1. Approve:
1) the List of productions, shops, professions and positions, the list of hard work, works with harmful and (or) dangerous working conditions in which work grants the right to the reduced duration of working hours, additional paid annual labor vacation and the increased amount of compensation, according to appendix 1 to this order;
2) Rules of provision of the reduced duration of working hours, additional paid annual labor vacation and the increased amount of compensation, according to appendix 2 to this order.
2. To provide to department of work and social partnership of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;
3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.
3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.
4. This order becomes effective since January 1, 2016 and is subject to official publication.

to the Order of the Minister of health and social development of the Republic of Kazakhstan of December 28, 2015 No. 1053
1. These rules of provision of the reduced duration of working hours, additional paid annual labor vacation and the increased amount of compensation (further - Rules) are developed according to the subitem 18) of Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 (further - the Labor code) and establish procedure for provision of the reduced duration of working hours, additional paid annual labor vacation and the increased amount of compensation.
2. The reduced duration of working hours, additional paid annual labor vacation (further - additional vacation) and the increased amount of compensation are provided to workers, experts and employees (further - workers) according to the List of productions, shops, professions and positions, the list of hard work, works with harmful and (or) dangerous working conditions in which work grants the right to the reduced duration of working hours, additional paid annual labor vacation and on the increased amount of compensation (further - the List) approved according to the subitem 18) of Article 16 of the Labor code.
3. Duration of the reduced working hours and additional vacation, the increased amount of compensation established by the List the employer changes on the basis of results of the certification of production facilities of the organizations which is carried out according to the Rules of obligatory periodic certification of production facilities under the terms of work approved according to the subitem 29) of Article 16 of the Labor code. The specific duration of the reduced working hours and additional vacation, the increased amount of compensation is established as the standard rate in the collective agreement and the employment contract.
4. In case of not carrying out certification by the employer under the terms of work of production facilities of the organization, the reduced duration of working hours and additional vacations, the increased amount of compensation are provided in full, provided in the List.
5. The reduced duration of working hours and additional vacation are provided to workers whose professions and positions are provided in the Section "General Professions of All Industries of Economy" of the List irrespective of in what productions or shops they work if these professions and positions are specially not provided in appropriate sections or subsections of the List.
6. To foremen, his assistants whose positions are provided in the List the reduced duration of working hours and additional vacation are provided to the same duration, as workers of the corresponding professions.
7. Control of correctness of application of the List is exercised by the state inspectors of work.
8. The reduced duration of working hours specified in the List is established to workers, only those days when they are engaged in harmful working conditions more than a half of the working day established for work of this production, the shop, profession or position.
