ORDER OF THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of medical and sanatorium support of employees and members of their families living together with them, pensioners of law enforcement agencies, and also children of employees, the dead on duty before achievement of age of majority by them, in the relevant state organizations of health care

According to the Law of the Republic of Kazakhstan "About law-enforcement service" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of medical and sanatorium attendance of employees and members of their families living together with them, pensioners of law enforcement agencies, and also children of employees, the dead on duty before achievement of age of majority by them, in the relevant state organizations of health care.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective after ten calendar days after day of its first official publication.

Rules of medical and sanatorium support of employees and members of their families living together with them, pensioners of law enforcement agencies, and also children of employees, the dead on duty before achievement of age of majority by them, in the relevant state organizations of health care

Chapter 1. General provisions

1. These rules of medical and sanatorium support of employees and members of their families living together with them, pensioners of law enforcement agencies, and also children of employees, the dead on duty before achievement of age of majority by them, in the relevant state organizations of health care (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About law-enforcement service" and determine procedure for medical and sanatorium support to the contingent.

Law enforcement officers, bodies of civil protection and the public courier service (further - employees), the members of their families living together with them, pensioners and children of staff of the specified bodies which died on duty before achievement of age of majority by them treat the contingent.

Pensioners of law enforcement agencies, bodies of civil protection treat pensioners (to whom the special ranks) and the public courier service (further - pensioners were given).

2. Medical care to separate employee categories which list affirms Administration of the President of the Republic of Kazakhstan in coordination with Administration of the President of the Republic of Kazakhstan appears in the medical organizations of Administration of the President of the Republic of Kazakhstan:

1) within the guaranteed amount of free medical care according to the Code of the Republic of Kazakhstan "About health of the people and health care system" (further – the Code);

2) in system of compulsory social medical insurance according to the Law of the Republic of Kazakhstan "About compulsory social medical insurance" (further – the Law);

3) at the expense of budgetary funds by types and in the amounts determined by Administration of the President of the Republic of Kazakhstan.

3. In Rules are understood as members of the family of employees: the spouse (spouse), joint or one of spouses the minor children (adopted, who are in dependence or under guardianship); the children (adopted, who are in dependence or under guardianship) and children of the spouse (spouse), students in the organizations of education for full-time courses, aged up to twenty three years; children with disability (adopted, being in dependence or under guardianship) and children with disability of the spouse (spouse) who establishes disability up to eighteen years; the parents and parents of the spouse (spouse) who are dependent on the employee.

For children of the employee, the dead on duty, before achievement of age of majority by them the right to medical and sanatorium support in the medical organizations of law-enforcement bodies remains.

4. Medical support of employees is performed in the medical organizations of law-enforcement bodies at the expense of budgetary funds.

In case of absence in the place of service or the residence of staff of the medical organizations of law-enforcement bodies or relevant departments in them of specialists or the special equipment on medical indications medical care to the employees appears subjects of health care:

1) within the guaranteed amount of free medical care according to the Code;

2) in system of compulsory social medical insurance according to the Law.

5. Fee of subjects of health care on delivery of health care to employees within the guaranteed amount of free medical care and in system of compulsory social medical insurance is performed by fund of social medical insurance.

Cost recovery of fund of social medical insurance on fee of subjects of health care on delivery of health care to employees within the guaranteed amount of free medical care and in system of compulsory social medical insurance is performed at the expense of the budgetary funds provided to authorized body in the field of health care.

6. Medical care is provided to the members of families of employees living together with them and also pensioners in the medical organizations of law-enforcement bodies.

Fee of the medical organizations of law-enforcement bodies for delivery of health care to members of families of employees and to pensioners is performed by fund of social medical insurance:

1) within the guaranteed amount of free medical care according to the Code;

2) in system of compulsory social medical insurance according to the Law.

7. According to article 135-1 of the Code and article 6 of the Law for receipt of medical care within the guaranteed amount of free medical care and in the system of compulsory social medical insurance which is not provided by the medical organizations of law-enforcement bodies, the contingent is attached to subjects of health care in the place of permanent or temporary residence taking into account the right of the free choice of the organization of primary health care.

Chapter 2. Health maintenance organization

8. The medical organizations of law-enforcement bodies render the following types of medical care:

1) out-patient and polyclinic help: primary health care and consulting and diagnostic help;

2) stationary help;

3) hospital-replacing help.
