The agreement between the Government of the Russian Federation and the Government of the Republic of Kazakhstan on cooperation in the field of information security

The government of the Russian Federation and the Government of the Republic of Kazakhstan which are hereinafter referred to as by the Parties

being guided by the Almaty Declaration of December 21, 1991,

understanding that lack of regulation of the relations in the field of ownership, use,

orders information, expressed in lack of restrictions or availability of excessive restrictions for its distribution can cause damage to the Parties,

recognizing need of combination of efforts of the Parties and coordination of their activities in the field of information security,

considering mutual interests in practical implementation of the Agreement on mutual ensuring safety of interstate secrets signed on January 22, 1993 in Minsk

agreed as follows:

Article 1.

The parties build the relations in the field of information security (*) on the basis of mutual respect, sovereignty and equality of the Parties, interests and recognition of the rights in the field of homeland security, protection of intellectual and other property according to the universally recognized norms and the principles of international law.

The questions which are not settled by this agreement, and also international agreements which participants are both Parties will be solved in accordance with the legislation of the Russian Federation and the Republic of Kazakhstan.

Article 2.

Each Party takes necessary measures for ensuring protection of the confidential information transferred to it by other Party according to the regulations regulating questions of protection of the state, official and other protected secret in its territory and also according to the Agreement on mutual ensuring safety of interstate secrets signed on January 22, 1993 in Minsk.

The parties not transfer confidential information by others to foreign states, legal entities and physical persons without the consent of the Party from which this information is obtained.

Article 3.

The parties will hold consultations and to exchange work experience on enhancement of system of information security, forming of single conceptual framework in this sphere.

Article 4.

The parties will cooperate in area:

developments and uses of normative and methodical documents in the field of information security, including on counteraction to foreign technical intelligence services, protection against unauthorized information access;

preparation, use and advanced training of personnel on the basis of the approved qualification requirements to the graduate of the corresponding higher educational institution, the complex information security specialist; developments and uses of means of information protection;

developments of legal acts concerning ownership, uses and orders information;

rendering services in complex engineering supervision of condition of security from technical means of investigation of objects of different function, including automated control systems;

developments of bonds between the State technical commission in case of the President of the Russian Federation and the State technical commission on information security under the Cabinet of Ministers of the Republic of Kazakhstan.

Article 5.

The parties recognize acting education documents and qualifications of specialists in the field of information security, about assignment of academic degrees and ranks on these questions, issued state and others officially by the organizations equated to them in the territories of the Parties.

Article 6.

For the purpose of implementation of this agreement of the Party will hold business meetings and to create joint working groups.

Article 7.

Financing of the events held within this agreement is performed by the Parties according to the procedure and on the conditions approved by them on each action.

Article 8.

In case of disputes over interpretation or application of provisions of this agreement of the Party will resolve them by negotiations. Under approval between the Parties changes and additions can be made to this agreement.

Article 9.

This agreement becomes effective from the date of its signing, will be effective within five years and to be prolonged automatically for the subsequent five-year periods if any of the Parties does not notify in 6 months prior to the expiration of current period in writing other Party on the decision to terminate the Agreement. It is made in Moscow on January 13, 1995 in duplicate, everyone in the Russian and Kazakh languages, and both texts are equally authoritative.
