About Regulations on procedure for carrying out tender on replacement of vacant managerial positions of public service

According to article 18 of the Law of the Republic of Tajikistan "About public service" and article 51 of the Law of the Republic of Tajikistan "About regulatory legal acts" for the purpose of the organization of steady system of matching and placement of personnel of public service, I decide:

1. Approve Regulations on procedure for carrying out tender on replacement of vacant managerial positions of public service it (is applied).

2. To provide to the ministries and departments, local executive bodies of the government and self-government institutions of settlements and villages realization of this provision.

3. Declare invalid the Presidential decree of the Republic of Tajikistan of May 20, 2009, No. 659 "About approval of the Regulations on procedure for carrying out tender on replacement of vacant managerial positions of public service".

Regulations on procedure for carrying out tender on replacement of vacant managerial positions of public service

I. General provisions

1. The regulations on procedure for carrying out tender on replacement of vacant managerial positions of public service (further - the Provision) are developed for the purpose of implementation of article 18 of the Law of the Republic of Tajikistan "About public service" and regulate rules of carrying out tender on replacement of vacant managerial positions of public service.

2. Tender on replacement of vacant managerial positions of public service (further - competition) is held for ensuring equality of citizens of the Republic of Tajikistan (further - citizens) in case of revenues to public service, selection of highly qualified and capable personnel to public service and ensuring career development of government employees.

3. In tender have the right to participate the candidates conforming to qualification requirements of vacant managerial position of public service and this provision.

4. Appointment of administrative government employees to managerial positions of public service out of the competition with observance of qualification requirements is performed in the following cases:

- in case of appointment to the state positions of public service as orders, decrees or with the consent of the President of the Republic of Tajikistan, orders and the orders of the Government of the Republic of Tajikistan;

- for positions, appointment to which according to the legislation of the Republic of Tajikistan has bilateral feature (appointment in the written consent);

- for elective offices;

- in case of appointment based on the recommendation of certifying commission;

- in case of appointment from among the faces included in reserve of personnel of state body on replacement of higher position;

- when translating from one position for other equal vacant post or is one position lower category in the same state body in the written consent of the government employee;
