages on crimes, the cases of operational accounting and other materials which are in production of bodies of drug enforcement, and also continuity of implementation of other functions and powers transferred to it, including business management about administrative offenses, the abolished Federal Drug Control Service of the Russian Federation and Federal Migration Service;

b) provide preserving in system of the Ministry of Internal Affairs of the Russian Federation of territorial authorities of the abolished Federal Drug Control Service of the Russian Federation;

c) provide offers on refining of the list of positions of the highest commanding structure in law-enforcement bodies of the Russian Federation, in the Federal Migration Service, to Bureau on coordination of fight against organized crime and other dangerous types of crimes in the territories of the State Parties of the Commonwealth of Independent States and the special ranks corresponding to these positions, No. 253 approved by the Presidential decree of the Russian Federation of March 1, 2011.

8. Bring in the Regulations on the Ministry of Internal Affairs of the Russian Federation approved by the Presidential decree of the Russian Federation of March 1, 2011 No. 248 "Questions of the Ministry of Internal Affairs of the Russian Federation" (The Russian Federation Code, 2011, No. 10, Art. 1334; 2012, No. 21, Art. 2630; No. 29, Art. 4078; 2013, No. 3, Art. 177; No. 26, Art. 3314; No. 31, Art. 4198; No. 51, Art. 6846; No. 52, Art. 7137; 2014, No. 19, Art. 2396; No. 26, Art. 3524; No. 32, Art. 4467; No. 44, Art. 6041, 6043, 6044; No. 46, Art. 6331; 2015, No. 4, Art. 641; No. 32, Art. 4747, 4748; No. 37, the Art. 5129), and in the structure of central office of the Ministry of Internal Affairs of the Russian Federation approved by this Decree, the following changes:

a) ceased to be valid;

b) to add structure of central office of the Ministry of Internal Affairs of the Russian Federation with Items 8.1 and 8.2 of the following content:
