Agreement between the Government of the Republic of Kazakhstan and Government of the Azerbaijan Republic on visa-free trips of citizens of the Republic of Kazakhstan and Azerbaijan Republic

The government of the Republic of Kazakhstan and the Government of the Azerbaijan Republic which are hereinafter referred to as by "Parties"

for the purpose of further development of friendship between the states, legal settlement of trips of their citizens

agreed as follows:

Article 1

Citizens of the state of one Party have the right to drive, leave and move on the territory of the state of other Party without visas with observance of rules of stay and the registration operating in this state according to the documents proving the identity and confirming nationality specified in Appendices 1 and 2 to this agreement.

Movement of citizens of the states of the Parties is performed through check points on frontiers of the Republic of Kazakhstan and the Azerbaijan Republic.

Article 2

The citizens of the Parties who are constantly living in the territory of the third states can drive, leave and follow through the territory of the states of the Parties without visas according to the documents specified in Appendices 1 and 2 to this agreement.

Article 3

The parties shall allow citizens of the states of the Parties into the third states through check points on frontier, open for the international passenger traffic, according to the documents valid for trip abroad and entry into the third state.

The parties will take measures to non-admission of departure from the territory of their states to the third states of persons which departure is limited to competent authorities of the either party. The parties will inform each other on current agreements with the third countries on procedure and the mode of mutual trips of citizens.

Article 4

The parties will inform without delay each other through diplomatic channels on new identity documents and nationality and to direct their samples, and also to inform on the changes concerning the documents specified in Appendices 1 and 2 to this agreement.

Article 5

Each of the Parties has the right fully or partially to suspend separate provisions of this agreement if it is necessary for safety of the state, preserving public order or public health care.

And about cancellation of such measures of the Party in 30 days shall inform each other on acceptance through diplomatic channels.

Article 6

The citizens of the states of the Parties who violated provisions of this agreement or rules of stay and registration for the territories of the states of the Parties are subject to return to the states of accessory according to the legislation of the Parties.

Numerous abuses of regulations of stay can entail responsibility according to the current legislation of the Parties.

Article 7

The parties will communicate and consult as required on the questions connected using provisions of this agreement.

The parties by mutual consent can make changes and additions to this agreement.

Article 8

This agreement becomes effective from the date of exchange of notes through diplomatic channels about accomplishment of the corresponding interstate procedures necessary for its introduction in force.

This agreement is signed for a period of five years. Its action is prolonged automatically for the following five-year term if any of the Parties does not declare by the written notice of its termination not later than six months before expiration of this agreement.

It is made in Almaty on June 10, 1997 in duplicate, everyone in the Kazakh, Azerbaijani and Russian languages, and all texts are equally authoritative. In case of discrepancies in interpretation of this agreement of the Party will be guided by the text in Russian.

Appendix 1

1. Passport of the citizen of the Republic of Kazakhstan.

2. Service passport.

3. Diplomatic passport.

4. The passport of the seaman (the identity document of the seaman, in the presence of the muster roll or the statement from it).

5. The certificate on return to the Republic of Kazakhstan (only for return to the Republic of Kazakhstan)
