Approve Regulations on procedure and the size of employee benefit of the State committee of judicial examinations of compensation for use of the vehicles belonging to them in the office purposes it (is applied).

Regulations on procedure and the size of employee benefit of the State committee of judicial examinations of compensation for use of the vehicles belonging to them in the office purposes

1. This Provision determines procedure and the size of employee benefit of the State committee of judicial examinations (further – employees) compensations for use of the vehicles belonging to them in the office purposes (further – compensation).

2. The employees using the vehicles belonging to them (further - private vehicles) in the office purposes, receive compensation of cost of the fuels and lubricants spent for these purposes in terms of money. The extreme amount of compensation constitutes five basic sizes a month on structural division of body of the State committee of judicial examinations (further - structural division).

Other expenses connected with use of private vehicles in the office purposes (depreciation (depreciation), repair, obligatory civil liability insurance of owners of vehicles, losses for the harm done to the vehicle, losses for the harm done by the vehicle, and another), employees bear at own expense.

3. Compensation payment to employees is made in cases if their service according to service duties is connected with permanent (daily) trips on the office vehicle, except for special vehicles, and in structural division in which employees serve, the number of office vehicles are less, than is established by regulations of polozhennost of vehicles, or the office vehicle assigned to structural division in a row is not used more than 30 calendar days (is under repair, process of write-off and other).

In the cases specified in part one of this Item, compensation is paid if necessary to several employees of the same structural division according to regulations of polozhennost of vehicles within the set run limits.

4. For receipt of permission to use of the private vehicle in the office purposes and compensation the employee submits respectively addressed to the Chairman of the State committee of judicial examinations, the head of department of the State committee of judicial examinations on area, Minsk the written official report with reasons for need of use of the private vehicle for the office purposes.

The official report of the employee of central office of the State committee of judicial examinations, managements of the State committee of judicial examinations on area, Minsk approves its direct and higher chiefs, and the official report of the employee district (interdistrict), city, district (interdistrict) department of the State committee of judicial examinations in Minsk - the chief of this department.

5. After consideration of the official report by the head specified in part one of item 4 of this provision in case of receipt of permission to use of the private vehicle in the office purposes the usage agreement of the private vehicle in the office purposes (further - the agreement) is signed with the employee in which including are specified:

the name, the state number of the used private vehicle in the office purposes;

certificate number about state registration (technical data sheet) of the private vehicle;

obligation according to central office of the State committee of judicial examinations, management of the State committee of judicial examinations on area, Minsk on compensation payment;

duration of the agreement.

The copy of the certificate on state registration (technical data sheet) of the private vehicle certified in accordance with the established procedure is attached to the agreement.

6. In case of compensation payment to several employees of the same structural division according to Item part two 3 limiting this provision the amount of compensation for each of employees is determined in proportion to the incurred expenses proceeding from the extreme amount of compensation provided in Item part one 2 this provision. Compensation is paid to employees in the month following for reporting along with payment of cash allowance.

7. For preparation of calculation for payment of compensation by the employee using the private vehicle in the office purposes no later than the 5th following reporting the report in which are specified position, special rank, surname, own name, middle name (if that is available) of the employee, the name, certificate number about state registration (technical data sheet), the state number, use period in the office purposes of the private vehicle, its run according to indications of speedometer goes to financial and economic division of body of the State committee of judicial examinations. The payment document confirming acquisition of fuels and lubricants (their cost) is attached to the report.

The report constituted and signed by the employee of central office of the State committee of judicial examinations, managements of the State committee of judicial examinations on area, Minsk the immediate superior and constituted and signed by the employee district (interdistrict), city, district (interdistrict) department of the State committee of judicial examinations in Minsk, - the chief of this department approves it.

The report affirms respectively the Chairman of the State committee of judicial examinations or person authorized by it, the head of department of the State committee of judicial examinations on area, Minsk.

Calculation of the amount of compensation is made by financial and economic division of body of the State committee of judicial examinations.

8. The basis for compensation payment to employees is respectively the order of the Chairman of the State committee of judicial examinations, the head of department of the State committee of judicial examinations on area, Minsk.

9. The employees who provided false information on use of private vehicles in the office purposes bear responsibility according to legal acts.

10. The officials making the decision and approving documents on payment of compensation according to this Provision bear the personal responsibility for justification of its payment.
