About approval of Rules of calls accounting of physical persons and legal entities

(as amended on 15-02-2021)

According to Item 2 of article 7 of the Law of the Republic of Kazakhstan of January 12, 2007 "About procedure for consideration of appeals of physical persons and legal entities", PRIKAZYVAYU:

1. Approve Rules of calls accounting of physical persons and legal entities according to appendix 1 to this order.

2. Recognize invalid some orders of the Attorney-General of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan (further - Committee):

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in information system of law of Ad_let and in periodic printing editions;

3) placement of the copy of this order on Internet resource of the Prosecutor General's Office of the Republic of Kazakhstan;

4) the direction of this order to the interested subjects of legal statistics and special accounting, structural divisions of the Prosecutor General's Office of the Republic of Kazakhstan for data and use in work, to territorial authorities of Committee for execution.

4. To impose control of execution of this order on the Chairman of Committee.

5. This order becomes effective after ten calendar days after day of its first official publication.

Appendix 1

to the Order of the Attorney-General of the Republic of Kazakhstan of January 18, 2015 No. 147

Rules of calls accounting of physical persons and legal entities

1. General provisions

1. These rules of calls accounting of physical persons and legal entities (further – Rules) are developed for the purpose of realization of Item 2 of article 7 of the Law of the Republic of Kazakhstan of January 12, 2007 "About procedure for consideration of appeals of physical persons and legal entities" (further – the Law) and determine accounting treatment for appeals of the physical persons and legal entities arriving in state bodies, local government bodies, legal entities with absolute participation of the state (further – subjects).

2. The appeal of physical person and legal entity is considered in the departmental automated information system of the subject or information system of Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan (further – Committee).

3. Accounting of the address is performed by filling of the respective fields in the electronic accounting form - the accounting card of the address of physical (legal) person (further - the accounting card of the address) in form, according to appendix 1 to these rules, or the departmental information accounting form which includes data of the accounting card of addresses, and also reflections of these data in the state legal reporting.

2. Procedure for acceptance and calls accounting

4. Each arrived address is subject to registration by fixing in the accounting card of the address or the departmental information accounting form of short data on contents of the address and assignment of registration number.

Registration number of the address is assigned automatically in end-to-end procedure.

Registration number of the appeal of physical person consists of the alphabetic FL index, initial letter of surname of the author and sequence number in the accounting card of the address.

Registration number of the address of the legal entity consists of the "YUL" alphabetic index, initial letter of surname of the official who signed the appeal and sequence number in the accounting card of the address.

Registration number of the anonymous address consists of the alphabetic AN index and sequence number in the accounting card of the address.

Registration number of the collective address consists of the alphabetic KL index and sequence number in the accounting card of the address.

5. Before registration of the address check on AIS is performed and established whether the address is repeated or the duplicate (copy) of the previous address.

In case of registration of the repeated address or duplicate (copy) of the address registration number of the first address, with indication of frequency is assigned to it (1, 2, 3) or the duplicate (copy) through virgule (fraction) (/1/2/3).

In case of receipt of the address with the petition for the termination of consideration of the address, it after registration joins the basic, with the corresponding mark in detail 24 "The petition for the termination" accounting cards of the address arrived.

6. Registration of the address is performed in day of its acceptance (receipt) according to requirements of items 4 and 5 these rules.

7. To the physical person or the representative of the legal entity who directly in writing addressed the subject, the coupon in form, according to appendix 2 to these rules is issued.

8. In unique number of the coupon the first couple designates year of registration of the address, by the second couple - area code (the city of republican value, the capital), the third couple – area code (the cities of regional value, the city of district value), the fourth couple – code of the rural district. The code of the subject and sequence number of the coupon consist of five figures.

9. The code of the subject is used from the reference book of subjects of the automated information system "Single Calls Accounting of Persons" (further – AIS EUOL).

10. In case of receipt of the address the registered mail through Kazpochta Joint-stock company in detail 7 "Unique number" of the accounting card of the address the subject brings 13-unit shaped the post identifier appropriated in department of mail service and adds to it 55555 symbols.

11. In case of the direction of the address for consideration unique number of this address which, in turn, is reflected in the accounting card of the address of the subject who received the address is specified to other subject according to Item 6 of article 7 of the Law in the cover letter.

12. Unique number is assigned only once, in case of primary registration of the address.

13. Are not subject to accounting according to the Law:

1) addresses concerning rendering the state services, except for the addresses provided by the subitem 3) of Item 1 of article 4 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services";

2) addresses which procedure for consideration is established by the legislation on administrative offenses, the criminal procedure, civil procedural legislation of the Republic of Kazakhstan.

14. In case of statement in the address of several questions among which there are questions which consideration is not included into competence of the subject this address is registered and allowed to them, according to the powers in terms, the stipulated in Clause 8 Laws.

At the same time, for consideration of other questions which permission does not enter its competence the copy of the address goes on competence to other subject, the official according to Item 6 of article 7 of the Law, with the obligatory notification about it the applicant.

This address is considered by the subject as considered.

15. By consideration of the address by several subjects the accounting card of the address is exposed to those by subject which directly gives the answer to the applicant. At the same time the subject (reducing) registers the address in the automated Address of Citizens base, other subjects collaborators register the address in the automated Office Correspondence base.

16. The accounting card of the address is filled in according to rekvizitny structure.

At the same time:

in detail 7: the social status of the addressed person if about it in the address there are data, is specified in the Reference book of status codes of the addressed person, according to appendix 3 to these rules;

in detail 12: the reason of frequency of the address (it is filled in case of receipt of the repeated address) is specified in the Reference book of reason codes of repeated addresses, according to appendix 4 to these rules;

in detail 14: the code of type of the address is specified, according to appendix 5 to these rules if address type – request, then availability the IIN/bin in detail 6 is necessary;

in detail 18 final date of completion date of the address is specified, automatically the program establishes term thirty calendar days if other term is provided, then other completion date is established. In case of prolongation of term of consideration of the address it is necessary to replace completion date with prolonged term, however in this detail internal control terms are not specified;

in detail 27 data and the made decision according to the address are entered, the decision code according to the address is specified according to the Reference book of codes of the taken measures for addresses, according to appendix 6 to these rules.

3. Procedure for provision by subjects of accounting data on appeals of physical persons and legal entities

17. Subjects provide in Committee and its territorial authorities, accounting data on appeals of physical persons and legal entities, and also on the addresses registered earlier on which decisions, daily by unloading of data from departmental information systems of the subject or information system of Committee were made.

18. The official of the subject provides timeliness, completeness, reliability of registration and introduction of accounting data of the address, reliability, completeness and timeliness of provision of accounting data on appeals of physical persons and legal entities to Committee and its territorial authorities.

4. Procedure for report generation "About consideration of appeals of physical persons and legal entities"

19. The report of form No. 1-OL "About consideration of appeals of physical persons and legal entities" on the republic (further – the Summary report) in form, according to appendix 7 to these rules is created in the automated mode in central office of Committee based on the data which arrived in AIS EUOL from subjects.

The summary report is created monthly the 10th following the accounting period and signed by the Chairman of Committee.

20. The summary report is provided by Committee in the Prosecutor General's Office of the Republic of Kazakhstan to the 12th, following the accounting period.

21. Duplicates (copies) of addresses and the petition for the termination of consideration of the address, the addresses registered in the Book of Accounting of Information (BAI) and the Unified Register of Pre-judicial Investigations (URPJI) are not subject to reflection in the report.

22. For the purpose of ensuring reliability and completeness of the data which arrived together with subjects monthly with 1 on 5 number carry out reconciliations about the number of the arrived addresses and results of their consideration to AIS EUOL, Committee and its territorial authorities.

After carrying out reconciliations by subjects of change are not brought in the data which are the basis for report generation.
