ORDER OF THE MINISTER OF HEALTH AND SOCIAL DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections

According to the subitem 30) Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 PRIKAZYVAYU:

1. Approve the enclosed Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections.

2. To provide to department of work and social partnership of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.

4. This order becomes effective since January 1, 2016 and is subject to official publication.

Rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections

Chapter 1. General provisions

1. These rules and terms of carrying out training, instructing and examinations on safety issues and labor protections of the workers, heads and persons responsible for safety and labor protections (further – Rules) are developed according to the subitem 30) of Article 16 of the Labor code of the Republic of Kazakhstan (further – the Code) and determine procedure and terms of carrying out training, instructing and examinations of the workers, heads and persons responsible for providing for safety issues and labor protections.

2. In these rules the following basic concepts are used:

1) special professional competences - the competences necessary for the heads and persons responsible for safety and labor protections of the organization for effective professional activity for safety and labor protections in certain industry;

2) territorial subdivision of authorized state body on work - the structural division of authorized state body on work performing within the corresponding administrative and territorial unit of power in the field of regulation of employment relationships according to the legislation of the Republic of Kazakhstan;

3) labor safety – the condition of security of workers provided with complex of the actions excluding impact of harmful and (or) dangerous production factors on workers in the course of labor activity;

4) general professional powers – the competences necessary for the heads and persons responsible for safety and labor protections of the organization for effective professional activity for safety and labor protections;

5) network technology – the technology including providing with educational and methodical materials, forms of interactive interaction of students with the teacher and with each other and also administration of educational process on the basis of use of the Internet;

6) safety regulations – the qualitative and quantitative indices characterizing conditions of production, production and labor process from the point of view of ensuring the organizational, technical, sanitary and hygienic, biological and other regulations, rules, procedures and criteria directed to preserving life and health of workers in the course of their labor activity;

7) distance training – the training performed in case of interaction of the teacher and students at distance including using information and communication technologies and telecommunication means;

8) competence - capability to apply the skills allowing to carry out one or several professional tasks constituting labor function;

9) multimedia - complex of the equipment rooms and software allowing the user to work with diverse data (graphics, the text, sound, video);

10) training center – the organization which is carrying out professional training, retraining and advanced training on questions on safety and labor protection at the leading and ranking officers;

11) the work permit – task for safe production of work and the determining content, place of employment, time of its beginning and the termination, condition of safe accomplishment, necessary security measures (including on radiation, fire safety and on gas-polluted workplaces), structure of crew and ranking officers.

Chapter 2. Procedure and terms of carrying out training and examination in the field of safety and labor protection of workers

3. Training and examination at workers on safety and labor protection is performed at least once a year.

4. Persons employed and also the workers transferred to other work are trained with the subsequent holding examination on safety issues and labor protections in the terms established by the employer, but no later than one month after execution of an employment agreement or transfer to other work.

The workers who did not undergo training and examination on safety and labor protections are not allowed to work.

When moving the worker of other workplace or to other structural division or the order of work on other mechanism or the aggregate within position, repeated training and examination on safety and labor protections is not required to specialty, profession, qualification.

5. The list of employees of the organization, the list of works and professions by which training is provided and also procedure and form of education are established by the employer, proceeding from nature of profession, work type, specifics of production and working conditions in coordination with employee representatives (in case of their availability).

6. The workers who are subject to examination on safety and labor protection are warned by the employer not later than one month prior to its carrying out.
