understanding the responsibility to this and future generation for prevention of world crisis, ecological disasters and catastrophic crashes, degradation of the environment and creation of ecologically harmless habitat;

in view of legislations of the Republic of Kazakhstan and the Kyrgyz Republic in the field of environmental protection and environmental management;

sure is that only together it is possible to keep the environment and natural wealth;

and also being guided by the Agreement between gosudarstvamiuchastnik of the Commonwealth of Independent States on interaction in the field of ecology and protection of the surrounding environment of February 8, 1992,

agreed as follows:

Article 1

The parties provide social and economic development of the states by preserving and improvement of the environment and natural objects on all space of action of this agreement;

provide optimum conditions, including economic incentives, to the legal entities and physical persons of one state extending and using ecologically safe technologies and the equipment conforming to normative requirements of other state;

inform each other, and also the third parties if it is necessary, about origin or possibility of ecologically dangerous phenomena and catastrophic crashes, jointly to participate in their prevention and liquidation;

Article 2

The parties will pursue coordinated policy on management, protection, reproduction and rational use:

- land and biological resources of mountain systems of the adjacent territories;

- the mineral resources relating to genetically single fields located in the territories of Kazakhstan and Kyrgyzstan;

- natural resources of cross-border value;

- water resources of the river of river of Chu, Talas, Karkara and the small rivers which are flowing down from ridges It is scarlet - Kyrgyzsky LLP, Kyungey and Terkey;

- populations of the migrating animals;

Article 3

The parties as priority for implementation of joint development determine the following programs:

- on the organization of recovery of forests in the adjacent territories;

- on fight against degradation of soils and vegetable cover of adjacent regions of Kazakhstan and Kyrgyzstan;

- on the organization and implementation of permanent environmental monitoring.

Article 4

For the purpose of effective use of intellectual, material and financial resources of the Party determine as general tasks:

- development and implementation of scientific and technical and comprehensive programs of environmental protection and rational use of the natural resources infringing on interests of both states;

- coordination of works on creation of systems of normative and technical ensuring environmental protection and ecological safety, including technical, environmental, sanitary and hygienic and other standards, standard rates and rules;

conducting joint state environmental assessment of projects of the planned economic activity and forecasting of ecological situation in the adjacent territories;

use of the general principles of ecological interstate regulation of state of environment and the environmental management, including the general principles of compensation of losses applied as a result of cross-border impacts on the environment;

- development of joint actions for improvement of ecological situation in the Aral basin;

coordination of actions for protection of the migrating animals, and also the animal species living in the territories of both states.

Article 5

The parties are determined that the rare and endangered species of animals and plants included in the Red List, one of the states and living in the territory of other state, are subject to special protection in all territory of operation of the Agreement. The procedure for their use in scientific and other purposes will be determined by special agreements specifically for each type.

Article 6

The parties will take measures for creation of mutually agreed system of especially protected natural territories on all space of operation of the Agreement and to carrying out on its base of mutually agreed works, including the scientific research directed to preserving biological diversity and maintenance of natural balance.

The parties will promote creation in regions of general frontier of system of the rational and joint especially protected natural territories.

Article 7

The parties will perform exchange of information in the field of protection of the surrounding environment, to jointly hold conferences, seminars, public ecological actions, other actions for activation of nature protection activities of the population, promotion of ecological knowledge.

Article 8

The results of cooperation received in case of accomplishment of this agreement can be transferred to the third states, their legal entities or physical persons only with the consent of the Parties.

Article 9

The departments responsible for the organization and coordination of cooperation within this agreement, are:

from the Republic of Kazakhstan - the Ministry of ecology and bioresources;

from the Kyrgyz Republic - the Ministry of environmental protection.

The specified departments develop working plans of cooperation and on joint sittings of the representatives approve, and also consider other questions connected with accomplishment of this agreement.

Meetings of representatives of the specified departments are held serially, in the Republic of Kazakhstan and the Kyrgyz Republic, as required, but at least once a year.
