About approval of the Regulations on check points through Frontier of the Republic of Uzbekistan

According to the Law of the Republic of Uzbekistan "About Frontier of the Republic of Uzbekistan" and for the purpose of establishment of single procedure for opening, functioning and closing of check points through Frontier of the Republic of Uzbekistan the Cabinet of Ministers decides:

1. Approve Regulations on check points through Frontier of the Republic of Uzbekistan according to appendix.

2. To the ministries and departments to provide the regulatory legal acts adopted by them according to this resolution in a month.

3. No. 347 "About approval of the Regulations on check points of border troops of Service of homeland security of the Republic of Uzbekistan" to declare the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of October 2, 1996 invalid.

4. To impose control over the implementation of this resolution on the deputy prime minister of the Republic of Uzbekistan B. I. Zakirov.

Regulations on check points through Frontier of the Republic of Uzbekistan

I. General provisions

1. This Provision determines international legal, organizational, financial and economic bases of opening, functioning, closing, construction and reconstruction of check points through Frontier of the Republic of Uzbekistan (further - check points).

2. In this Provision the following basic concepts are used:

Frontier of the Republic of Uzbekistan - the line and the vertical surface passing across this line determining limits of the territory of the Republic of Uzbekistan (sushi, waters, subsoil and airspace);

the check point - the territory (part of the territory), border railway stations and automobile ways, river ports, the airports (airfields) open for the international messages, and also other specially equipped place where are performed boundary, customs both other types of control and the omission through Frontier of the Republic of Uzbekistan of persons, vehicles, goods, other property, animal, seed, landing material and other products of animal and phytogenesis;

initiators of opening of the check point - Joint-stock company "÷zbekiston temir y¸llar", National airlines "÷zbekiston havo y¸llar", public authorities on places, and also the ministries and departments interested in functioning of the check point;

administration of the check point - management of the airport (airfield), river port, railway station, automobile check point to which this check point is assigned;

state control bodies - bodies boundary, customs, sanitary and quarantine, veterinary, phytosanitary and other types of control participating in the omission through Frontier of the Republic of Uzbekistan of persons, vehicles, goods, other property animal, seed, landing material and other products of animal and phytogenesis.

3. Check points open for the purpose of:

ensuring accomplishment of international treaties and regulatory legal acts of the Republic of Uzbekistan;

creating favorable conditions for development of the message between the Republic of Uzbekistan and foreign states;

identification and suppression of illegal migration, arms trafficking, drugs of their analogs, psychotropic substances, precursors and taking measures to prevention of epidemics and epizooty;

ensuring control and accounting behind crossing of Frontier of the Republic of Uzbekistan by persons, vehicles and movement of goods, other property, animal, seed, landing material and other products of animal and phytogenesis;

creations of necessary conditions for work of state control bodies, and also transport organizations and places of acceptance, authorized banks;

safety, economic and political interests of the Republic of Uzbekistan, and also creation of conditions for increase in transit potential, handling capacity of check points according to the current and perspective demands of economic development of the Republic of Uzbekistan.

4. The check point includes complex of buildings, rooms, constructions and other places with the corresponding processing equipment in which state control bodies, and also transport and other organizations providing proper functioning of the check point in accordance with the established procedure perform activities.

5. For ensuring control of observance of statutory rules of crossing of Frontier of the Republic of Uzbekistan by persons, vehicles and movement of goods, other property and animals by the relevant ministries and departments at check points activities of divisions boundary, customs, sanitary and quarantine, veterinary, phytosanitary and other types of control are organized.

6. Implementation by physical persons and legal entities at check points of the economic and other activity which is not connected with ensuring normal functioning of the check point and the omission of persons, vehicles, goods, other property, animal, seed, landing material and other products of animal and phytogenesis, is not allowed, except as specified, stipulated by the legislation the Republic of Uzbekistan.

II. Classification of check points

7. Check points are classified by category, the status and operating mode:

a) on category - road (pedestrian), railway, river and aviation;

b) according to the status:

international - perform the omission of persons, vehicles, goods, other property, animal, seed, landing material and other products of animal and phytogenesis of the Republic of Uzbekistan and other foreign states;

bilateral - perform the omission of persons, vehicles, goods, other property, animal, seed, landing material and other products of animal and phytogenesis of the Republic of Uzbekistan and the adjacent state;

simplified - perform the omission of citizens of the Republic of Uzbekistan and the adjacent state in pedestrian procedure. The operating procedure, the simplified check points, is established in coordination between boundary and customs departments of the Republic of Uzbekistan and the adjacent state;

c) on operating mode - round-the-clock and during daylight hours.

Time of the beginning and completion of work at check points with operating mode is established "during daylight hours" by structural divisions of boundary departments of the Republic of Uzbekistan and the adjacent state.

8. The procedure for the omission of persons, vehicles, goods, other property, animal, seed, landing material and other products of animal and phytogenesis, and also change of the operating mode, the status of the check point of the Republic of Uzbekistan located on automobile, railway and river tracks of the international message are regulated by bilateral international treaties of the Republic of Uzbekistan with the relevant states.
