for the purpose of elimination of technical barriers in economic trade relations, ensuring compatibility, interchangeability of products, its safety for life and health of the person, environmental protection,
expressing the aspiration to develop cooperation in the field of standardization, metrology and certification, proceeding at the same time from the principles and regulations accepted in this area by the international organizations
being guided by economic interests of both Parties,
agreed as follows:
The parties mutually recognize the operating state systems of standardization, ensuring unity of measurements and certification;
The parties mutually provide information and the regulating documentation (standards, indexes of standards and specifications, bulletins, magazines and other documents on standardization, metrology and certification) is in duplicate free with the subsequent right of replication, copying and realization in the territory of contracting parties on in addition agreed terms.
The either party can apply regulating documents on standardization, metrology and certification of other Party if their requirements do not contradict the established procedure entered by national authority on standardization, metrology and certification according to the current legislation of this state. The parties represent each other the right free of charge to enter fully or partially regulating documents and indexes of regulating documents of other Party into the national regulating documents and indexes of regulating documents.
The parties mutually recognize results of the state testing of approval of type, checking, calibration and metrological certification of measuring instruments, standard samples of structure and properties of substances and materials, standard help data and the organizations which carry out accreditation of testing and test laboratories and centers, and also the laboratories and the centers performing testing, checking and calibration of measuring instruments accredited by them.
The parties mutually recognize accredited bodies on certifications, test laboratories and the centers in the systems of certification issued by them certificates and marks of conformity on mutually delivered goods on in addition agreed terms.
Responsibility for safety of products is born by her manufacturer, and for reliability of certificates of conformity - the body which issued the certificate.
The parties communicate about the certification bodies planned to accreditation in national systems and can take part in their accreditation.
The parties interact in advanced training of personnel, establishment of direct connections between the companies and public organizations in preparation of regulating and organizational and methodical documents in the field of standardization, metrology and certification.
The parties mutually participate in the organization of seminars, meetings and conferences on questions of standardization, metrology, certification and management of quality.
The parties give mutual support in case of the accession to the international organizations in the field of standardization, metrology and certification which member is one of the parties, and in work of these organizations.
The parties inform each other on works in International Organizations for Standardization, metrology and certification which members consist vzaimoobespechivat texts of international standards.
The parties provide confidentiality of the obtained documentation and information on the works which are carried out within this Agreement and on the achieved scientific and technical results if the transferring party stipulates their confidentiality. The scientific technical information obtained by one of the Parties during cooperation can be transferred to the third party only on condition of the consent of the Party which provided this information.
The coordination of works provided by this Agreement, and their realization are assigned:
in the Republic of Kazakhstan - on Committee on standardization, metrology and certification (Gosstandart of the Republic of Kazakhstan);
in the Kyrgyz Republic - on the State inspectorate for standardization and metrology under the Government of the Kyrgyz Republic (Kyrgyzstandart).
Provisions of this agreement are implemented on the basis of the protocols and programs between Committee on standardization, metrology and certification of the Republic of Kazakhstan and the State inspectorate for standardization and metrology under the Government of the Kyrgyz republic providing:
further development, enhancement and harmonization of the state systems of standardization, ensuring unity of measurements and certification;
interaction in development of regulating and methodical documents on standardization, metrology and certification;
preparation and advanced training of personnel;
creation, enhancement and checking of national standards of units of physical quantities and initial model measuring instruments;
creation and application of standard samples of structure and properties of substances and materials, and also standard help data on physical constants and properties of substances and materials;
development of information activities in the field of standardization, metrology and certification.
The parties, if necessary, will create coordinating and working bodies for accomplishment of these protocols and programs.
This agreement does not affect the rights and obligations following from the agreements signed by the Parties in the field of standardization, metrology and certification with other states.
All disputes connected with accomplishment and interpretation of this agreement will be solved by negotiations and mutual consultations.
This agreement becomes effective from the date of its signing and is effective within 5 years and is automatically prolonged for the subsequent five-year period if one of the Parties does not notify in writing other Party on the intention to terminate this Agreement no later than six months before the expiration of its action. It is made in Almaty on April "8", 1997, in two authentic copies, everyone in the Kazakh, Kyrgyz and Russian languages, and all texts are authentic. In case of disagreements in interpretation of texts of the Agreement of the Party will be guided by the text in Russian.
