1. Approve the enclosed rules of cost determination of works on conducting complex non-departmental examination of construction projects of objects, and also complex town-planning examination of projects of town-planning planning of the territories of different level;

2. Declare invalid the order of the Minister of national economy of the Republic of Kazakhstan of February 28, 2015 No. 167 "About price approval on carrying out expert works on complex non-departmental examination of the construction projects which are carried out by the state expert organization, irrespective of financing source" (registered in the Register of state registration of regulatory legal acts for No. 88389, published in information system of law of Ad_let on April 21, 2015).

3. To provide to committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of cost determination of works on conducting complex non-departmental examination of construction projects of objects, and also complex town-planning examination of projects of town-planning planning of the territories of different level (further - Rules) are developed according to subitem 23-18) of article 20 of the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan".

2. Rules determine procedure for cost determination of works on carrying out:

1) complex non-departmental examination of construction projects of objects (feasibility statements and design estimates);

2) complex town-planning examination on projects of town-planning development planning and the building of the territories performed by commissions of experts or expert groups.

3. The cost of the expert works performed by the accredited expert organizations with participation of industry examinations is established according to the contract between the customer and the expert organization.

Under the agreements which are carried out within public procurements, the cost of expert works cannot be lower than the cost established according to these rules.

4. The procedure and duration (terms) of conducting complex non-departmental examination of the feasibility statement on construction, and also the design estimates for construction are determined by the Rules of conducting complex non-departmental examination of the feasibility statements and the design estimates intended for construction new, and also changes (reconstruction, expansions, modernization, upgrade and major repair) the existing buildings and constructions, their complexes, engineering and transport communications irrespective of financing sources, approved by the order of the Minister of national economy of the Republic of Kazakhstan of April 1, 2015 No. 299 (it is registered in the Register of state registration of regulatory legal acts for No. 10722) and are single for all subjects of expert activities in the field of designing of construction objects.

Chapter 2. Procedure for cost determination of works on complex non-departmental examination

5. The cost of conducting complex non-departmental examination of construction projects of objects is established on formula:

MRPP - value of monthly settlement indicator for date of cost determination of project works;

If under the agreement and the customer's task only part of Sections and works of the design estimates, from project cost or the working project is subject to examination, in case of its substitution in formula of Item 5 of these rules, the cost of those Sections or works of the project which are not subject to examination is excluded.
