About approval of the Program for aviation safety in the field of civil aviation

1. Approve the enclosed Program for aviation safety in the field of civil aviation.
2. This resolution becomes effective after ten calendar days after day of its first official publication.

1. This Program for aviation safety in the field of civil aviation (further - the Program) is developed according to requirements of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law), appendices 19 "Safety management of flights" to the Convention on international civil aviation (further - appendix 19) and Doc of 9859 ICAO "The control directive aviation safety" and:
1) is represented by single complex of the rules and actions directed to increase in level of aviation safety;
2) promotes effective realization of safety management system of flights of operators and civil aviation organizations and proper interaction with them;
3) provides monitoring and assessment of performance indicators of safety-of-life function;
Supports 4) and constantly improves nation-wide performance indicators of safety-of-life function.
The program provides coordination of activities and close interaction in the field of management of risk factors for aviation safety and safety-of-life function between authorized body in the field of civil aviation, authorized organization in the field of civil aviation and authority on investigation.
2. Main objectives of this Program are increase in level of aviation safety in the field of civil aviation of the Republic of Kazakhstan by means of the additional elements based on efficiency and assessment of risk factors for aviation safety and also contribution of effective realization of safety management systems of flights (further - SUBP) airline industry of the Republic of Kazakhstan.
3. Safety-of-life function in civil aviation is key priority of activities and the obligation of all subjects of the public relations connected with use of airspace.
4. In this Program the following basic concepts are used:
1) aviation incident - the aviation event connected with flight operation of the air vehicle which could create or created threat of integrity of the air vehicle and (or) life of the people who are on its board, but did not end with aviation incident;
2) aviation incident - the aviation event connected with flight operation of the air vehicle which led to death (to bodily harm from the death) of the people who were onboard the air vehicle and (or) loss of this air vehicle;
3) suppliers of servicing - the civil aviation organizations certified by authorized organization in the field of civil aviation (the physical person or legal entity which is engaged in operation of civil air vehicles or offering the services in this area);
4) operating personnel - the personnel of civil aviation organization connected with ensuring aviation activities and having opportunity to provide information on aviation safety;
5) safety of flight - the condition in case of which the risk of damnification of life or to human health, or drawings damage to property is reduced to acceptable level and is supported at this or more low level by means of continuous process of identification of sources of danger and control of risk factors;
6) safety management system of flights - system approach to safety management of flights, including organizational structure, hierarchy of responsibility, obligation, guidelines and procedures;
7) efficiency of safety-of-life function - the aviation safety level reached by the state or the supplier of servicing determined by the target objectives of efficiency of safety-of-life function and performance indicators of safety-of-life function established by them;
8) performance indicators of safety-of-life function - the aviation safety parameters based on actual data used for monitoring and efficiency evaluation of safety-of-life function;
9) the target objective of efficiency of safety-of-life function - the target objective planned or assumed by the state or the supplier of servicing for performance indicator of safety-of-life function for the set period reflecting the purposes in area of aviation safety;
10) risk for aviation safety - expected probability and gravity of effects or results of danger;
11) authorized body in the field of civil aviation - the central actuator performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation;
12) authorized organization in the field of civil aviation - the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, aviation safety and aviation safety;
13) authority on investigation - the structural division of authorized body in the field of civil aviation performing activities both responsible for the organization and conducting investigation of aviation incidents and incidents.
5. Use of airspace of the Republic of Kazakhstan and activities of civil aviation of the Republic of Kazakhstan are regulated by the Constitution of the Republic of Kazakhstan, the Law and other regulatory legal acts of the Republic of Kazakhstan in the field of civil aviation, and also the standards and recommended practice of International Civil Aviation Organization (further - ICAO) applied in the territory of the Republic of Kazakhstan.
6. The law provides access to the aviation inspectors of authorized organization in the field of civil aviation performing functions of control of safety-of-life function to air vehicles, productive activity, means and services, personnel and the corresponding accounting documentation, when applicable, of persons and the organizations performing aviation activities.
