ORDER OF THE MINISTER OF NATIONAL ECONOMY OF THE REPUBLIC OF KAZAKHSTAN

About approval of criteria for evaluation of risk degree and checking leaf in the sphere of management of housing stock

According to Item 3 of Article 141, Item 1 of article 143 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015, PRIKAZYVAYU:

1. Approve:

1) criteria for evaluation of risk degree in the sphere of management of housing stock, according to appendix 1 to this order;

2) checking leaf in the sphere of management of housing stock, in form according to appendix 2 to this order.

2. To provide to committee on cases of construction, housing and communal services and management of land resources of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. Declare invalid the order of the Minister of national economy of the Republic of Kazakhstan "About approval of criteria for evaluation of risk degree and form of checking leaf in the sphere of management of housing stock" of June 23, 2015 No. 447 (registered in the Register of state registration of regulatory legal acts for No. 11750, published in information system of law of Ad_let of August 17, 2015).

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Criteria for evaluation of risk degree in the sphere of management of housing stock

1. General provisions

1. These Criteria for evaluation of risk degree in the sphere of management of housing stock (further – Criteria) are developed according to Item 3 of article 141 of the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 for reference of the checked subjects in the sphere of management of housing stock (further – the checked subjects) to risk degree for carrying out selective checks.

2. In these Criteria the following concepts are used:

1) criteria for evaluation of risk degree – set of the quantitative and qualitative indexes connected with direct activities of the checked subject, the features of industry development and factors influencing this development, the checked subjects allowing to carry to various risk degrees;

2) the checked subjects – governing bodies of objects of condominium behind which activities the state control is exercised;

3) risk in the sphere of management of housing stock – probability of deterioration in technical condition of common property of objects of condominium, premature depreciation of their elements leading to decrease in durability of designs and safety of work of engineering systems of objects of condominium (apartment houses), to emergence of accidents as a result of violation of requirements and regulations of operation and content of housing stock.

4) gross violation in the sphere of management of housing stock – the violation characterized by availability of two and more confirmed claims from physical or legal entities;

5) considerable violations in the sphere of management of housing stock – the violations of requirements of the housing legislation expressed in lack of registration of objects of condominium in judicial authorities, the savings and current account on each object of condominium in bank of the second level, expense budget on content of common property of object of condominium approved by the protocol of meeting of members of cooperative of owners of rooms (apartments), contracts with the subject of service activities of the meeting of owners of rooms (apartments) approved by the legal decision, in non-compliance by governing body of object with condominium of terms of submission of the quarterly report on management of object of condominium, available defects in systems of central heating, water supply, water disposal, electric utility service of common property of condominium, unexecuted instructions on elimination of abuses of regulations of content of common property of object of condominium, or the violation characterized by availability of one confirmed claim from physical or legal entities;

6) insignificant violations in the sphere of management of housing stock – the violations of requirements of the housing legislation expressed in lack of the agreement of management of object of the condominium corresponding to standard form of the agreement of management of object of condominium, supporting documents of carrying out planned surveys of technical condition of designs and the engineering equipment of object of condominium, supporting documents of performance of works on the disinfection, disinsection and deratization of basements and other places public of object of condominium approved with housing inspectorate of expense budget on carrying out the separate types of capital repairs of common property of object of condominium financed with participation of the housing help (in the presence of the legal decision of meeting of owners of rooms (apartments) on carrying out the capital repairs financed with participation of the housing help), non-compliance with terms of office of board of cooperative of owners of rooms (apartments) determined by the charter of the checked subject, discrepancy of protocols of meeting of owners of rooms (apartments) to the Standard protocol of meeting of owners of rooms (apartments) to No. approved by the order of the Minister of national economy of the Republic of Kazakhstan of March 20, 2015 243, registered in the Register of state registration of regulatory legal acts for No. 10573.

3. Criteria for evaluation of risk degree for selective checks are created by means of objective and subjective criteria.
