1. Approve the enclosed Rules of accounting of the notifications sent by control facilities and supervision to the authorized body performing within the competence statistical activities in the field of legal statistics and special accounting.

2. To provide to committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan (further - Committee):

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican state company on the right of economic vision "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for placement in Reference-control bank of regulatory legal acts of the Republic of Kazakhstan;

2) the direction of this order to the interested subjects of legal statistics and special accounting, and also to territorial authorities of Committee for execution.

3. To impose control of execution of this order on the Chairman of Committee.

4. This order becomes effective after ten calendar days from the date of its first official publication.

Rules of accounting of the notifications sent by control facilities and supervision to the authorized body performing within the competence statistical activities in the field of legal statistics and special accounting

1. General provisions

1. These rules of accounting of the notifications sent by control facilities and supervision to the authorized body performing within the competence statistical activities in the field of legal statistics and special accounting (further - Rules), are developed in pursuance of the Laws of the Republic of Kazakhstan of December 22, 2003 "About the state legal statistics and special accounting", of June 30, 2017 "About prosecutor's office".

2. Rules determine procedure for accounting of the notifications which are not subject to registration according to article 146 of the Entrepreneurial code of the Republic of Kazakhstan, sent by control facilities and supervision to the authorized body performing within the competence statistical activities in the field of legal statistics and special accounting.

3. In these rules the following concepts are used:

1) accounting of the notifications sent by control facilities and supervision to the authorized body performing within the competence statistical activities in the field of legal statistics and special accounting (further - accounting of notifications) - complex of the actions for accounting sent to bodies of legal statistics and special accounting of notifications on carrying out the state control and supervision, and also to provision of the relevant information accounting documents;

2) subjects of accounting - the state bodies authorized by the laws of the Republic of Kazakhstan on conducting checks and other forms of control and supervision of activities of physical persons, legal entities, including state bodies, branches and representations of legal entities behind which activities control and supervision are exercised;

3) the checked objects - the property which is on the property right or other legal cause at the checked subject, subject to control and supervision;

4) the checked subjects - physical persons, legal entities, including state bodies, branches and representations of legal entities behind which activities control and supervision are exercised;

5) authorized body - the state body performing within the competence statistical activities in the field of legal statistics and special accounting, authorized on accounting of the notifications directed by control facilities and supervision;

6) the electronic information accounting document (further - EIUD) - the carrier of legal statistical information in electronic form based on which data of the state legal statistics and special accounting are created.

4. Accounting of notifications is performed for the purpose of collection, accounting, the analysis and provision to state bodies, physical persons and legal entities of the reliable and sufficient legal statistical information created by results of checks and other forms of control and supervision which are carried out by state bodies of the Republic of Kazakhstan.

5. The accounting procedure of notifications includes:

1) accounting in authorized body of the notifications sent by control facilities and supervision to authorized body;

2) provision of electronic information accounting documents.

6. Accounting of the notifications directed by control facilities and supervision is performed by authorized body in the location of the checked subject (object).

7. Accounting of notifications is performed by exposure of EIUD sent by control facilities and supervision to authorized body in form according to appendix 1 to these rules (further - card No. 1-U).

8. The employee of authorized body no later than one working day from the moment of receipt of card No. 1-U sends to subjects of accounting the message on accounting of notifications with indication of accounting number.

9. According to Item 8 of article 137 of the Entrepreneurial code subjects of accounting no later than three working days after creation of the act of results of control enter data on analysis results of other forms of control and supervision in the database of the Unified register of subjects and objects of checks (ERSOP) by filling of card No. 1-U.

10. Details of card No. 1-U are subject to filling with person performing carrying out the state control and supervision.
