About approval of the Regulations on procedure for conducting examination and issue of the conclusions under agreements (contracts) for delivery of main types of the textile equipment regarding compliance to its modern production requirements and level of the world prices

According to the resolution of the President of the Republic of Uzbekistan of February 4, 2016 "About additional measures for technical and technological modernization of the textile companies on the basis of implementation of modern technologies" the Cabinet of Ministers decides No. PP-2485:

1. Approve Regulations on procedure for conducting examination and issue of the conclusions under agreements (contracts) for delivery of main types of the textile equipment regarding compliance to its modern production requirements and level of the world prices according to appendix (further - the Provision).

2. Agree with the offer of the Agency on expert evaluation of feasibility statements on projects of again under construction and reconstructed production capacities, the equipment and technologies under the Cabinet of Ministers of the Republic of Uzbekistan (further - the Agency) and JSC Uzbekengilsanoat about conducting examination of agreements (contracts) regarding compliance, the acquired textile equipment to modern production requirements and level of the world prices by the following criteria:

novelty - determined by year of release (no more than two years at the time of conducting examination);

exportooriyentirovannost and product assortment - determined by its demand, first of all in the foreign markets;

performance - calculated as production volume of certain textile products for unit of time;

energy efficiency - determined by the comparative analysis of installed capacity of engines, the acquired textile equipment, according to their technical and technological parameters with the similar equipment of other producers;

parameters of the prices of the equipment - determined by the comparative analysis on the basis of comparison of the prices of the acquired textile equipment to the level of the world prices of the textile equipment having similar technical and technological parameters.

3. Confer the personal responsibility on heads:

The agencies - for timely conducting examination of agreements (contracts) regarding compliance to its modern production requirements and level of the world prices, issue of the conclusion according to the above-stated criteria and in the terms which are strictly established in the Provision;

JSC Uzbekengilsanoat - for consideration of agreements (contracts) regarding feasibility of acquisition of the textile equipment, assortment and the exportooriyentirovannost made on is mute products on the basis of the analysis of its demand in the foreign market;

The State Customs Committee of the Republic of Uzbekistan - for timely implementation of customs clearance, the imported textile equipment (the Commodity Nomenclatures of Foreign Economic Activity codes 8445, 8446, 8447), based on the conclusion of the Agency and non-admission of delivery to the republic unpromising, morally and physically obsolete textile equipment.

4. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R. S. Azimov.

Regulations on procedure for conducting examination and issue of the conclusions under agreements (contracts) for delivery of main types of the textile equipment regarding compliance to its modern production requirements and level of the world prices

I. General provisions

1. This Provision according to the resolution of the President of the Republic of Uzbekistan of February 4, 2016 No. PP-2485 "About additional measures for technical and technological modernization of the textile companies on the basis of implementation of modern technologies" determines procedure for conducting examination and issue of the conclusions by the Agency by expert evaluation of feasibility statements on projects of again under construction and reconstructed production capacities, the equipment and technologies under the Cabinet of Ministers of the Republic of Uzbekistan (further - the Agency) under agreements (contracts) for delivery of main types of the textile equipment regarding compliance to its modern production requirements and level of the world prices (further - the conclusion).

2. In the Agency agreements (contracts) providing delivery of main types of the textile equipment (processing cotton fiber and products from it) relating to group of the Commodity Nomenclatures of Foreign Economic Activity codes 8445, of 8446, 8447 are subject to examination (further - the agreement (contract)).

Agreements (contracts) and the supplementary agreements to them signed till March 1, 2016 on which payment is made and/or shipment of the textile equipment is performed, are not subject to examination in the Agency.

The supplementary agreements to agreements (contracts) which are subject to examination in the Agency providing change of technical parameters, costs of the acquired textile equipment and/or conditions of agreements (contracts) according to requirements of this provision are also subject to examination in the Agency

3. Examination of agreements (contracts) and supplementary agreements to them is performed according to the scheme according to appendix No. 1 to this Provision.

II. The documents submitted for conducting examination and receipt of the conclusion

4. For receipt of the conclusion the applicant submits the following documents to the Agency:

a) the statement in form according to appendix No. 2 to this Provision;

b) the original of the agreement (contract) and its copy (numbered, which are strung together, certified by seal and the authorized signature of the applicant under the agreement (contract) with detailed technical characteristics and specifications). The original of the agreement (contract) is subject to obligatory return to the applicant;

c) the competitive list or reasons for contractual pricing constituted based on comparison of the key technical and technological parameters (performance, energy efficiency) and parameters of the prices of the textile equipment, with appendix of the supporting documents existing for date of the conclusion of the agreement (contract) including the commercial offers, price lists or invoices approved by the sign and seal of the applicant.

At the same time all supporting documents shall contain postal addresses (locations) and contact details of the organizations which provided alternative offers
