1. Approve the enclosed Rules of carrying out by National Bank of the Republic of Kazakhstan of transactions on converting and rekonvertation of foreign currency for clients.

2. To department of financial accounting and monitoring of financial transactions (Baymukanov Zh. S.) in the procedure established by the legislation to provide:

1) together with Legal support department (Sarsenov N. V.) state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of this resolution in the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan":

on official publication in information system of law of Ad_let within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan;

for inclusion in the State register of regulatory legal acts of the Republic of Kazakhstan, Reference control bank of regulatory legal acts of the Republic of Kazakhstan within ten calendar days from the date of its obtaining by National Bank of the Republic of Kazakhstan after state registration in the Ministry of Justice of the Republic of Kazakhstan;

3) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication.

3. To department of the international relations and public relations (Kazybayev A. K.) provide the direction of this resolution on official publication in periodic printing editions within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan.

4. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Galiyeva D. T.

5. This resolution becomes effective after ten calendar days after day of its first official publication and extends to the relations which arose since February 1, 2016.

Rules of carrying out by National Bank of the Republic of Kazakhstan of transactions on converting and rekonvertation of foreign currency for clients

1. General provisions

1. These rules of carrying out by National Bank of the Republic of Kazakhstan of transactions on converting and rekonvertation of foreign currency (further - Rules) are developed for clients according to the Law of the Republic of Kazakhstan of March 30, 1995 "About National Bank of the Republic of Kazakhstan" and determine procedure for carrying out by National Bank of the Republic of Kazakhstan (further - National Bank) transactions by converting and rekonvertation of foreign currency for clients.

2. In Rules the following concepts are used:

1) settlement division - the division of National Bank serving bank accounts of clients;

2) converting of foreign currency - transaction of National Bank on sale to the client of foreign currency for tenge on the official rate of tenge to foreign currency established by National Bank on the date of carrying out transaction;

3) the request for converting and (or) rekonvertation of foreign currency - the document processed according to Rules submitted by the client to settlement division and containing specifying to make transaction on converting and (or) rekonvertation of foreign currency for the account and for the benefit of the client on the conditions determined by the request for converting and (or) rekonvertation of foreign currency;

4) the client - public institutions, the organizations of National Bank, the organization, fifty and more percent of shares (shares) of which belong to National Bank, the liquidation commissions of the liquidated banks of the second level of the Republic of Kazakhstan, the Single accumulation pension fund having the bank accounts in foreign currency opened in National Bank;

5) operational day - period of time during which the National Bank performs acceptance and payment processing and money transfers;

6) rekonvertation of foreign currency - transaction of National Bank on purchase from the client of foreign currency for tenge on the official rate of tenge to foreign currency established by National Bank on the date of carrying out transaction;

7) trade division - the division of National Bank performing purchase of foreign currency for implementation of transaction on converting of foreign currency.

2. Procedure for carrying out transactions by National Bank on converting and rekonvertation of foreign currency for clients

3. The settlement division performs converting of foreign currency for the transactions which are not connected with investing activities and requests the additional information from the client for refining of the purposes of the performed operations on converting of foreign currency.

5. The National Bank accepts from the client of the data on currency and the amount of the forthcoming converting according to the schedule of operational day.

6. After obtaining from the client of data on the amounts of the forthcoming converting of foreign currency the settlement division in case of insufficiency of foreign currency on line item of National Bank represents to trade division the summary warrant for purchase of foreign currency which is drawn up in form according to appendix 1 to Rules.

7. Transactions on converting and (or) rekonvertation of foreign currency are performed by settlement division based on the request of the client for converting of the foreign currency (purchase by the client of foreign currency for tenge) which is drawn up in form according to appendix 2 to Rules and (or) requests for rekonvertation of the foreign currency (sale by the client of foreign currency for tenge) which is drawn up in form according to appendix 3 to Rules.
