About approval of criteria for evaluation of risk degree and checking sheets in the field of veterinary science
According to Items 5 and 6 of Article 141 and Item 1 of article 143 of the Entrepreneurial code of the Republic of Kazakhstan PRIKAZYVAYEM:
1. Approve:
1) criteria for evaluation of risk degree in the field of veterinary science according to appendix 1 to this joint order;
2) checking leaf in the field of veterinary science concerning the subjects performing activities for cultivation of cattle (from 1000 and more conditional heads) according to appendix 2 to this joint order;
3) checking leaf in the field of veterinary science concerning the subjects performing activities for cultivation of small cattle (from 1000 and more conditional heads) according to appendix 3 to this joint order;
4) checking leaf in the field of veterinary science concerning the subjects performing activities for cultivation of birds (from 1000 and more conditional heads) according to appendix 4 to this joint order;
5) checking leaf in the field of veterinary science concerning the subjects performing activities for cultivation of pigs (from 1000 and more conditional heads) according to appendix 5 to this joint order;
6) checking leaf in the field of veterinary science concerning the subjects performing activities for cultivation of farm animals (less than 1000 conditional heads) according to appendix 6 to this joint order;
7) checking leaf in the field of veterinary science concerning the subjects performing procurement and conversion of fish and fish products according to appendix 7 to this joint order;
8) checking leaf in the field of veterinary science concerning the laboratories of veterinary and sanitary examination performing activities for conducting veterinary and sanitary examination of products and raw materials of animal origin according to appendix 8 to this joint order;

44) checking leaf in the field of veterinary science concerning the subjects performing activities for production of medicines of veterinary assignment according to appendix 44 to this joint order.
2. To provide to department of veterinary and food safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:
1) the state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after the state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;
3) placement of this joint order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies.
3. Declare invalid the joint order of the Minister of Agriculture of the Republic of Kazakhstan of June 30, 2011 No. 18-02/366 and the deputy. The Minister of Economic Development and Trade of the Republic of Kazakhstan of August 2, 2011 No. 228 "About approval of forms of checking sheets and criteria for evaluation of degree of risks in the field of private entrepreneurship in the field of veterinary science" (No. registered in the Register of the state registration of regulatory legal acts 7152, No. 294-295 published on September 14, 2011 (26685-26686), on September 15, 2011 No. 296-297 (26687-26688) in the Kazakhstanskaya Pravda newspaper).
4. To impose control of execution of this joint order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.
5. This joint order becomes effective after ten calendar days after day of its first official publication.

Appendix 1
to the joint Order of the Minister of Agriculture of the Republic of Kazakhstan and the Minister of national economy of the Republic of Kazakhstan of December 25, 2015 No. 7-1/1130, 28 of December, 2015 No. 802
1. These Criteria for evaluation of risk degree in the field of veterinary science (further – Criteria) are developed according to Item 5 of article 141 of the Entrepreneurial code of the Republic of Kazakhstan (further – the Code), Rules of forming by the regulatory state agencies of system of assessment and risk management approved by the order of the acting minister of national economy of the Republic of Kazakhstan of June 22, 2022 No. 48 (it is registered in the Register of the state registration of regulatory legal acts No. 28577), and the order of the acting minister of national economy of the Republic of Kazakhstan of July 31, 2018 No. 3 "About approval of form of checking leaf" (it is registered in the Register of the state registration of regulatory legal acts No. 17371), for reference of subjects (objects) of control and supervision in the field of veterinary science to risk degrees and selection of subjects (objects) of control and supervision when conducting checks on compliance to qualification requirements according to the granted licenses, allowing requirements for the issued permissions and requirements for directed notifications according to the Law of the Republic of Kazakhstan "About permissions and notifications" (further – check on compliance to requirements), and preventive control with visit of subject (object) of control and supervision.
2. In these Criteria the following concepts are used:
1) point – quantitative measure of calculation of risk;
2) normalization of data – the statistical procedure providing reduction of the values measured in different scales to conditionally general scale;
3) subjects (objects) of control and supervision – the state veterinary organizations created by local executive bodies of areas, cities of republican value, the capital, the physical persons and legal entities performing business activity in the field of veterinary science, the physical persons and legal entities using the objects which are subject to the state veterinary health control and supervision, including performing the activities connected with production, procurement (slaughter), storage, use, conversion and realization of animals, products and raw materials of animal origin, veterinary medicines, forages and feed additives, the veterinarians of divisions of production supervision by determination of compliance of animals, products and raw materials of animal origin to veterinary standard rates performing issue of the veterinary reference;
4) insignificant violation – violation of the requirements established by the legislation of the Republic of Kazakhstan in the field of veterinary science to placement, completing, movement of animals, products and raw materials of animal origin on objects of production, performing cultivation of animals, procurement (slaughter), storage, conversion and realization of animals, products and raw materials of animal origin, and also the violations which are not referred to gross and considerable violations;
5) considerable violation – violation of the requirements established by the legislation of the Republic of Kazakhstan in the field of veterinary science to availability of rooms on objects of production, performing cultivation of animals, procurement (slaughter), storage, conversion and realization of animals, products and raw materials of animal origin and also in the organizations for storage and realization of veterinary medicines, forages and feed additives; to receipt (acceptance), production (production), storage, realization, utilization, destruction of subjects to the state veterinary health control and supervision; to holding veterinary actions; to accomplishment of function in the field of veterinary science; to violation of terms and completeness of providing veterinary accounting and reporting, accounting of veterinary documents;
6) gross violation – violation of the requirements established by the legislation of the Republic of Kazakhstan in the field of veterinary science, attracting administrative responsibility provided by the Code of the Republic of Kazakhstan "About administrative offenses", non-compliance with requirements for ensuring veterinary and sanitary safety, the attracting poisoning of people and animals, and also non-compliance with requirements to material equipment, sampling, not conducting veterinary accounting and the reporting, not carrying out identification of farm animals, availability of claims and addresses, and also violation of requirements of the Eurasian Economic Union in the field of veterinary science;
7) risk – probability of damnification as a result of activities of the subject of control and supervision of life or to health of the person, the environment, legitimate interests of physical persons and legal entities, valuable interests of the state taking into account severity of its effects;
8) criteria for evaluation of risk degree – set of the quantitative and qualitative indexes connected with direct activities of the subject of control and the supervision, the features of industry development and factors influencing this development, allowing to carry subjects (objects) of control and supervision to different risk degrees;
9) objective criteria for evaluation of risk degree (further – objective criteria) – the criteria for evaluation of risk degree used for selection of subjects (objects) of control and supervision depending on risk degree in certain field of activity and which are not depending directly on separate subject (object) of control and supervision;
10) subjective criteria for evaluation of risk degree (further – subjective criteria) – the criteria for evaluation of risk degree used for selection of subjects (objects) of control and supervision depending on results of activities of specific subject (object) of control and supervision;
11) system of assessment and risk management – process of acceptance of the management decisions directed to decrease in probability of approach of adverse factors by distribution of subjects (objects) of control and supervision on risk degrees for the subsequent implementation of preventive control with visit of subject (object) of control and supervision and (or) checks on compliance to requirements for the purpose of minimum possible extent of restriction of freedom of enterprise, providing at the same time admissible risk level in the corresponding fields of activity, and also directed to change of risk level for specific subject (object) of control and supervision and (or) release of such subject (object) of control and supervision from preventive control with visit of subject (object) of control and supervision and (or) checks on compliance to requirements;
12) sample (selection) – the list of the evaluated subjects (objects) carried to homogeneous group of subjects (objects) of control in the specific sphere of the state control according to Item 2 of article 143 of the Code.
3. For risk management objectives when implementing preventive control with visit of subject (object) of control and supervision and (or) check on compliance to requirements, criteria for evaluation of risk degree for conducting check on compliance to requirements and preventive control of subjects (objects) of control and supervision are created by means of determination of objective and subjective criteria which are performed step by step (the multicriteria analysis of decisions).
At the first stage by objective criteria subjects (objects) of control and supervision belong to one of the following risk degrees:
1) high risk;
2) average risk;
3) low risk.
Concerning subjects (objects) of control and supervision carried to high and average risk degrees are carried out check on compliance to requirements, preventive control with visit of subject (object) of control and supervision, preventive control without visit of subject (object) of control and supervision and unscheduled inspection.
Concerning subjects (objects) of control and supervision carried to low risk degree are carried out check on compliance to requirements, preventive control without visit of subject (object) of control and supervision and unscheduled inspection.
4. At the second stage by subjective criteria subjects (objects) of control and supervision belong to one of the following risk degrees:
1) high risk;
2) average risk;
3) low risk.
On risk exponents by subjective criteria the subject (object) of control and supervision belongs:
1) to high risk – in case of exponent of risk from 71 to 100 inclusive;
2) to average risk degree – in case of exponent of risk from 31 to 70 inclusive;
3) to low risk degree – in case of exponent of risk from 0 to 30 inclusive.
5. Depending on possible risk and the importance of problem, singularity or systemacity of violation, the analysis of the decisions made earlier on each source of information requirements imposed to activities of subjects (objects) of control correspond to extent of violation – rough, considerable and insignificant.
Extents of violations of requirements to subjects (objects) of control and supervision in the field of veterinary science are determined according to appendix 1 to these Criteria.
Criteria for evaluation of risk degree for conducting check on compliance to requirements and preventive control of subjects (objects) of control and supervision are created by means of determination of objective and subjective criteria.
6. Determination of objective criteria in the field of veterinary science to subjects (objects) of control and supervision is performed by means of risk identification whenever possible of approach of adverse incident for life or to health of the person, the environment, legitimate interests of physical persons and legal entities, the states.
7. By objective criteria to high risk treat subjects (objects) of control and supervision:
1) the subjects performing activities for cultivation of cattle (from 1000 and more conditional heads);
2) the subjects performing activities for cultivation of small cattle (from 1000 and more conditional heads);
3) the subjects performing activities for cultivation of birds (from 1000 and more conditional heads);
4) the subjects performing activities for cultivation of pigs (from 1000 and more conditional heads);
5) the subjects performing activities for cultivation of farm animals (less than 1000 conditional heads);
6) the subjects performing procurement and conversion of fish and fish products;
7) the laboratories of veterinary and sanitary examination performing activities for conducting veterinary and sanitary examination of products and raw materials of animal origin;
8) the subjects performing conversion of meat, products and raw materials of animal origin;
9) the subjects performing slaughter of animals;
10) the subjects performing milk conversion;
11) the subjects performing activities for production of medicines of veterinary assignment.
8. By objective criteria to average risk degree treat subjects (objects) of control and supervision:
1) the subjects performing activities for production of forages and feed additives;
2) the state veterinary organizations created by local executive bodies of areas, cities of republican value, the capital;
3) the subjects performing activities for production of honey and products of beekeeping.
9. By objective criteria to low risk degrees belong to subjects (objects) of control and supervision:
1) the subjects performing veterinary treatment-and-prophylactic activities;
2) the subjects performing storage of products and raw materials of animal origin;
3) the subjects performing activities for content and animal husbandry in the scientific purposes;
4) the subjects performing activities for storage and realization of forages and feed additives;
5) zoos, circuses and pet-shops;
6) the subjects performing activities for carrying out disinfection, disinsection, deratization and deworming;
7) the subjects enabling the realization of medicines for the veterinary purposes, biological medicines, products and attributes of veterinary and zoohygienic assignment;
8) the subjects performing production of the veterinary medicines used as means of perfumery or cosmetics for animals;
9) the veterinarians of divisions of production supervision by determination of compliance of animals, products and raw materials of animal origin to veterinary standard rates performing issue of the veterinary reference.
10. Determination of subjective criteria is performed using the following stages:
1) forming of the database and information collection;
2) information analysis and risks assessment.
11. Forming of the database and information collection are necessary for identification of subjects (objects) of control and supervision.
For risk degree assessment by subjective criteria for carrying out preventive control with visit of subject (object) of control and supervision the following sources of information are used:
1) results of monitoring of the reporting and the data represented by the subject of control and supervision;
2) results of the previous checks and preventive control with visit of subjects (objects) of control and supervision;
3) analysis results of the data represented by state bodies and the organizations;
4) results of preventive control without visit of subject (object) of control and supervision (the resulting documents issued following the results of preventive control without visit of subject (object) of control and supervision).
For assessment of degree of risks by subjective criteria for conducting check on compliance to requirements the following sources of information are used:
1) results of the previous checks concerning subjects of control and supervision;
2) analysis results of the data represented by state bodies and the organizations.
12. Based on the available sources of information the data on subjective criteria which are subject to the analysis and assessment are created.
The analysis and assessment of subjective criteria allows to concentrate conducting check on compliance to requirements and preventive control of subject (object) of control and supervision concerning subject (object) of control and supervision with the greatest potential risk.
At the same time in the analysis and assessment the data of subjective criteria which are earlier considered and used concerning specific subject (object) of control and supervision or data according to which the term of limitation period according to Item 1 of Article 178 of the Civil code of the Republic of Kazakhstan expired are not applied.
Concerning the subjects of control and supervision which eliminated in full the issued violations following the results of the carried-out previous preventive control with visit and (or) checks on compliance to requirements their inclusion when forming schedules and lists for the next period of the state control is not allowed.
13. Proceeding from priority of the applied sources of information and the importance of indicators of subjective criteria, according to risk exponent procedure of payments by the subjective criteria determined in Chapter of 3 these Criteria the risk exponent by subjective criteria on scale from 0 to 100 points is calculated.
Priority of the applied sources of information and the importance of indicators of subjective criteria are established according to the list of subjective criteria for determination of risk degree by subjective criteria in the field of veterinary science according to appendix 2 to these Criteria.
14. For the purpose of realization of the principle of encouragement of fair subjects of control and supervision and concentration of control and supervision on violators subjects (objects) of control and supervision are exempted from carrying out preventive control with visit of subject (object) of control and supervision and (or) check on compliance to requirements of the period determined by Items 22 and 23 of these Criteria by means of use of subjective criteria.
15. Subjects (objects) of control and supervision by subjective criteria are transferred using information system from high risk in average risk degree or from average risk degree in low risk degree in the field of veterinary science of subjects of control and supervision in cases if in the laws of the Republic of Kazakhstan and in these Criteria cases of release from preventive control with visit of subject (object) of control and supervision or conducting checks on compliance to requirements are determined.
16. The system of assessment and risk management is conducted with use of the information systems carrying subjects (objects) of control and supervision to specific risk degrees and creating schedules or lists of holding control actions and also is based on the state statistics, results of departmental statistical observation, and also information tools.
In the absence of information system of assessment and risk management minimum admissible threshold of amount of subjects (objects) of control and supervision concerning which are performed preventive control with visit of subject (object) of control and supervision and (or) check on compliance to requirements shall not exceed five percent from total quantity of such subjects of control in the field of veterinary science.
17. To risk degree according to Item 3 and 4 of the presents the Criterion is applied to reference of the subject of control the following procedure of payments of exponent of risk.
The state body collects information and creates the database on subjective criteria of sources according to Item of 11 these Criteria.
18. Measure calculation of risk degree by subjective criteria (R) is perfromed in the automated mode by summing of exponent of risk on violations by results of the previous checks and preventive control with visit of subjects (objects) of control and supervision (SP) and exponent of risk by subjective criteria (SC) determined according to Item of 13 these Criteria with the subsequent normalization of the values this in the range from 0 to 100 points.
Rprom = SP + SC,
where:
Rprom – intermediate exponent of risk by subjective criteria,
SP – risk exponent on violations,
SC – risk exponent by the subjective criteria determined according to Item of 13 these Criteria.
Calculation is made on each subject (object) of control and supervision of homogeneous group of subjects (objects) of control and supervision in the field of veterinary science. At the same time the list of the evaluated subjects (objects) of control and supervision carried to homogeneous group of subjects (objects) of control and supervision of one sphere of the state control and supervision forms sample (selection) for the subsequent normalization of data.
19. According to the data obtained by results of the previous checks and preventive control with visit of subjects (objects) of control and supervision the risk exponent on violations evaluated in points from 0 to 100 is created.
In case of identification of one gross violation on any of the sources of information specified in Item of 11 these Criteria, the subject of control and supervision the exponent of risk of 100 points is equated and concerning it it is performed on compliance to requirements or preventive control with visit of subject (object) of control and supervision.
In case of not identification of gross violations the risk exponent on violations is calculated total indicator on violations of considerable and insignificant degree.
In case of measure definition of considerable violations 0,7 coefficient is applied. This indicator is calculated by the following formula:
SRZ = (SP2 x 100/SP1) x 0,7,
where:
SRZ – indicator of considerable violations;
SP1 – the required number of considerable violations;
SP2 – the number of the revealed considerable violations.
In case of measure definition of insignificant violations 0,3 coefficient is applied. This indicator is calculated by the following formula:
SRN = (SP2 x 100/SP1) x 0,3,
where:
SRN – indicator of insignificant violations;
SP1 – the required number of insignificant violations;
SP2 – the number of the revealed insignificant violations.
The risk exponent on violations (SP) is calculated on scale from 0 to 100 points and is determined by summing of indicators of considerable and insignificant violations by the following formula:
SP = SRZ + SRN,
where:
SP – risk exponent on violations;
SRZ – indicator of considerable violations;
SRN – indicator of insignificant violations.
The received risk degree measure value on violations joins in measure calculation of risk degree by subjective criteria.
20. Measure calculation of risk degree by the subjective criteria determined according to Item of 13 these Criteria is made on scale from 0 to 100 points and performed on the following formula:
xi – indicator of subjective criterion;
wi – specific weight of indicator of subjective criterion of xi;
n – quantity of indicators.
The received risk degree measure value by the subjective criteria determined according to Item of 13 these Criteria joins in measure calculation of risk degree by subjective criteria.
21. The values calculated by subjects (objects) by indicator are normalized by R in the range from 0 to 100 points. Normalization of data is performed on each sample (selection) with use of the following formula:
R – risk exponent (final) by subjective criteria of separate subject (object) of control and supervision;
Rmax – the greatest possible value on risk degree scale by subjective criteria on subjects (objects) entering one sample (selection) (the upper bound of scale);
Rmin – minimum possible value on risk degree scale by subjective criteria on subjects (objects) entering one sample (selection) (the lower bound of scale);
Rprom – the intermediate exponent of risk by subjective criteria calculated according to Item of 18 these Criteria.
21-1. Treat the measures of rapid response applied within these Criteria:
1) prohibition of production, application and realization of the moved (transported) objects which are not conforming to requirements of the legislation of the Republic of Kazakhstan in the field of veterinary science, to the international treaties of the Republic of Kazakhstan and acts constituting the right of the Eurasian Economic Union;
2) suspension of action of the allowing document in the field of veterinary science;
3) prohibition of activities or separate types of activity according to the laws of the Republic of Kazakhstan;
4) suspension of operations or separate types of activity according to the laws of the Republic of Kazakhstan.
21-2.
