1. Approve:

1) criteria for evaluation of risk degree in the field of use and protection of water fund of the Republic of Kazakhstan, safety of dikes according to appendix 1 to this joint order;

2) checking leaf in the field of use and protection of water fund of the Republic of Kazakhstan, safety of dikes according to appendix 2 to this joint order.

2. Recognize to invalid:

1) the order of the Minister of Agriculture of the Republic of Kazakhstan of May 3, 2011 No. 24-03/230 "About approval of form of checking leaf in the field of use and protection of water fund of the Republic of Kazakhstan (except for spheres of private entrepreneurship)" (registered in the Register of state registration of regulatory legal acts for No. 6957, No. 194 published on June 21, 2011 (26615) in the Kazakhstanskaya Pravda newspaper);

2) the joint order of the acting minister of agricultural industry of the Republic of Kazakhstan of July 13, 2015 No. 19-2/645 and the acting minister of national economy of the Republic of Kazakhstan of July 31, 2015 No. 579 "About approval of criteria for evaluation of risk degree and form of checking leaf in the field of use and protection of water fund of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts for No. 11983, published on September 22, 2015 in information system of law of Ad_let).

3. To committee on water resources of the Ministry of Agriculture of the Republic of Kazakhstan, in the procedure established by the legislation to provide:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) the direction of the copy of this order within ten calendar days from the date of its obtaining in the Republican state company on the right of economic introduction "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

4) placement of this joint order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and on the intranet portal of state bodies.

4. To impose control of execution of this joint order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This joint order becomes effective after ten calendar days after day of its first official publication.

Criteria for evaluation of degree of risks in the field of use and protection of water fund of the Republic of Kazakhstan, safety of dikes

1. These Criteria for evaluation of degree of risks in the field of use and protection of water fund of the Republic of Kazakhstan, safety of dikes (further - Criteria) are developed in compliance with the Entrepreneurial code of the Republic of Kazakhstan of October 29, 2015 for reference by basin water inspectorates of primary water users who are carrying out water intake from water objects on degrees of risks.

2. In these Criteria the following concepts are used:

1) the subject of control - the physical persons and legal entities, public institutions, the state companies and non-profit organizations which are carrying out water intake directly from water objects for satisfaction of own needs or its delivery for secondary water users, and also the organizations the performing operations of hydraulic engineering constructions, regulation of superficial drain for providing different industries of economy using services of the water management organizations and receiving water from water supply systems for production and technical needs (primary water users) and carrying out works on water objects and their water protection zones and strips;

2) insignificant violations - violations of requirements of the legislation of the Republic of Kazakhstan in the field of use and protection of water fund of the Republic of Kazakhstan, safety of dikes in part - hindrances of regulation of water resources, not observance of the established water servitudes, absence, and also failure of seal on water-measuring devices, lack of the passport of water management construction, availability of claims and addresses upon violation of the established water servitudes, information from state bodies, on violation of the established water servitudes, taking into account severity of its effects attracting the administrative responsibility;
