About creation of Public institution "Control center of the Developments of the Rural Zone project

1. Create Public institution "Control center of the project of Development of the rural zone" and approve the enclosed its Charter.

The executive agency of the Developments of the Rural Zone project to determine the Ministry of Agriculture and Environment of the Republic of Tajikistan.

2. To allocate to the state Committee on investments and management of state-owned property of the Republic of Tajikistan together with the Ministry of Agriculture and Environment of the Republic of Tajikistan the necessary room for placement of Public institution "Control center of the Developments of the Rural Zone project.

3. To public institution "Control center of the Developments of the Rural Zone project in coordination with the Ministry of Agriculture and Environment of the Republic of Tajikistan, the Ministry of Finance of the Republic of Tajikistan and Asian Development Bank to develop and approve structure, the staff list and expense budget on content of the office of Public institution "Control center of the Developments of the Rural Zone project.

4. To the Ministry of Finance of the Republic of Tajikistan annually when forming the Government budget to provide necessary funds for contribution of the Government of the Republic of Tajikistan for project implementation of "Development of the rural zone".

Charter of Public institution "Control center of the Developments of the Rural Zone project

I. General provisions

1. The public institution "Control center of the Developments of the Rural Zone project (further the Center) is single independent specialized organizational structure, on the basis of the agreement on credit financing and grant between the Government of the Republic of Tajikistan and Asian Development Bank of November 9, 2006 providing effective use of the credit and grant, provided by Asian Development Bank, for the purpose of development of the rural zone and pilot areas (Varzobsky, Vahdat, Rogunsky, Rudaki, Fayzobodsky).

2. The center performs the activities according to the legislation of the Republic of Tajikistan, other regulatory legal acts, the international legal acts recognized by the Republic of Tajikistan, recommendations Asian Development bank and this Charter.

3. The center is legal entity and according to the legislation of the Republic of Tajikistan has separate property, separate balance, settlement accounts in national and foreign currency in bank institutions, seal, stamps and forms with the name.

4. Names of the Center:

in Russian: Public institution "Control center of the Development of the Rural Zone project;

The center performs the activities during project implementation of development of the rural zone in pilot areas (Varzobsky, Vahdat, Rogunsky, Rudaki, Fayzobodsky). Duration of activities of the Center of 7 years.

II. Purposes and object of activity of the Center

7. Main objectives of activities of the Center are:

- timely and high-quality project implementation of development of the rural zone performed together with Asian Development Bank;

- ensuring target and effective use of the credit and grant of Asian Development Bank provided for project implementation to the Government of the Republic of Tajikistan.

8. Object of activity of the Center are:

- the organization of activities of the Center under the direction of the Ministry of Agriculture and Environment of the Republic of Tajikistan and together with the ministries and departments, local executive bodies of the government and the organizations;

- implementation of coordination and providing working conditions for the international, local consultants and project implementation specialists,

- carrying out prequalification selection with interested, the organizations, tendering process, assessment of the provided offers and contract signature;

- ensuring timely financing of the project and fee of the international and local consultants;

- implementation of purchases of goods, works and services in compliance e the legislation of the Republic of Tajikistan and procedures of Asian Development Bank;

- monitoring and quality control of the performed works on realization of components of the Project by the organizations and the executive agencies.

- conducting foreign economic activity and foreign economic relations which are directed to pas the solution of tasks on project implementation.

- participation in acceptance of the performed works and their delivery in the future to the organizations to users.

III. Rights and obligations of the Center

9. The center has the right:

- in the procedure established by the law to perform ownership, use and the order of the property of pas assigned to it the rights of operational management of property;

- sign agreements (contracts), acquire the property and non-property rights, participate in court as the claimant and the defendant;

- to independently organize the current and perspective activities;

- open settlement and currency accounts in banks of the Republic of Tajikistan;

- provide monitoring and assessment of work progress;

- make other actions which are not contradicting the legislation of the Republic of Tajikistan and the purposes of the Center.

10. The center shall:

- provide target and effective use of means of the credit and grant:

- according to the legislation of the Republic of Tajikistan to provide to the workers observance of the guarantees of the rights of citizens established by the state and to bear in accordance with the established procedure damage liability, put to their health and working capacity;

- perform operational and financial accounting of financial and economic activities, and also to keep statistical and accounting documentation;

- represent to the Government of the Republic of Tajikistan, the Ministry of Finance of the Republic of Tajikistan and to the Ministry of Agriculture and Environment of the Republic of Tajikistan quarterly, semi-annual and annual reports of receipt and development of means in the project progress.

IV. Formation of means and property

11. The center at the order has rooms, construction, the equipment, the stock and other property for ensuring the activities provided by this charter by the right of operational management.
