being guided by articles 1 and 2 of the Agreement between the Government of the Russian Federation and the Government of the Republic of Kazakhstan about cooperation in the field of peaceful use of atomic energy of September 23, 1993,

recognizing long-term potential opportunities of the managed thermonuclear synthesis as almost unrestricted, environmentally acceptable and economically competitive power source,

including continuation of works on thermonuclear subject as one of the most important elements of development of science, the equipment and the industry, essential political and economic factor in international cooperation,

proceeding from the long-term interests connected with need of preserving and further development of scientific and technical potential of each of the Parties

considering deep integration of the developed scientific and technical and production bonds,

emphasizing feasibility of interstate cooperation in the scientific and technical sphere,

based on the Agreement between European Atomic Energy Community, the Government of the Russian Federation, the Government of the United States of America and the Government of Japan on the cooperation in development of the engineering design of the International thermonuclear experimental reactor (ITER) signed on July 21, 1992, the appendices and protocols to it, and also the amendment to this Agreement prolonging its action till 2001 which further are referred to as with the Agreement on ITER

for the purpose of carrying out joint operations within the engineering design of the International thermonuclear experimental reactor which further is referred to as with the engineering design of ITER

agreed as follows:

Article 1

The parties according to the international obligations and within the national legal system perform activities for the purpose of introduction of constructive contribution to development of the engineering design of ITER.

Article 2

The parties undertake obligations on accomplishment of mutually coordinated research and development works within the engineering design of ITER.

Article 3

1. The parties are appointed by the plenipotentiaries in the field of maintaining mutually coordinated research and development works within the engineering design of ITER:

from the Russian Side - the Ministry of the Russian Federation of atomic energy;

from the Kazakhstan Side - the Ministry of science - Academy of Sciences of the Republic of Kazakhstan.

The specified plenipotentiaries create respectively the Russian and Kazakhstan directorates of the engineering design of ITER.

2. The ministry of science - the Academy of Sciences of the Republic of Kazakhstan coordinates accomplishment of research and is experienced design works within the engineering design of ITER in the Republic of Kazakhstan on tasks of the Russian directorate of the engineering design of ITER and the Ministry of the Russian Federation of atomic energy.

3. The main contractors of research and development works within the engineering design of ITER are:

from the Russian Federation - the state company "Research Institution of the Electrophysical Equipment of D. V. Efremov", the state unitary enterprise "Research and Design Institute of the Power Equipment", the state scientific center of the Russian Federation - the All-Russian Research Institute of inorganic materials of name of the academician A. A. Bochvar, the state scientific center of the Russian Federation - the Russian scientific center "Kurchatov Institute";

from the Republic of Kazakhstan - joint-stock company of the companies of nuclear power and the industry, the National nuclear center of the Republic of Kazakhstan, Research institution of experimental and theoretical physics of the Kazakh state university.

Article 4

Distribution, use and information security, applied or received as a result of the activities performed within this agreement, and distribution of the intellectual property rights, formed during such activities, are regulated by the national legal system of the Parties, and also the Agreement on ITER.

Article 5

Plenipotentiaries of the Parties with participation of the Russian and Kazakhstan directorates of the engineering design of ITER consider and approve intermediate and final results of nauchnoissledovatelsky and developmental works within the engineering design of ITER.

Article 6

The parties do all necessary within the national legal system for implementation of this agreement taking into account the Agreement on ITER.

Article 7

The damage suffered by one of the Parties in the course or as a result of accomplishment of this agreement is compensated according to the national legal system of the Parties.

Article 8

1. The parties, being effective through the plenipotentiaries, hold consultations on any question resulting from implementation of this agreement or as a result of disagreements in interpretation of the Agreement or on any technical issue concerning the tasks stated in mutually approved list of research and development works within the engineering design of ITER. The parties undertake all feasible measures for settlement of such questions by means of consultations between plenipotentiaries.

2. Each of the Parties can request carrying out consultations with other Party on questions which cannot be resolved according to Item 1 of this Article. The party to which such address arrived without delay will agree with such request.

Article 9

In case of need the Parties in the mutual written consent can make changes and additions to this agreement. Changes and amendments become effective from the date specified in such written arrangement.

Article 10

This agreement becomes effective from the date of its signing and remains in force during all duration of the agreement on ITER.

Article 11

Each of the Parties can terminate this agreement by the direction to other Party of the written notice of the intention not later than 6 months before expected date of cancellation of the Agreement.

It is made in Alma-Ata on October 12, 1998 in duplicate, everyone in the Russian and Kazakh languages, and both texts are equally authoritative.
