About approval of the Technique of determination of rates of payments for use of fauna

1. Approve the enclosed Technique of determination of rates of payments for use of fauna.

2. To provide to committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Technique of determination of rates of payments for use of fauna

1. General provisions

1. This Technique of determination of rates of payments for use of fauna (further - the Technique) is developed according to the subitem 7) of Item 1 of article 9 of the Law of the Republic of Kazakhstan of July 9, 2004 "About protection, reproduction and use of fauna" (further - the Law) and is applied to determination of rates of payments for use of fauna.

2. Determination of rates of payments for use of fauna is made on basis:

1) normative limit of production - standard rates of withdrawal of the animal species which are subjects to hunting, approved by authorized body according to the subitem 5) of Item 1 of article 9 of the Law;

2) coefficients of surplus of animals and production;

3) quantities of animals (its animal parts and derivatives withdrawn from the habitat).

3. The payment for use of the rare and being under the threat of disappearance animal species is established in each separate case by the Government of the Republic of Kazakhstan in case of issue of permission to withdrawal of these animals from the environment.

4. The payment is not levied:

1) in case of withdrawal from the environment of animals for the purposes of branding, banding, resettlement, acclimatization, artificial culture and crossing in the research and economic purposes with subsequent their release to the environment;

2) when using the objects of fauna which are property of the physical persons and legal entities divorced in the artificial way and containing in bondage and (or) semi-free conditions;

3) when implementing by authorized state body in the field of protection, reproduction and use of fauna of test fishing of fishes and other water animals for the purpose of biological reasons on use of fish resources and other types of water animals;

4) in case of withdrawal of animal species which number is subject to regulation for the purpose of public health care, protection from diseases of farm and other pets, prevention of environmental damage, the prevention of danger of causing essential damage of agricultural activities.
