ORDER OF THE MINISTER OF INTERNAL AFFAIRS OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of the organization of activities of the local police inspectors responsible for the organization of work of local police station, local police inspectors and their assistants

According to the subitem 30) the Item 16 "Regulations on the Ministry of Internal Affairs of the Republic of Kazakhstan" approved by the Order of the Government of the Republic of Kazakhstan No. 607 of June 22, 2005 I ORDER:

1. Approve the enclosed Rules of the organization of activities of the local police inspectors responsible for the organization of work of local police station, local police inspectors and their assistants.

2. To provide to the chairman of Committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan and chiefs of departments of police of areas, cities of republican value and the capital studying of this order by staff of law-enforcement bodies.

3. To committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

4) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

4. To impose control of execution of this order on the deputy minister of internal affairs of the Republic of Kazakhstan police major general Turgumbayev E. Z. and Committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.).

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the organization of activities of the local police inspectors responsible for the organization of work of local police station, local police inspectors and their assistants

Chapter 1. General provisions

1. These rules on the organization of activities of the local police inspectors responsible for the organization of work of local police station, local police inspectors and their assistants (further – Rules) the procedure for activities of local police inspectors responsible for the organization of work of local police station determines, local police inspectors (further – the local police inspector) and their assistants.

2. The administrative site - the territory of the city or rural zone to which (further - горрайорган) (person fulfilling its duties) the local police inspector is assigned by the order of the chief of city, district law-enforcement body. The sizes of border of the serviced administrative site, and the number of staff of local police station (further - UPP) it is determined by the chief of gorrayorgan. In the city area of UPP combines no more than 7 administrative sites, in rural on each settlement - one UPP.

3. To the administrative site the order of the chief of gorrayorgan (person fulfilling its duties) assigns sequence number. Acceptance of the administrative site by again appointed local police inspector is made with participation of the deputy chief of gorrayorgan or the chief of local police service (further - Ministry of Railways).

The purpose of acceptance of the administrative site is acquaintance of the local police inspector with borders and features of the administrative site, the developing operational situation on it, representation to his officials of bodies of local public administration and if necessary - to heads of the companies, organizations and organizations located on the site.

About the fact of acceptance and delivery of the administrative site the corresponding entry in the passport of the administrative site in form according to appendix 1 to Rules is made.

Borders of administrative sites affirm the chief of gorrayorgan (person fulfilling its duties) taking into account density and population, and also taking into account distance between settlements as the rural zone.

4. The local police inspector is the representative of territorial authority of internal affairs (further - Department of Internal Affairs) on the fixed administrative site, fulfilling duties assigned to it according to the legislation of the Republic of Kazakhstan.

5. The assistant to the local police inspector is the representative of territorial authority of internal affairs performing within the competence, the obligations assigned to it under direct management of the local police inspector who is in full allocated with the rights and obligations of the local police inspector, except for independent adoption of proceeding decisions on criminal offenses.

6. In the period of long absence (more than 5 working days) on service of the local police inspector (vacancy, leave, disease, business trip and so on), the administrative site is serviced by the local police inspector of the adjacent administrative site, according to the order of the chief of gorrayorgan (person fulfilling its duties).

Chapter 2. Procedure for the organization of work of UPP

7. UPP is official premises (building) of Department of Internal Affairs intended for the organization of activities of local police inspectors and their assistants, local police inspectors for the minor, other services of Department of Internal Affairs and citizens participating in ensuring public order on the fixed administrative site and also implementation of reception of citizens, delivery of offenders and the prevented persons.

8. UPP consists of studies for local police inspectors, their assistants from calculation of 7,5 of square meters on one employee, the room of reception of citizens and work with the public, the room for delivered, recreation rooms (separately), the bathroom.

8-1. UPP is in the separate building, and in case of placement in one building with the companies, the organizations or in apartment houses to have, separate entrance. At the same time, UPP, is located in the center of the administrative site (residential district).

8-2. Outside of UPP the sketch of the indicating panel of local police station in form according to appendix No. 1-1 to Rules, and also the sketch of the plate of working hours of local police station in form according to appendix No. 1-2 to Rules, about days and time of reception of citizens with indication of phones of local police station and control room of gorrayorgan is at the place, visible to the population.

8-3. Corridor (hall) of UPP are equipped with sketches of the stand:

1) legal information in form according to appendix No. 1-3 to Rules;

2) the information about local police inspectors in form according to appendix No. 1-4 to Rules;

3) the administrative site in form according to appendix No. 1-5 to Rules where borders of zone of servicing by local police inspectors are designated.

9. Content and material equipping of UPP and providing local police inspectors and their assistants is made at the expense of means of local budgets according to the current legislation.

Chapter 3. Procedure for the organization of work of the local police inspector and his assistant

10. The common directorship on the organization of activities of local police inspectors and their assistants is performed by the chief of gorrayorgan or his deputy.

11. Organizational and methodical providing and control of activities of local police inspectors are exercised by the Ministry of Internal Affairs, Departments of police of the capital, cities of republican value, areas and gorrayorgana which:

1) analyze condition, structure and dynamics of offenses in general, and also efficiency of the taken measures for their prevention and suppression;

2) is prepared in accordance with the established procedure in bodies of the representative and executive authority by information materials on problematic issues of activities of local police inspectors and their assistants, and also the offers following from the analysis of operational situation on enhancement of prevention of offenses;

3) perform interaction with bodies of local public administration, public associations and the religious organizations for prevention of offenses;

4) are brought in accordance with the established procedure in relevant organs and the organizations of idea of elimination of the reasons and conditions promoting making of offenses;

5) is prepared by methodical recommendations and reviews, and also drafts of the orders, instructions and other management decisions directed to enhancement of activities of local police inspectors and their assistants;
